DECREE NO 820
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
CONSIDERING:
I.-That by Legislative Decree No. 1039, dated April 29, 2006, published in Official Journal No. 103, Tomo 371 dated June 6, 2006, was enacted the Law of the Municipal Administrative Race, which entered into was valid on 1 January 2007.
II.-That the aforementioned law aims to develop the Constitutional principles relating to the Municipal Administrative Race and to guarantee the efficiency of the Municipal Administrative Regime, through the offer of equality of opportunities for municipal public service income, permanent training, stability in office and the possibility of promotions and transfers.
III.-That the Register of the Municipal Administrative Career, is a dependency of the municipality or other municipal entities under the responsibility of the Mayor or the maximum the respective authority, having as the main function to register the persons entering the Administrative Race and to give certainty of the acts and resolutions issued by the administrative organs in respect of the servers of the municipality or municipal entity, which are within the Administrative Race.
IV.-By means of Decree-Transitional Decree No. 536, published in the Official Journal No. 231, Volume 401 dated December 9, 2013, the incorporation was approved registration of officials and municipal public employees who carry out positions or jobs in the Carrera Municipal Administration.
V.-That notwithstanding the Transitional Decree mentioned, there are still municipalities, which have not fulfilled or finalized the administrative processes for the incorporation and registration of the officials or employees Municipal Register of the Administrative Race in the corresponding Municipal Register and who have not informed of the seats in their possession to the National Registry of the Municipal Administrative Race, dependency of the Salvadoran Institute of Municipal Development.
VI.-That it is necessary that the Registry of the Race Municipal Administration, is updated annually and is reported in the first three months after the completion of the fiscal year corresponding to the National Register of the Municipal Administrative Race of all information registration and incorporation of municipal officials or employees who carry out posts or permanent jobs of the Municipal Administrative Career; in order to guarantee the equality of their rights and to prevent workers from working remain unprotected.

in use of the Constitutional powers and at the initiative of the Deputies and the Diputadas Bertha Mercedes Avilés de Rodríguez, Nery Arely Díaz Aguilar, Mario Antonio Ponce López, Juan Manuel de Jesús Flores Cornejo and Mario Eduardo Valiente Ortiz.
DECRETA the following:
Reforms to the Law of the Administrative Race Municipal, issued by Legislative Decree No. 1039, dated April 29, 2006, published in Official Journal No 103, Volume No 371 of 6 June 2006.
Art. 1.-Incorporate a paragraph between the second and third points of Article 56, as follows:
" The Municipalities shall incorporate and register in the Register, those officials and municipal employees who have since before entry into force of this Law, carry out posts or permanent jobs of the Municipal Administrative Career, as included in Arts 6, 7, 8 and 9 of this Law; except for such registration, to those posts or jobs that points out Art. 2 of this Law. "
Art. 2.-Incorporate the second, three points to Article 58, as follows:
" The corresponding Municipalities or Entities shall implement the Municipal Records of the Municipal Administrative Race and incorporate and register municipal employees who comply with the requirements stated in the preceding articles.
The Municipal Register of the Municipal Administrative Race, must be updated by the respective municipalities or entities, at thirty-one of December of each year, and must inform at the latest within three months following the completion of the corresponding fiscal year of all the seats in their possession and those of updating them to the National Registry of the Municipal Administrative Race.
Once the deadline stated in the the previous paragraph, the Court of Auditors of the Republic may apply the provisions of article 107 of its Organic Law, in the case that the Municipalities or Entities have not updated the Registry and sent the information required in the precedent. "
Art. 3.-This Decree will enter into force eight days after its publication in the Official Journal.
