DECREE NO 73

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 653 dated 06 December 2001, published in Official Journal No. 240, Volume No. 353, of the 19th of the same month and year,

was issued the Organic Law of the National Civil Police Salvador, who in his Art. 30 establishes that the Law of the Police Race will regulate everything concerning promotions and promotions of the police, administrative, technical staff and

service of that Police Institution.

II.-That by Legislative Decree No. 773, dated July 18, 1996, published

in Official Journal No. 144, It took N ° 332, from 07 August of that same year, the Law of the Police Race was issued, which regulates that to opt for the ascent to the level or the immediate higher category, it will be necessary to have a square

vacant for need of service and that the aspirant meets certain requirements among which is found to reach the necessary score according to the baremo, regulated in Art. 29 of the said normative body.

III.-That the effort made by the aspirants to rise to the different Levels or Categories mentioned in the Law to which reference has been made in the Considering above, on the basis of seeking encouragement to the continuous

overcoming and professionalization, avoiding any kind of discrimination, is frustrated by the mentioned baremo, that through this instrument, far from taking in The true professional, cultural and ancient merits,

generates a series of injustice, since it takes into account parameters far removed from the objectives to be achieved by and for the members of the Police Institution.

IV.-That for the reasons explained above, it becomes necessary to delete from the Law of the Race Police, those provisions that are generating many injustices and deprofessionalization of the members that make up the Police

National Civil. FOR TANTO,

DECCRETA, the following:

REFORMS TO THE LAW OF THE POLICE CAREER

Art. 1.-Reform Art. 3, as follows:

" Art. 3.-In the text of this Law, the Ministry of Justice and Public Security may be referred to as the Ministry or the MJSP; the National Civil Police, such as the Police or the PNC;

National Academy

Public Security as the Academy or the ANSP; the Escalafon of the National Civil Police as the Escalafon; the Register of Police Personnel as the Register of Personnel or the Registry and the Number of Personnel Registration as Institutional Numeric Order or ONI. "Police personnel, the

set of officers, cabs, sergeants and officers of the PNC shall be understood; members of the categories included in the higher executive levels shall be understood by officer."

Art. 2.-Reform the numeral 3), from literal a), from Art 21, as follows:

" 3. Members of the National Civil Police of the Basic Level, who hold a University Title and have no outstanding disciplinary record for serious or very serious misconduct, may

participate in the courses for the Sub-Inspector Category, for which there is no age limit. '

Art. 3.-Reform the first paragraph of Art. 25, as follows:

" Art. 25.-The external income may be up to 30% of the existing vacancies in the Category

of Sub-Inspector, having application in its case, the provisions of the final part of Art. 37 of this Law. "

Art. 4. -Derive the literal d) of Art. 27.

Art. 5.-Reform the first paragraph of Art. 29, as follows:

" Art. 29.-The Minister of Justice and Public Security, on a proposal from the Director General of the National Civil Police, will establish the professional and seniority merits, as well as the minimum scores, on the basis of procuring the stimulus to the continuous overcoming and professionalizing personnel, avoiding

any kind of discrimination. "

Art. 6.-Reform Art. 31, as well:

" Art. 31.-At the competition stage, the Court of Entry and Ascensuses shall select those who meet the requirements laid down. "

Art. 7.-Reform the third indent of Art. 33, as follows:

" Those who approve the course with the highest score, will be promoted according to the number of the

vacant places and do not have serious or very serious non-cancelled or pending processes. In the same way, those who have approved the respective promotion course for any level or category and not

will have available seats will be fit and pending for the respective ascent, as there are vacant places, debiendosels respect the scale, the seniority and the highest score obtained in this course. "

Art. 8.-Reform the first paragraph of Art. 34, as follows:

" Art. 34.-The applicants who pass the course will be added to the scores reached in the course and those obtained in the previous phases to obtain the final score, being scaled according to the order of the highest to the lowest score. "

Art. 9.-Reform Art. 36, as well:

" Art. 36.-The Minister of Justice and Public Security, on a proposal from the Director General of the ANSP, will determine the percentage values of the tests, in order to obtain the score for the escalation. The above shall be regulated in the respective Regulation. "

Art. 10.-This Decree will enter into force eight days after its publication in the Official Journal.
