THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF THE SALVADOR,

CONSIDERING:

I.- That on 15 December 1989, it was adopted at the Forty-fourth Session of the United Nations General Assembly, by resolution 44/128, the Second Optional Protocol to the International Covenant on Civil and Political Rights to Abolish the Death Penalty.

II.- That the Instrument referred to in the previous consideration has been approved by Executive Agreement No. 1917/2012 of December 5, 2012, and submitted for consideration by this Legislative Assembly for inclusion in the Salvadoran legal system, in force and positive.

III.- It is appropriate to ratify the Instrument by establishing an express reservation in accordance with the authority granted in Art. 2 of the Protocol, which is to apply the death penalty, as provided for in Art. 27 of the Constitution.

TANTO,

in use of the authority established in Art. 131, ordinal 7th of the Constitution in relation to Art. 168, ordinal 4 of the same, and at the initiative of the Deputy Minister of Foreign Affairs, Integration and Economic Promotion, in charge of the office.

RIGHT:

Art. 1.- Ratify the Second Optional Protocol to the International Covenant on Civil and Political Rights to Abolish the Death Penalty, which consists of a preamble and eleven articles; adopted and proclaimed at the Forty-fourth Session of the General Assembly of the United Nations, by resolution 44/128 of 15 December 1989, adopted by the Executive Body, by Agreement No. 1917/2012 of 5 December 2012, with express reservation in accordance with the authority granted to Art. 2 of the Protocol, which is to apply the death penalty, as provided for in Art. 27 of the Constitution of the Republic of El Salvador.

Art. 2.- This Decree shall enter into force eight days after its publication in the Official Gazette.
