DECREE NO 732

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 994 dated September 19, 2002, published in the Official Journal No 182, Volume No. 357 of October 1 of the same year, the General Maritime Port Law was issued, by means of which the Harbour Maritime Authority has been created, by its acronym, as an Autonomous Institution, of service public, responsible for exercising the technical and economic regulation of maritime and port activities in El Salvador.

II.-That in accordance with the provisions of the General Maritime Port Law, the autonomy of the AMP, includes the administrative, technical and financial, also establishing that the entity has legal personality and its own patrimony.

III.-That the equity of the AMP includes, among others, real estate that it acquires with the product of its revenue and which are necessary for the achievement of its institutional aims of promoting, to monitor, monitor, control and regulate maritime and port activities at national level.

IV.   That currently the AMP is fully exercising the institutional competences, that the General Law of the Harbour Harbour assigns to it, however, it lacks own facilities for the development of its activities, both at the central level, and in the different coastal areas of the country, a situation that carries important relocations in the concept of leasing of buildings.

V.-That the General Law of the Port of the Port, currently does not expressly grant to the AMP, the faculty for the (i) the purchase of credit, which will allow the acquisition of immovable property; It is necessary to reform the General Maritime Port Law, in this sense.

BY TANTO,

in use of its Constitutional powers and on the initiative of the President of the Republic, through the Minister of Public Works, Transport and Housing and Urban Development.

DECRETA the following:

REFORMS TO THE PORT MARITIME GENERAL LAW

Art. 1.-Add to Art. 10, in its second indent, the numeral 28, as follows:

of indebtedness to the Ministry of Finance, loans greater than one year, in order to to acquire real estate in any part of the national territory, for the operation of administrative and operational offices of the AMP, being able to guarantee them in any legal form, even to constitute a mortgage charge on the aforementioned goods; all in accordance with the current policies of the Government in the field of indebtedness. '

Art. 2.-Add two final points to Art. 18, as follows:

" The AMP, after authorization from the governing body, and verification of its debt capacity with the Ministry of Finance, may take out loans greater than a year, in order to acquire real estate, in any part of the national territory, for the operation of its administrative and operational offices; it may guarantee them in any legal form even to constitute a mortgage charge on the said goods.

In case the obligations acquired for the the acquisition of the goods referred to in the preceding subparagraph, transcending a fiscal year, the respective annual amount, must be incorporated, in the annual institutional budget, which must be submitted for consideration and approval by the Ministry of Finance for its subsequent presentation and approval of the Legislative Assembly. "

Art. 3.-This Decree will enter into force eight days after its publication in the Official Journal.
