1 Decree N ° 217 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that through Legislative Decree N ° 1030, dated 26 April 1997, published in the official journal N ° 105, volume N ° 335, 10 June of the same year, was issued the criminal code.
II. that by means of Legislative Decree N ° 733, dated October 22, 2008, published in the official journal N ° 20, volume N ° 382, dated January 30, 2009, was promulgated the code of criminal procedure.
III. occurring in accordance with regulated in articles 32, 34 of the code of criminal procedure, the prescription by have not begun the persecution of crime, or having been started, by the inactivity of their persecution in the corresponding criminal proceedings, without that mediate some of the causes of suspension or discontinuance in the computation of the same, according to articles 35 and 36 of the same code.
IV.-that in order to eradicate and to contribute with the combat of crimes against sexual freedom of children and meet real justice for them, it is necessary to reform the criminal code and the code of criminal procedure, to return limitations such crimes, in view that, at the time in which the facts occurred the child is usually not able to talk about it, much less report.
Therefore, in use of his constitutional powers and at the initiative of the members and the deputies Lorena Guadalupe Pena Mendoza, Guillermo Antonio Gallegos Navarrete, Patricia Valdivieso and with the support of the members and the deputies Rodrigo Avila Avilés, Lucía de el Carmen Ayala de León, Carmen Elena Calderón Sol step and Ricardo Andrés Velásquez Parker.
DECREES, as follows: reforms to the criminal code and criminal procedural code article 1. Reform is the fourth paragraph of article 99 of the criminal code, thus: "does not prescribe the penalty in the following cases: torture, acts of terrorism, kidnapping, genocide, violation of the laws or customs of war, enforced disappearance of persons, political, ideological, racial, persecution by sex or religion, and crimes against sexual freedom of minor or unable to, always that case of facts whose home of execution were subsequent to the entry into force of this code."

2 Art 2-reforming the final paragraph of article 32 of the code of criminal procedure, in the following manner: "does not prescribe the criminal action in the following cases: torture, acts of terrorism, kidnapping, genocide, violation of the laws or customs of war, enforced disappearance of persons and crimes against sexual freedom of minor or unable to, always that case of facts whose home of execution were subsequent to the entry into force of this code."
Article 3.-this Decree shall enter into force eight days after its publication in the official journal.
