DECREE NO 870
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
CONSIDERING:
I.-That by Legislative Decree No. 413, dated July 3, 2013, published in Official Journal No. 138, Volume N ° 400, of July 26, 2013, the Electoral Code was issued.
II. the Constitution, establishes the faculty of this Legislative Assembly to Interpret The Law Authentically.
III.-That Article 209 of the Constitution of the Republic states that the Law shall establish the necessary bodies for the reception, counting and audit of votes and other activities concerning the suffrage and shall ensure that they are integrated so that no party or coalition of parties predominate in them.
IV.-Article 116 of the Electoral Code establishes the prohibition of more than one member in electoral bodies of the same Party or Coalition of Parties.
V.-That the current wording of Article 116 of the Electoral Code may create confusion for the the moment to establish the integration of the departmental and municipal electoral boards, generating predominance of a Party or Coalition of Parties, in any of these organizations, which would be contrary to the provisions of Article 209 of the The Constitution.
VI.-That in order to ensure compliance with Article 209 of the Constitution, it is necessary to authentically interpret Article 116 of the Electoral Code to facilitate and delimit its application.

in use of its Constitutional powers and on the initiative of the Deputy Jackeline Noemi Rivera Avalos and Deputy Carlos Walter Guzman Coto.
DECRETA:
Art. 1.-The authentic interpretation of Article 116 of the Electoral Code, issued by Legislative Decree No. 413 dated July 3, 2013, published in the Official Journal No. 138, Volume N ° 400, July 26, 2013, in the sense that the Parties Politicians who are members of the Coalition will only be able to appoint a representative and their respective Substitute, by Coalition, in the integration of the departmental electoral boards, regardless of the fact that it only applies to an election. whether it is the Presidential Elections, the Members of Parliament and the Members of Parliament Central American, and deputies and deputies to the Legislative Assembly; and, at Municipal Electoral Boards,

Art. 2. Related Authentic Interpretation is incorporated into the text of the Electoral Code.
Art. 3.-This Decree shall enter into force eight days after its publication in the Official Journal.
