DECREE NO 989

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That Article 33 of the Constitution of the Republic states that " The law shall regulate the personal and property relations of the spouses of each other and

between them and their children, establishing the rights and duties reciprocal on a level playing field; and it will create the necessary institutions to ensure its applicability ... ".

II.-That by Legislative Decree No. 677, dated October 11, 1993, published in Official Journal No. 231, Volume 321, dated December 13,

same year, the" Family Code " was issued.

III. Legislative Decree N ° 520, dated November 25, 2010,

published in Official Journal No. 2, Volume No. 390 of 4 January 2011, the "Comprehensive Special Law for a Free Life of Violence for Women" was issued.

IV.-That by Legislative Decree No. 645, dated March 17, 2011, published in Official Journal No. 70, Volume No. 391 of 8 April 2011, the "Law of Equality, Equity and Eradication of Discrimination Against Women" was issued.

V.-That in order to make life free from violence and discrimination for women in the family, and to eradicate economic violence and

direct or indirect assets against women, it is appropriate to carry out reforms to the Family Code, approved by Legislative Decree No. 677 dated October 11, 1993, published in Official Journal No. 231, Tomo 321, of

date 13 December of the same year.

DECERTA the following:

FAMILY CODE REFORMS

Art. 1.-Reform the first paragraph of Art. 260 as follows:

" Art. 260.-The right to order food is inalienable and inalienable, but overdue food pensions may be compensated. "

Art. 2.-Reform Art. 261 as follows:

" Art. 261.-The right to collect overdue food pensions is prescriptive. "

Art. 3.-This Decree shall enter into force eight days after its publication in the Official Journal

.
