CONSTITUTIONAL REFORM AGREEMENT N ° 2

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR SALVADOR,

CONSIDERING:

I.-That the Constitution of the Republic in its article 32 enshrines that the family is the fundamental basis of society and will have the protection of the State, who

will dictate the necessary legislation and create the appropriate bodies and services for their integration, welfare and development " Social, cultural and economic.

II.-That in turn establishes that the legal basis of the family is marriage and rests on the legal equality of the spouses; having to have in the constitutional range, clearly defined, the scope of application of the marriage and

adoption.

III.-That in consideration of the above considerations it is appropriate

to introduce the relevant reform to the Constitution.

AGREES: the following reform to the Constitution of the Republic, issued by Constituent Decree

N ° 38 dated December 15, 1983, published in the Journal Officer N ° 234, Tomo N ° 281, dated 16 of the same month and year, of the Constituent Assembly, which is considers individually for ratification.

Art. 1.-Reform Art. 32 as follows:

" Art. 32. The family is recognized as the fundamental basis of society and will have the protection of the State, who will dictate the necessary legislation and create the appropriate agencies and services for their integration, welfare and social, cultural and

comply with the conditions established by the Law. Same-sex marriages celebrated or recognized under the laws of other countries, and other unions that do not comply with the conditions established by the Salvadoran legal order, will not take effect in El Salvador.

State shall encourage marriage; but the lack thereof shall not affect the enjoyment of the rights established by the Law. "

Art. 2.-Reform Art. 33 as follows:

" Art. 33.-The Law shall regulate the personal and property relations between the spouses and between them and their children, establishing reciprocal rights and duties on a level basis; and shall establish the necessary institutions to ensure their applicability. It shall also regulate the relations resulting from the stable union of a man and a woman, thus born, and who have no impediment to contract

marriage. "

Art 3.-Reform Art. 34 as follows:

" Art. 34.-All minors have the right to live in family and environmental conditions that allow their integral development, for which they will have the protection of the State.

The adoption is recognized as an institution, whose guiding principle will be the higher interest of the adopted.

They will be enabled to adopt people who meet the conditions that the Law establishes. Adoption by same-sex couples is prohibited.

The Law will determine the duties of the State and create the institutions for the protection of maternity and childhood. "
