Original Language Title: LEY ESPECIAL PARA LA REGULACIÓN Y CONTROL DE LAS ACTIVIDADES RELATIVAS A LA PIROTECNIA.

1. Decree No. 810, the Legislative Assembly of the Republic of EL SALVADOR: I.-that the Constitution establishes in its article 1, which El Salvador recognizes the human person as the origin and purpose of the activity of the State, therefore, is the duty of this ensure its inhabitants the enjoyment of the rights of freedom health, culture, economic well-being and social justice.
II.-that the Constitution of the Republic in their articles 2, 35 subsection first and 44 subsection first, sets between others it obligation of the State, of protect the right to it life, it integrity physical and the health of the population general and of them minor in particular; and ensure that it complies with the conditions that must meet the workshops, factories and workrooms.
III. that article 217 of the Constitution of the Republic establishes that the development of the activities of manufacturing, import, export, trade in weapons, ammunition, explosives and similar items, only may be carried out with the permission and under the direct supervision of the Executive Body in the field of defence; establishing also that a law special will regulate this matter.
IV. that by means of Legislative Decree N ° 655, on July 1, 1999, published in the official journal N ° 139, Tome N ° 344, July 26, 1999, was issued the law of Control and regulation of arms, ammunition, explosives and similar articles, being incorporated aspects on pyrotechnic products or substances relating to the pyrotechnics, through amendments to the aforementioned Act; merging as well, the concept of national defense two related but distinct subjects in terms of its regulation and control.
V that because of the above and after the passing of the years, it has been confirmed the need and importance of the creation of a special law, which regulates activities related to the import, storage, transportation, manufacturing, marketing, handling, internment and export of pyrotechnic products or pertaining to pyrotechnics substances; Since currently it is framed under the Act for the Control and regulation of arms, ammunition, explosives and similar items, requiring a full identification of the importance that has having its own rules, which is consistent with national and international law.
Therefore, in use of its powers constitutional and to initiative of the then President of the Republic 2 by means of the Minister of Interior, both of the period presidential 2009-2014; members of the legislature 2012-2015 Othon Sigfrido Reyes Morales, Edmundo Cabrera Chacón Yohalmo, Carlos Cortez Hernandez, Dario Alejandro girls Argueta, Benito Antonio Lara Fernández, Reynaldo Antonio López Cardoza, Sigifredo Ochoa Pérez, Orestes Fredesman Ortez Andrade, Ramon Aristides Valencia Arana; and with the support of the Deputy Mártir Arnoldo Marín Villanueva.
DECREES, as follows: law special for the regulation and CONTROL of the activities relating to LA PYROTECHNICS title I Chapter single object, competition and field of application object article 1.-the present law is intended to regulate and control the activities related to the import, internment, storage, transportation, manufacturing, marketing, handling and export relating to pyrotechnics substances or pyrotechnical products as well as punish violations of this law.
Competition article 2.-is the application of this law to the Ministry of national defence through the Directorate of logistics; which it shall authorize and oversee the activities contained in the previous article, prior favourable opinion, depending on the case, of the institutions directly related. It will also impose sanctions corresponding to who violates this law, without prejudice to the civil or criminal liability to any place.
He Ministry of governance and development Territorial, through the body of fire of El Salvador, will issue them certifications of compliance of them measures of security against fire and accidents of them places of manufacturing, storage, marketing, media of transport and places for the manipulation of products pyrotechnic or substances relating to the pyrotechnics, prior inspection corresponding.
He Ministry of Justice and security public, through the police National Civil, has the function of prevent the found of them violations to the present law; and through his arms and explosives Division, it will pursue and investigate the violations committed; also execute the functions of control and regulation laid down in this law.
The Ministry of health, through the corresponding health units, will issue the certification of compliance with sanitary measures to effect ensure the prevention of injuries, disabilities, and deaths caused by pyrotechnic products or substances relating to the pyrotechnics.
The municipal authorities will propose to the Cuerpo de Bomberos de El Salvador, the place for the installation of temporary collective sales and handling of pyrotechnic products. As well as allowing 3 installation of the boards of the same sales, prior technical guarantee of compliance with the security measures.
Scope of application article 3.-this law applies within the national territory to all persons, natural or legal, who develop activities that makes reference in this law and its regulations, that was their nationality, domicile or residence.
Names article 4.-for the purposes of this Act, be used the following designations: 1. Technical Commission: to refer to the Technical Committee of evaluation and Control of pyrotechnic products and substances relating to the pyrotechnics;
2 municipalities: to refer to the municipal authorities;
3. body of fire: to refer to the Cuerpo de Bomberos de El Salvador;
4 DAE: to refer to the Division of arms and explosives from the police National Civil;
5. MRNA: to refer to the Ministry of environment and natural resources;
6 MDN: to refer to the Ministry of national defense;
7 MINSAL: to refer to the Ministry of health;
8. MIGOBDET: to refer to the Ministry of the Interior and Territorial Development;
9 MJSP: to refer to the Ministry of Justice and public security; and, 10. PNC: to refer to the National Civil Police.
Definitions article 5.-for the purposes of this law, the following definitions are established: 1. articles similar to explosives: any element, substance or product, that their properties or in combination with another element, substance or product, can produce an explosion, deflagration, propulsion or pyrotechnic effect; action initiator, pyrotechnic, electrical, chemical or mechanical;
2 Winery to store Fireworks product: local intended to store Fireworks product;

3-4. Cellar to store relative to pyrotechnics substances: local intended to store material and substances that will be used in the manufacture of pyrotechnic products;
4 rocket: establishment or place where combinations or mixtures of substances and matter are raw materials used for the manufacture of pyrotechnic product;
5. control: Action Verify and by the delegates of the Committee on technical compliance with this Act and its regulations;
6 delegate of the technical Commission: technical personnel of each one of the institutions that make up the Technical Committee;
7. manufacturing: the process of transformation of substances relating to the pyrotechnics and other materials for the production of pyrotechnic products;
8. Audit: audits to natural or legal persons engaged in activities regulated by this law and its regulations;
9 import: action giving rise to the motion for entry of merchandise to the national territory by legally established places, pyrotechnic products or substances relating to the pyrotechnics, from a country outside the Central American region;
10 export: action giving rise to the commercial movement to the exit or exit by legally established places, pyrotechnic products or substances relating to the pyrotechnics, outside the national territory, to any country of destination;
11. internment: action giving rise to the commercial movement for the entry of merchandise to the national territory by the places legally established, relating to pyrotechnics substances or pyrotechnic products, originating in a country in the Central American region;
12. inspection: verification carried out by members of the institutions that make up the technical Commission, jointly or separately, compliance with security measures established by this law and other applicable requirements.
13. concerning the pyrotechnic substance: raw material used for the manufacture of pyrotechnic products or articles similar to them;
14 mix pirica: any combination or composite that has properties that are used for different pyrotechnic applications which cause explosion, deflagration, or lights;
15 chemical precursor: are all those chemicals that are used for the production, manufacture and preparation of pyrotechnic products;
16. product pyrotechnic: any composition or device of manufacturing industrial or 5 craft that combine elements and compounds chemical, in order produce a combustion or detonation controlled with effects lights and/or sound, own for activities of fun and recreation;

17. registration of data: System or base of information permanently updated of form physical documentary and computerized, that will allow control the substances relating to the pyrotechnics; as well as import, admission, export, production and marketing of pyrotechnic product;
18 room sale of pyrotechnic product: permanent place intended to market Fireworks product retail and wholesale;
19. system of protection against fire: are those teams that is require to minimize them risks of fire and can consist in sprinkler automatic, detectors of smoke and of heat, fire extinguishers, alarms manual, sources own of supply of water with their respective accessories and equipment;
20. handling: lawful use of any pyrotechnic product or substance relating to the pyrotechnics, in authorized places;
21. pyrotechnic companies: are those engaged in the import, internment, manufacture, storage, transport, marketing or export of pyrotechnic products or substances relating to the pyrotechnics;
22. pyrotechnics: it is the art of creating Fireworks with lighting, sound effects and fumigants;
23 Fireworks: event that is performed as entertainment products made from pirica mixture in any of the presentations, authorized pursuant to this Act;
24. kiosks: are those places authorized for sales time in centers commercial;
25 collective sales: in case of several temporary sales, where authorized and designated by the municipalities; and 26. Pyrotechnic craft person: is one that carries a manual or creative activity that has the experience and knowledge necessary to become a pyrotechnic product, with the help of simple tools and simple machinery relating to pyrotechnics substances.
Title II licenses and permissions chapter I licenses 6 license article 6.-document non- transferable which will be extended by the MDN, any natural person who required, in accordance with the activities regulated by this law, prior compliance with the requirements established for this purpose.
License empowers the person possessing the requested activity, according to the classification of this law.
Obtaining the license will be essential and mandatory for all persons carrying out one or more of the activities set out in this Act and its regulations.
The term of any of the mentioned licenses under this Act, shall be five years.
Classification and definition of licenses Art. 7.-them licenses is classified in: 1. license for manufacturing: empowers to a person natural to develop or perform mixtures piricas, whose purpose is get a product pyrotechnic, likewise, empowers the storage and transport of them substances and products pyrotechnic, in compliance of them measures of security established in the present law and other laws related;
2. license for marketing: empowered to a person natural to exercise the trade of products pyrotechnic, in local and spaces public, previously authorized for this; empowering in addition, storing and transporting those products, in compliance with the security measures laid down in this law and other related laws;
3 handling in Fireworks license: authorizes a natural person to carry on the business of handling pyrotechnic products authorised for advertising, or fun and entertainment, in previously authorized for that purpose; and, 4. License for person artisan pyrotechnic: authorizes to a person natural with knowledge of the trade, to develop or perform mixtures piricas, of way manual or creative, to transform them in product Fireworks.
Requirements for obtaining of licenses art. 8.-all national or foreign person with permanent residence in the country, more than eighteen years of age, may obtain and renew the respective license, prior compliance with the following requirements: 1. submit application to the MDN, containing: the type of license that is requested, the full name, age, place of residence, profession or trade nationality and residence 7 of the applicant, whose form will be provided by the Ministry.
2 shall attach to the application the following documents: to) Original and photocopy of: single document of identity, tax ID card, and in the case of a foreign person passport and valid permanent resident;
(b) the solvency of a criminal record; and, c) solvency of police.
3. submit proof of attendance and completion of the course of competency and professional security, which for this purpose shall prepare and execute the body of fire, which is appropriate to the class of license that is applying.
Responsibility for reporting the loss, theft, damage or theft to the competent authority article 9.-the person that you lost, it is stolen you or stolen license, you must give notice to the NCP, which shall send a copy of the complaint to the MDN, in term of forty-eight hours.
For lost, stolen or pilfered licenses, the interested party will have thirty days to process his replacement, which must present the respective complaint filed in the PNC.
In case of damage, the person concerned shall inform the MDN for their respective replacement.
Failure to comply with time limits laid down in the law, to the renewal and replacement of licences, shall be sanctioned as it otherwise.
Chapter II Permissions permission article 10.-document which will be extended by the MDN, to any natural or legal person that requires it, in accordance with the activities regulated by this law, prior compliance with the requirements established for this purpose; This document shall have the term of three years and shall be extended on one period not more than ten working days from the day following the presentation of the documentation required.
Classification and definitions of permission article 11.-the permissions are classified according to their activity: 8 1. Permission for manufacturing: empowered to a person natural or legal to develop or make mixtures piricas, whose purpose is obtain a product pyrotechnic in place previously authorized, understanding of equal way the storage of the same;
2 permission for storage of fireworks-related substances: empowers a natural or legal person so that you can protect the substances relating to the pyrotechnics in places previously authorized for that purpose;
3. permission to market: faculty to a natural or legal person to practice the trade in pyrotechnic product, premises and public spaces, previously authorized for this purpose, comprising the same storage. The following categories should be taken into account: to) collective sales, in the case of temporary sales;
(b) kiosks, as regards temporary sales inside of shopping malls; and, c) rooms for sale, in the case of local permanent.
4 permission to manipulate in firework: empowers a natural or legal person to perform shows using pyrotechnic products, marketing purposes, or for fun and recreation, in previously authorized;
5 permission to import, export, and internment of pyrotechnic products: empowers a natural or legal person to import, export, or admit pyrotechnic product, in accordance with the provisions of the present law; and, 6. Permission to import, export, trading, and internment of pyrotechnic products and substances relating to pyrotechnics: empowers a natural or legal person to import, export, or admit pyrotechnic product, as well as substances relating to the pyrotechnics, in accordance with the provisions of the present law.
Requirements for obtaining of permissions article 12.-any person Salvadoran or foreigner with permanent residence in the country, largest of eighteen years of age, may obtain and renew permission to manufacture, store, import, export, place, market and handling pyrotechnic product.
The person concerned shall submit the application to the MDN by stating, as the case may be, the full name, age, address, profession or occupation, nationality and current residence, whose form will be provided by the Ministry, prior compliance with the following general requirements: 1. rating of the place by the respective City Hall to manufacture, store or sell Fireworks product or relating to pyrotechnics substances;

2-9. The sanitary certification extended by MINSAL; and, 3. Having the certification of compliance with the security measures, issued by the fire.
En_el_caso_de the natural person, in addition to the provisions of the preceding paragraph, shall also comply with the following specific requirements: to) be more than eighteen years of age;
b) present original and photocopy of the single identity document, card, tax ID, passport or permanent resident card or a photocopy certified by notary; and, c) present solvency of criminal records and police.
En_el_caso_de legal person, in addition to the provisions of the second paragraph of this article, shall also comply with the following specific requirements: to) copy certified by a notary of the public deed of incorporation of society or association and amendment of articles of incorporation, if any,

duly registered and current on the register of Commerce;
(b) existing credential of the legal representative of the company or of the sole administrator of the same, as the case may be, duly registered and current on the register of Commerce;
(c) submit the record of registration of company;
d) presenting original and photocopy of the single identity document, card tax ID, passport or meat of a permanent resident or a photocopy certified by a notary of the legal representative; (and e) provide solvency of criminal records and police of the legal representative.
In the case of the closure of the company's operations, it shall inform the MDN, within a period of five working days.
The term of any of the permissions mentioned in the previous article, shall be three years and shall be renewable for equal periods, prior to the fulfilment of the requirements of law and the payment of the corresponding tax rights. Once requested renewal, you may continue in respective economic activity, while the MDN meets such requirement to the person concerned.
Title III measures of safety 10 chapter I distances relating to the manufacture, storage, marketing and handling distances in terms of making article 13.-the manufacturing centers or coheterias of pyrotechnic products must be away from centers of concentration of human, according to the type of production, and applying the following safety distances: 1. external or environment: to) when in the case of manufacture of pyrotechnic products such as : cohetillos, machine guns, mortars, rockets of rod or similar, whose quantity of composition pyrotechnic by load of work with which is develop such products, is to of three pounds, must save is a distance not less of thirty meters from the place of work;
(b) in the case of manufacture of pyrotechnic products such as overhead lights, artifacts for public or private events, whose total pyrotechnic composition by workload to develop such products, is up to a maximum of fifteen pounds of mixture, at a distance not less than thirty meters, which will be counted from the place of work;
(c) in the case of manufacture of pyrotechnic products as light items, such as: volcanoes, mosaics, light sources, pistolitas and candles Roman or similar; whose amount of composition pyrotechnic by load of work with which is develop such products, is to of a maximum of ten pounds, is must save a distance not less of fifteen meters, which is counted starting from the place of work;
(d) in the case of manufacture of pyrotechnic products like sparklers, such as: estrellitas, joys, tealights bright for waterfalls, castles for posters, or the like; whose amount of pyrotechnic composition by workload to develop those products is up to fifteen pounds of pyrotechnic composition, you must save not less than ten metres, which will be counted from the place of work;
(e) in the case of micro-enterprises in the case of manufacture of explosives pyrotechnic products of cohetillos, machine guns, mortars, rockets of rod, with a and half a pound of pyrotechnic composition shall keep not less than ten meters. Which will be counted from the place of work; (and, f) for the case of the microenterprise when is concerned of manufacturing of products pyrotechnic of lights as boiling, mosaics, pistolitas, toritos, castles and all it concerning to lights Christmas and shows public until a maximum 11 of five pounds of mix, to a distance of five meters which is counted starting from the place of work.

(c) in the process of manufacture of pyrotechnic products for the different phases, there must be with individual cubicles, mixed system of two meters wide by two meters long, with a height of two meters, with ceilings of wood-Blade Assembly; and, (d) in the case of micro-enterprises, the cubicle where the phase of preparation of mixtures and filling process, takes place must be four metres away from other cubicles. Distances in terms of storage of pyrotechnic products and substances relating to pyrotechnic article 14.-the places to store Fireworks product with respect to the distance should be: to) be located within distance of fifteen meters, at a minimum, of the process of manufacturing and a specially designed place for that purpose; (and, b) away to fifteen meters of centres of concentration human, such as: centers educational, temples, establishments of health, terminals of transport, ports, parks or others sites recreational and areas residential or housing;

10. all factory must be free of weeds and waste eight meters RADIUS; and, 11. Lighting, preference, must be natural and not incandescent, with their respective preventive and corrective maintenance.
Safety measures for marketing and storage of products pyrotechnic article 18.-for marketing and storage of pyrotechnic products must met the following safety precautions: 1. be placed signs in visible locations indicating "GUNPOWDER not smoking", in letters not less than twenty-five centimeters;
2. keep water containers and fire extinguishers according to the category of local;
3. all premises should be kept in order, clean and free of weeds;
4. the lighting should not be incandescent, with its respective maintenance preventive and corrective;
5 pyrotechnic product, must be packaged in tough, suitable material, and be placed on wooden pallets;
6. the interior of the premises shall provide ventilation natural or artificial;
7. the circulation corridors and doors of entry or exit must be free of obstacles;
8. the emergency door open outward and must be properly signposted;
9. in its interior, pyrotechnic store, products will be placed at a minimum distance of 15 cm from the walls, ceilings and light fixtures; and, 10. The storage of pyrotechnic products should be respecting the affinity and sensitivity of the same, keeping the required distance between them.
Rooms sale and wineries, as well as measures of security before, must have that then settle: to) premises constructed of mixed system;
(b) system of smoke detectors operated with batteries, which must be 14 in optimal operating conditions, with the aim of detecting a fire in its early stages; and,

(c) system of audible and visible alarm with manual stations of activation, in order to alert people in case of an emergency arise.
Wineries, in addition to measures of security before, must have permanently which then settle: to) electrical installations switches should be located on the outside of the premises;
(b) to carry out a service that generates heat in the interior of a winery, pyrotechnic product should be transferred to another appropriate local duration
(c) is maintained in order, clean and free of weeds, in an area of eight meters to the round; and, (d) system against fire or equipment, according to the technical criteria of the competent authority.
Security measures for marketing and storage of substances relating to the pyrotechnic article 19.-for marketing and storage of relating to pyrotechnics substances must meet the following security measures: 1. be placed signs in visible locations indicating "Hazardous materials", which shall be visible and legible to fifty meters;
2. keep absorbent materials such as: sand, sawdust, among others, and fire extinguishers according to the risks of stored substances;
3. in the interior of the premises, materials to save will be placed at a minimum distance of 15 cm from the walls, ceilings, and lights, on wooden pallets, in an orderly and organized in such a way that to avoid the possibility of a reaction by the spontaneous decomposition;
4. the lighting should not be incandescent and the entire electric system must have its respective preventive and corrective maintenance. There must be emergency lighting system;
5. system of proper ventilation, according to the substance;
6. the corridors of circulation and doors of entry or exit must be free of obstacles;

15 7. The emergency door open outward and must be properly signposted;
8. the storage of these substances should be done according to the degree of risk and support them, keeping the required distance between them;
9. they must have a mixed system construction;
10. the floor not should have no cracks;
11 ducts of ventilation or drainage, which must be protected with trellis or mesh to prevent access by animals;
12 develop and develop a pest control program;
13. exterior paint should be white to reflect sunlight and prevent warming of walls;
14. the premises will remain closed and secured not business hours, with permanent surveillance;
15 systems of detection and alarms;
16. all substances shall include in its submission the manufacturer, brand name and characteristics;
17. should count with bathrooms and showers for decontamination;
18. the company shall own PPE for their employees, the use of these will be mandatory in their work;
19 it must have emergency planning, evacuation and contingency; and, 20. A sign indicating that access to these facilities will be only persons duly authorized to do so must be.
Security measures regarding the transport of pyrotechnic products or substances relating to the pyrotechnics in the national territory article 20.-for transporting pyrotechnic products or substances relating to the pyrotechnics, which exceed four minimum wages, vehicles must comply with the following: 1. good condition internally and externally, especially electrical system;
2 fire extinguisher suitable regarding the pyrotechnic product or substances relating to the pyrotechnics to be transported;

16 3. Sheet of safety or technical form, when transporting Fireworks product or relating to pyrotechnics substances;
4 shall carry a diamond indicating hazardous material class which belongs to and a plate orange color under the diamond with the number of identification established by the United Nations, as well as other specifications for the class of dangerous goods. Such signs shall be located on the sides, rear and front.
5 it must be in vehicles, fully enclosed or properly covered; and, 6. In the case of exports, the carrier whose vehicle is foreign plate, must submit existing permission from their country of origin for transporting pyrotechnic products or substances relating to the pyrotechnics.
Duty of custody of the PNC art. 21.-for the internments and imports, the transport of pyrotechnic products or substances relating to the pyrotechnics from authorized points of entry or the tax-free licensed wineries, will be in the custody of the national civil police, according to the level of risk that qualifies the MDN.
Managers of the wineries of customs and tax-free, must require the presence of the custodian or the document that except this requirement, at the time of his office.
In case of export, the custody shall be deemed from the authorized until the customs tax-free warehouses.
Title IV Commission technical evaluation and CONTROL of products Fireworks and substances relating to PYROTECHNICS chapter I creation, powers and responsibilities establishment of the Technical Committee of evaluation and Control of pyrotechnic products and substances relating to the pyrotechnic article 22.-create the Technical Committee of evaluation and Control of pyrotechnic products and substances relating to the pyrotechnics, referred to in this law Technical Committee , which will be integrated by the MDN through the Directorate of logistics, MIGOBDET through the fire, the MJSP through the DAE, MINSAL through the unit of environmental health, the MRNA and the municipalities through the delegate designated by COMURES.

17. its operation shall be subject to the provisions of this law, its headquarters and dependency will be the Ministry of national defense. The coordination of the same will be in charge of the principal or Director of logistics of the Ministry.
The owners of the institutions that comprise it, may appoint delegates, according to your criteria and requirements established in this law.
The appointment of delegates article 23.-the delegated persons forming part of the Technical Committee, must be named by agreement of the Executive Body in the field concerned, the first ten working days of the month of January of each year.
When delegated persons be replaced, the owner, has a period of ten days to make the new appointment, which shall inform the Director or Director of logistics of the MDN.
Powers and obligations Article 24-are powers and obligations of the technical Commission: 1. ordinarily convening every three months and extraordinarily when called the director of logistics of the MDN, at the request of any of its members;
2 develop, track, and evaluate the annual work Plan of the functions assigned by this law;
3 issue the corresponding approval for the extension of permits, which shall not exceed twenty working days;
4. keep updated list of pyrotechnic products and substances relating to the pyrotechnics, which can incorporate into the already regulated in the present law, according to the different requests of the persons concerned;
5 require the advice of professionals and technicians, when deemed necessary;
6 carry out scheduled inspections and unscheduled, the first will be based on the work Plan referred to in the paragraph 2 of this article, and the non-scheduled when they deem relevant;
7 working with the MDN on planning, inspection and oversight when it requests it;
8. recommend policies aimed at compliance with the Act and its regulations;
9. attend meetings convened by the MDN;

10-18. Simply send the MDN reports, opinions or any other requests deemed suitable of the inspections carried out, at the end of two days; and, 11. The institutions members of the Technical Committee, shall coordinate among themselves, all matters concerning the application of this law.
Responsibilities of the MDN in the Commission technical article 25.-corresponds to the MDN through the delegated person: 1. coordinate and direct acting of the Technical Committee, as well as the activities of control and inspection;
2. bring the computer records of inspections or audits carried out, together with the institutions mentioned in article 2 of this law;
3. to analyze the special cases in coordination with the Technical Committee, the isolation of pyrotechnic products or substances relating to the pyrotechnics, which would endanger the life or health of the population or which may cause damage to the environment; and, 4. Summon the members of the Technical Committee.
Responsibilities of MINSAL in the Commission technical article 26.-corresponds to MINSAL: 1. be part of the technical Commission, through the delegated person;
2. attend meetings through the delegated person when it is convened; and, 3. Participate in the implementation of inspections and audits scheduled and unscheduled by the Technical Committee.
Responsibilities of the MIGOBDET in the Commission technical article 27.-corresponds to the MIGOBDET: 1. be part of the technical Commission, through the delegated person;
2. attend meetings, through the associate person, when it is convened;

3 participate in the implementation of inspections and audits scheduled and unscheduled 19 by the Technical Committee; and, 4. Inspect, qualify and deliver technical opinion to the MDN, of existing and proposed premises for manufacture, storage and marketing of pyrotechnic products or substances relating to the pyrotechnics, as well as vehicles intended for the carriage of the same.
Responsibilities of the MJSP in the Commission technical art. 28.-corresponds to the MJSP: 1. be part of the technical Commission, through the delegated person;
2. attend meetings, through the associate person, when it is convened;
3 participate in the implementation of inspections and audits scheduled and unscheduled by the Technical Committee; and, 4. Make seizures and beginning of pyrotechnic products and substances relating to the pyrotechnics during the inspections scheduled and unscheduled, when so determined by the MDN.
Responsibilities of the MRNA in the Commission technical article 29.-corresponds to the MRNA: 1. be part of the technical Commission, through the delegated person;
2. attend meetings, through the associate person, when it is convened; and, 3. Participate in the implementation of inspections and audits scheduled and unscheduled by the Technical Committee.
Responsibilities of COMURES in the Commission technical article 30.-corresponds to COMURES: 1. be part of the technical Commission, through the delegated person;
2. attend meetings, through the associate person, when it is convened; and, 3. Participate in the implementation of inspections and audits scheduled and unscheduled by the Technical Committee.

20 chemicals regulated industry pyrotechnic article 31.-the chemicals for the use of pyrotechnics will be regulated and controlled by the MDN, for which will require an authorization for each import and local purchase operation is performed which, according to the following list: 1. oxidizers: 1.1. Potassium chlorate;
1.2. potassium perchlorate;
1.3. nitrate of potassium-called commonly salt or salt of Nitro;
1.4 barium chlorate;
1.5 barium nitrate;
1.6. strontium nitrate;
1.7. sodium nitrate; and, 1.8. Ammonium chlorate.
2. fuel: 2.1. Aluminium powder;
2.2 sulphur.
2.3. sodium benzoate;
2.4. strontium carbonate;
2.5 sodium oxalate;
2.6 antimony sulphide;
2.7. aluminum in glitter;
2.8 magnesium powder; and 2.9. Granulated magnesium.

21. the classification and updating of the list of chemical substances regulated by this article, will be reviewed by the Technical Committee each semester, which may be enlarged, diminished or modified.
They are chemical substances prohibited for the exclusive use of pyrotechnics: amorphous red phosphorus powder, yellow phosphorus and white phosphorus.
Title V training, programs, incentives and rights tax chapter I training, education and prevention training article 32.-the MIGOBDET, through the fire, it will produce mandatory training to those involved in the development of activities relating to the pyrotechnics, about the security measures that must be taken into account, and issue a certificate for all those people who have been trained which will have a term of five years.
Prevention article 33.-the MIGOBDET campaigns, in coordination with the MINED, MINSAL, and municipalities must develop permanent education and prevention campaigns aimed at the population, with the support of the companies and the Fireworks artisan industry, in accordance with the provisions of this law, with special emphasis on the schools.
Chapter II programs, incentives and rights tax programs article 34.-the MIGOBDET will coordinate with the other involved institutions, programs of incentives for artisans and craftsmen who develop activities relating to pyrotechnics.
Incentives for the manufacturing National Art. 35.-the person natural or legal that matter or internal products pyrotechnic, that not is manufacturer of the same, must buy to them companies pyrotechnic manufacturers national legally established, at least one thirty percent in product pyrotechnic of the total of each import that perform.
The MDN shall authorize the import of pyrotechnic products referred to in the preceding subparagraph, previously checked by the person importing the percentage of procurement in national Fireworks product, using the corresponding invoice.

22 training and assistance technique article 36.-the State through the National Commission for Micro and small enterprises and the Salvadoran Vocational Training Institute, will develop technical assistance programs, aimed at pyrotechnic companies legally established in their various activities.
Classification of the companies article 37.-for the purposes of this Act, the pyrotechnic companies are classified as follows: 1. Micro Enterprise: natural or legal persons operating in various sectors of the economy, through one economic unit with a level of annual gross sales to 482 monthly minimum wages of greater amount and up to 10 workers;
2. small business: natural or legal persons operating in various sectors of the economy, through one economic unit with a level of annual gross sales greater than 482 monthly minimum wages of greater amount and up to 4,817 monthly of higher minimum wages and a maximum of 50 employees;
3. medium-sized companies: are companies with annual gross sales up to 28,877.88 monthly minimum wages on major, with a maximum of 100 workers; and, 4. Large enterprise: there are companies with annual gross sales exceeding 28,877.88 monthly minimum wages on major, with more than 100 workers.

5. the recruitment of children and adolescents to perform any of the activities related to pyrotechnic products;
6 develop any activities relating to the pyrotechnics without telling their respective licensed;
7 hide or deny to the competent authority, the existence of pyrotechnic products or substances relating to the pyrotechnics, at the time of inspection;
8 allow the presence of girls, children and adolescents, as well as outsiders in the activity of carrying pyrotechnic products or substances relating to the pyrotechnics;

9-24. Own, owners, shareholders or contractors of companies dedicated to pyrotechnics activities established in the present law, officials or staff of the institutions, that during the performance of their functions, are directly related in the application of the same;
10 hire or allow that in manufacturing processes, marketing, storage, handling and transportation of pyrotechnic product, labore personal that it does not have the respective license;
11 be tenant person or subarrendataria of premises or establishments to develop some activities relating to pyrotechnics, when they do not fulfil the requirements stipulated in this law;
12 that parents, mothers or guardians allow girls, children, or adolescents to handle pyrotechnic products without the supervision of an adult;
13 let girls, children and adolescents, as well as people outside the activity of pyrotechnics, to remain in the specific area in which trigger mechanisms are handled during the development of fireworks;
14 manufacture, storing, marketing or transporting Fireworks product or substances relating to the pyrotechnics, without compliance with the security measures laid down in this law.

15 selling or providing, under any concept, pyrotechnic products or substances relating to the pyrotechnics, children and adolescents, as well as people in apparent drunken state or behavior disorders;
16 let girls, boys and adolescents, people in apparent drunken state or behavior disorders, as well as people outside the activity of pyrotechnics, to remain or work in the rooms or spaces for the manufacture, storage and marketing of pyrotechnic product;
17. the importation of finished Fireworks products already manufactured in the country; and, 18. Own product pyrotechnic or substance relative to the pyrotechnics not authorized.
Fouls and penalties article 40.-Las fouls to provisions of this law and its regulations, without prejudice to any civil or criminal liability that any, are classified as minor, serious and very serious.

Article 58.-the entry into force this law shall enter into force thirty days after its publication in the official journal.
