DECREE NO 928

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 307 dated February 14, 2013, published in Official Journal No. 40, Volume No. 398 of the same month and year, the Law of Political Parties was issued.

II. Law for the first time it was established that the board of Deputies to the Legislative Assembly, Parliament Central American and Municipal Council members, were to be made up of at least thirty percent of women.

III.-That this provision has been reformed twice, the first on September 25, 2014, through Legislative Decree No 811 and the second on 31 October 2014, by Legislative Decree No 843.

IV.-That the Constitutional Chamber of the Supreme Court of Justice, in the process of Inconstitutionality 43-2013, issued a judgment declaring that there is an unconstitutionality by omission in respect of internal democracy of the parties, which affects the content of the first paragraph of article 37 of the Law of Political Parties.

V.-That by virtue of the reforms and the resolution cited, it is necessary to reformulate the content of the mentioned article to guarantee the clarity and effectiveness of your application.

DECRETA the following:

REFORM TO THE LAW OF POLITICAL PARTIES

Art.1.-Replace Article 37, as follows:

" Art. 37.-The election of party authorities and candidates for positions of popular choice to be nominated by the political parties in the elections called by the Supreme Electoral Tribunal, as well as the decisions of the party's government, must be governed by rules of internal democracy established in the law and in the party statute.

The political parties will have to integrate their plans for the election of deputies to the Legislative Assembly, the Central American Parliament and the members of the Municipal Councils, at least with a thirty percent participation of women.

That percentage will apply to each National, Departmental and Municipal payroll, according to the registration of candidates and candidates for each political party or coalition present in the National, Departmental and Municipal constituencies. Each planilla will be considered in a comprehensive way, that is, including bids from owners and alternates.

In the case of the plans with candidates for Municipal Councils, the thirty percent minimum participation of women will be (b) the rules governing the application of the rules of procedure laid down in Article 165 (1) of Regulation (EC) No 516/2003 of the European Parliament and of the European Parliament and of the European Parliament and of the European Parliament and of the European Parliament and of the European Parliament The second section of the Electoral Code.

Art. 2.-This Decree shall enter into force eight days after its publication in the Official Journal.
