DECREE NO 217

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree No. 1030, dated April 26, 1997, published in Official Journal No. 105, Volume N ° 335, of June 10 of the same

year, the Criminal Code was issued.

II. Legislative N ° 733, dated 22 October 2008

in Official Journal No 20, Volume N ° 382, dated January 30, 2009, the Criminal Procedure Code was enacted.

III.-That in accordance with the provisions of Articles 32, 34 of the Code of Criminal Procedure, the prescription occurs because the prosecution of the crime has not been initiated, or In the absence of any of the causes of suspension or interruption in the calculation of the same, in accordance with Articles 35 and 36 of the same Code, it has been initiated, due to the inactivity of their persecution in the criminal proceedings

.

IV.-That in order to eradicate and contribute to the fight of crimes committed

against freedom The criminal code and the Penal Code are necessary to make such crimes, in view of the fact that

DECCRETA, the following:

CRIMINAL CODE AND CRIMINAL PROCEDURAL CODE REFORMS

Art. 1. Reform the fourth paragraph of Article 99 of the Penal Code, as follows:

" It is not prescribed in the following cases: torture, acts of terrorism, kidnapping, genocide, violation of laws or customs of war, enforced disappearance of persons, political persecution,

ideological, racial, by sex or religion, and the crimes committed against the sexual freedom of minor or incapable, provided that these are facts whose beginning of execution was after the validity of the present Code. '

Art 2.-Reform the final paragraph of Article 32 of the Criminal Procedure Code, as follows: Way:
