DECREE NO 155

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 436 dated October 8, 1998, published in Official Journal No. 206, Volume N ° 341 of November 5 of the same

year, the Special Law of the Ocourses of Grace was issued.

II.-That the object of the aforementioned Law, is to regulate the promotion, processing and effects

of the Ocourses of Thank you, those who in your process must be expeditious, trying to avoid excessive bureaucracy, maintaining at all times the control of the condemned person, even if that person is enjoying the

benefit of freedom, in any of the modalities laid down in the first paragraph of Article 39 of the Penitentiary Law.

III.-That in virtue of the foregoing, it is necessary to reform the provision that establishes that, in order to grant the grace of pardon, the Assembly Legislative, after obtaining the opinion of the committee concerned, on whether the request meets the Law, in the sense that the commission qualifies such circumstances

and once checked, that it counts the Supreme Court of Justice; as well as in the part concerning the report of the Regional Criminal Council or National, to the effect that it maintains the control of the convicted person,

even when it is enjoying the benefit of freedom, in any of the modalities established in article 39 of the Penitentiary Law.

DECCRETA:

The following reform to Articles 16 and 25 of the Special Law on the Ocurs de Gracia, issued by Legislative Decree No. 436 dated October 8, 1998, published in the Official Journal No. 206, Volume 5 of November of the same year.

Art. 1.-Reform Article 16 of the Special Law of the Ocurs of Grace, as follows:

" Art. 16. The Legislative Assembly, through the Commission of Justice and Human Rights, shall verify that the request meets the formalities referred to in the previous article. In such circumstances, the Commission shall give the Supreme Court of Justice the account of the Supreme Court, in order to issue the report establishing the Ordinary 26 ° of Article 131 of the Constitution. "

Art. 2.-Add a point, which will be the second, to Art. 25 as follows:

" When the convicted person is found enjoying the benefit of freedom, in any of the modalities laid down in the first paragraph of Article 39 of the Penitentiary Law, to be able to appreciate the considerations contained in the previous paragraph, the Regional or National Criminological Council,

must request a report from the Department of Evidence and Assisted Freedom, who must give it in a 15-day period of time. "

Art. 3.-The current second indent of Article 25, shall be the third.

Art. 4.-This Decree will enter into force eight days after its publication in the Official Journal.
