DECREE NO 124

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 529 dated January 13, 1999, published in Official Journal No. 23, Volume N ° 342, of the 3rd of February of the same

year, the Law of Customs Simplification was issued, with the object of establishing the basic legal framework for the adoption of simplification, facilitation and control of customs operations, through the use of systems

automatic exchange of information.

II.-That by means of Legislative Decree No. 23, dated June 7, 2012,

published in Official Journal No. 123, It took N ° 396, from 4 July of the same year, the Law referred to the previous recital has been reformed, with the objective to modernize the customs and to allow the customs service to access the technology

adequate, that it will facilitate the licit trade of goods through the interaction and integration of the participants in the logistic chain and the implementation of non-intrusive inspection services.

III.-That by means of article 12-B of the said Law, the rate was created by the Provision of Services of Non-Intrusive Inspection, the obligation of which is generated by the entrance or exit of Goods or means of transport of the territory

national customs and payment of the same shall be made at the time of the electronic transmission of the Manifesto, Declaration of Goods to any of the Customs Regimes, Form Single Central American Customs,

Internal or International Transits or other declarations or forms to cover the transport, movement or movement of goods to and from the customs territory.

IV.-Which by means of Legislative Decree No 902 of 12 December 2014, published in the Official Journal No 238, 405, from 19 of the same month and year,

were excluded from the payment of the Rate in reference to the operations of international land transit.

V.-That it is necessary to regulate some exemptions to the payment of the Rate established in the Art. 12-B of the Customs Simplification Act, such as, the operations performed by the Diplomats in accordance with the Vienna Convention and the

imports of goods made under the Simplified Declaration mode less than one thousand dollars from the United States of America, among others; as well as the realization of other operations, which will make the appropriate application

in general terms, of the non-intrusive inspection service.

BY TANTO,

in use of its Constitutional powers and on the initiative of the President of the Republic, through the Minister of Finance.

DECRETA the following:

REFORMS TO THE LAW ON CUSTOMS SIMPLIFICATION

Art. 1.-Reform the ninth indent of Article 12-B and incorporate an end point, as follows:

" They shall be excluded from the payment referred to in this Article, the goods in transit that do not have the territory of origin or destination national, the operations carried out by the diplomats of conformity

to the Vienna Convention, the imports or exports of goods carried out under the modality of Simplified Declaration less than one thousand dollars from the United States of America for each importer or exporter, the Declarations containing travellers ' luggage and those that by Conventions or other

Laws are exempt. "

" For the purpose of ensuring the provisions of this provision, the Ministry of Finance shall have the power to carry out all necessary financial, budgetary and accounting operations, indispensable and

all costs and expenses arising from the provision of the Non-Intrusive Inspection Service. "

Art. 2.-This Decree will enter into force eight days after its publication in the Official Journal.
