1 Decree No. 732 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that aired the port maritime General Law, through which the maritime port authority was created by Legislative Decree No. 994 of date September 19, 2002, published in the journal official No 182, volume no. 357, of October 1 of the same year, , by its acronym AMP, as an autonomous institution of the public service responsible for exercising economic and technical regulation of maritime and port activities in El Salvador.
II.-in accordance with provisions of law General maritime port, the autonomy of the AMP, includes administrative, technical and financial, in addition, establishing that such entity has legal personality and own patrimony.
III.-that the heritage of the AMP includes, among others, real estate purchase with the product of their income and that are necessary for the achievement of their institutional ends of promote, supervise, monitor, control and regulate maritime and port activities at the national level.
IV. that the AMP is currently exerting fully the institutional competencies, which the port General maritime law, however, lacks facilities for the development of their activities, both at the central level and in different coastal areas of the country, a situation that entails important expenditures in respect of renting of buildings.
V-port General maritime law, currently not granted expressly to the AMP, the Faculty for the contracting of credits, which allow the purchase of real estate; so it becomes necessary to reform the port maritime General Law, in this sense.
Therefore, use of his constitutional powers and at the initiative of the President of the Republic, by the Minister of public works, transport and housing and urban development.
DECREES the following: reforms to the law GENERAL maritime port article 1.-added to article 10, in its second paragraph, paragraph 28, in the following manner: "28.-hire, prior authorization of the governing body of the AMP and check of capacity 2 of indebtedness with the Ministry of finance, more than a year term loans, in order to acquire real estate anywhere in the national territory" , for the operation of administrative and operational offices of the AMP, guarantee them in any legal form, even constitute a mortgage lien on the aforementioned goods; all according to the existing policies of the Government in respect of indebtedness."
Article 2.-two Adicionanse final clauses article 18, in the following manner: "the AMP, prior authorization of the governing body of the same, and verification of its borrowing with the Ministry of Finance capacity, may contract more than a year term loans, in order to acquire real estate anywhere in the national territory, for the functioning of its administrative and operational offices; guarantee them in any legal form even constitute a mortgage lien on these assets.
In the event that the obligations for the acquisition of goods referred to in the preceding paragraph, beyond a fiscal year, the respective annual amount, must be incorporated in the institutional budget, which must be submitted for consideration and approval of the Ministry of finance for its subsequent presentation and approval of the Legislative Assembly."
Article 3.-this Decree shall enter into force eight days after its publication in the official journal.
