DECREE NO 122

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 1030 dated April 26, 1997, published in Official Journal No. 105, Volume N ° 335, of June 10 of the same

year, the Criminal Code was issued.

II. process of adequacy of the Criminal Regulations to the circumstances

real of the country, becomes necessary Reform the penalty of the crime of Tenence and Indue Use of Traje or Uniform, regulated in article 288-A of the Penal Code.

III.-In this sense, with the referred reform to article 288-A, in the first paragraph, the penalty of fine will be increased and, in the second subparagraph, the penalty of imprisonment of the offence committed in a third part will be increased by the use of the uniforms of

private use detailed in article 1 of this Decree.

BY TANTO,

in use of its faculties Constitutional and on the initiative of Deputy Martyr Arnoldo Marin.

DECRETA the following:

REFORM AL PENAL CODE

Art. 1.-Reform Art. 288-A, as follows:

" Art. 288-A.-The one that unjustifiably has in its possession, or will improperly wear true or simulated uniforms with the same characteristics, slogans, emblems or insignia of the National Civil Police, of the National Academy of Public Security, of the The Armed Forces of the General Directorate of

Criminal Centers, of the different personnel who are regulated in the Law of the State Security Services, Autonomous Institutions and the municipalities, as well as the Law of the Private Security Services, will be sanctioned with one hundred to one hundred and fifty days fine.

If such uniforms are used in committing a crime, the penalty will be increased by a third of the penalty imposed in that crime. "

Art. 2.-This Decree will enter into force eight days after its publication in the Official Journal.
