DECREE NO 702
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
WHEREAS:
I. That by Legislative Decree No. 232 dated December 14, 2012, published in Official Journal No. 8, Volume No. 398 of 14 January 2013, the Special Law for the Constitution of the Fund for the Attention to Victims of Accidents of Transit.
II. That the Law referred to in the previous recital, creates the Fund for the Attention to Victims of Traffic Accidents, called FONAT, which is financed, among others, by a special contribution established in it.
III. That the recovery of the aforementioned contribution was declared unconstitutional by the Constitutional Chamber of the Supreme Court of Justice, also establishing that the collection of the contribution made
before the suspension of the recovery On July 15, 2013, the amount of which
amounts to EIGHT MILLION HUNDRED AND SIX THOUSAND EIGHTY-FIVE DOLLARS FROM THE UNITED STATES OF AMERICA (US$8, 106,085.00), has legal validity.
IV. That of the total revenue received for the collection made before the suspension, referred to in the previous recital, was transferred to the FONAT in the fiscal year 2013, the amount of FIVE MILLION
TWO HUNDRED AND SIXTY-EIGHT THOUSAND NINE HUNDRED AND FIFTY-SIX DOLLARS FROM THE STATES
UNITED OF AMERICA (US$5, 268,956.00), remaining pending to transfer to the Health Ramo the amount of TWO MILLION EIGHT HUNDRED AND THIRTY-SEVEN THOUSAND HUNDRED TWENTY-NINE DOLLARS
UNITED STATES OF AMERICA (US$2,837,129.00), which was not incorporated in the budget of the fiscal year 2013, corresponding to that Secretary of State.
V. That the General Budget of the State of the Fiscal Financial Year in force of 2014 does not include the resources previously related, which are required in this opportunity by the Ministry of Health, for the fulfillment of the privileges granted by the Special Law for the Constitution of the Fund
for the Attention to Victims of Traffic Accidents, in relation to coordinating and providing health care services, in order to attend to every victim resulting from an accident of
VI. That for the reasons set out above and with the purpose that the Health Ramo can use the resources that correspond to the collection explained above, it is necessary to modify the Law of the Budget, approved by Legislative Decree No. 522, Date 31 October 2013, published in the Journal
Official No. 225, Volume 401, of December 2 of the same year, in the part of revenue and expenses concerning said Ramo, with the amount of TWO MILLION EIGHT HUNDRED AND THIRTY-SEVEN THOUSAND
HUNDRED AND TWENTY-NINE DOLLARS FROM THE UNITED STATES OF AMERICA (US$2,837,129.00).
