DECREE N ° 209

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That in accordance with Article 101 of the Constitution of the Republic, the State shall promote economic and social development by increasing the

production, productivity and rational utilization of the resources and that for the same purpose it will promote the various sectors of the production and will defend the interest of consumers.

II.-That by Legislative Decree N ° 405, dated September 3, 1998, published in Official Journal No. 176, Volume No. 340, of the 23rd of the same month and year,

the Law of Free Zones was issued Industrial and Marketing.

III.-That in order to increase domestic and foreign investment and enhance the

competitiveness and productivity of the country, it becomes necessary to expand the production activities and services that can be established and operated in a Franca.y Zone,

IV.-That in order to promote the establishment of new companies related to the strategic sectors defined in the National Policy of Promotion, Diversification and Productive Transformation, it is necessary to establish a framework

appropriate legal that regulates the best practices in the field.

BY TANTO,

in use of its Constitutional powers and on the initiative of the President of the Republic, by means

of the Minister of Economy.

DECRETA the following:

REFORMS TO THE LAW OF INDUSTRIAL FREE ZONES AND MARKETING

Art. 1.-Addition to the first paragraph of Art. 3, the Roman VI, as follows:

" VI. Manufacture, assembly or maquila, manufacture, processing, processing or

placing on the market of compensating products using as raw or input materials, alcohols, including those falling within heading 2207 and subheading 220890 of the Central American Tariff System, SAC, provided that the final product is not liquor or beverages

containing alcohol, except for beverages of pharmaceutical or cosmetic use. "

Art. 2.-Substitute in Art. 6, the literal h), as follows:

" h) Production, assembly or maquila, manufacture, processing, processing or marketing of alcohol of any origin. This prohibition shall not apply to the provisions of Romans V and VI of Art. 3 of this Law. "

Art. 3.-Intercalase in Art. 21, a new paragraph, between the current first and second incisos, as follows:

" The goods covered by the customs regime of Zona Franca, may be referred to a logistic operator authorized under the Law of International Services, only for storage

under the customs procedure of temporary admission established therein. Such goods or compensating products shall continue to be the property of the holder and may only be returned to the same user of Zona Franca. "

Art. 4.-This Decree will enter into force eight days after its publication in the Official Journal.
