DECREE NO 808
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
CONSIDERING:
I.-That by Legislative Decree No. 665 dated March 7, 1996, published in Official Journal No. 58, Volume No. 330, on the 22nd of the same month and year, the Law of the Teaching Career was issued in order to guarantee that the teaching is carried out by educators registered in the Register of Education of the Ministry of Education.
II.-That according to the number 4) of Art. 5 of the aforementioned Law, it is established as the duty of the Ministry of Education, to reach, among other objectives, to provide and guarantee, as far as possible, full occupation to the trained educators.
III.-That in Art. 18 of that same Law, the procedure to be followed for the assignment of the vacant places, new or old of the teachers at the service of the State is established and that through the application of this procedure, the teachers graduated by the country's various universities, have little opportunity to obtain one of These places, due to the preference that according to the Law, are given to the teachers based on the right of transfer, the seniority of the same in the service and their re-entry.
IV.-That year with year the number of graduates, which makes it increasingly difficult for them to be able to obtain a place in the public sector; therefore, it is necessary to lay down rules of exception and transition, which allows teachers to agree to seniority of your graduation, access those places.
V.-That it is important to prioritize selection criteria for those places, taking into consideration the age of their year of graduation, the specialty and their place of residence with the applicant educational center of the square.
VI.-That dated May 7, 2010 was issued Legislative Decree No. 346, published in the Official Journal No 103, Volume N ° 387, dated 3 June of the same year, whereby it is established that for the period of one year, the new places or vacancies which the Ministry of Education publishes for any cause, would be assigned by the bodies concerned, on a permanent basis, only to educators who have not obtained never appointing a teacher's place within the public sector and who will have the required specialty.

DECRETA:
Art. 1.-The new or vacant places which the Ministry of Education publishes for any cause, in the period of one year from the time of the present Decree, shall be assigned by the corresponding bodies, on a permanent basis, only to aspiring educators who have never obtained appointment as a teacher's place within the public sector and who have the required specialty.
As set out in the previous paragraph, it will also be applicable to the places published on September 7 of the year two thousand fourteen, prior to the entry into force of the present Decree, by the Ministry of Education.
Art. 2.-To grant the said places, the seniority of the year of graduation, the specialty and the place of residence of the applicant will be taken into account.
For the application of the specialty it must be understood that the Licensas and Licensas Education Sciences in their different options and teachers trained in other specialties such as Social Studies, Biology, Letters, Mathematics, are trained to work in the levels of first, second and third cycles of education base and media.
Art. 3.-During the period established in this Decree, the Qualifier Tribunal will grant the seats; for this purpose, the teachers must present the required documentation according to the requirements laid down in the Law of the Teaching Career.
Art. 4.-If in the contest of the places, there is a level playing field among the applicants, the Qualifier Court will assign them according to the results obtained in the selection tests administered to the aspirants of such places.
Art. 5.-This Decree shall enter into force on the day of its publication in the Official Journal.
