1 Decree Nº 682 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that the Constitution of the Republic of El Salvador establishes in its article 93, that international treaties regulate the form and conditions on which nationals of countries that were not part of the Federal Republic of Central America retain their nationality, however purchasing the Salvadoran by naturalization , provided that the principle of reciprocity is respected.
II.-that to this effect, the immigration law since 1986, has chosen in its article 50 by requiring Express renunciation of the nationality of origin, in which can lead to difficulties with certain States which, although not that formed part of the Federal Republic of Central America, have domestic legal systems that do allow their national origin enjoy a dual or multiple nationality.
III.-that in accordance with article 94 of the Constitution, the Salvadoran nationality by naturalization can lose, so considering this possibility, and the effect of article 50 of the law on aliens, are the circumstances that can lead to cases of statelessness.
IV.-that the General Assembly of the United Nations, by resolution A/RES/50/152, on 9 February 1996, has called for the States of the world to enact laws concerning nationality, with a view to the reduction of statelessness, in line with the principles of international law and, in particular, prohibiting arbitrary of nationality deprivation and repeal provisions allowing to renounce the nationality, without possessing or acquiring previously, recognizing, at the same time, the right of States to enact laws governing the acquisition, renunciation or loss of nationality.
V for all of the above, it is essential to introduce relevant reform to the Aliens Act.
Therefore, in use of his constitutional powers and at the initiative of the President of the Republic, by the Minister of Justice and public security, DECREED the following: reform to the law of aliens 2 article 1.-replace article 50, first subparagraph, first part and its final paragraph by the following: "Art.50.-in the swearing in ceremony, the Minister or Deputy Minister of Justice and public safety" ", it interrogará to the Acceptor in the following terms:" "If the acceptor is originally from a State that did not form part of the Republic of Central America, and between that State and El Salvador Federal, any existing treaties which, while respecting the principle of reciprocity, determining that the acceptor had to renounce their nationality of origin to be able to acquire the Salvadoran by naturalization also the first of the questions listed in the subparagraph first of this article must be formulated."
Art.2.-this Decree shall enter into force eight days after its publication in the official journal.
