DECREE NO 239
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
CONSIDERING:
I.-That by Legislative Decree No. 220, dated January 19, 2007,
published in Official Journal No. 31, Volume No. 374 of February 15 of the same year, the Law of the International Center of Fairs was issued and Conventions of El Salvador.
II.-That in Art. 1 of the Law referred to in the previous recital, created the International Center of Fairs and Conventions of El Salvador, as an
autonomous institution of public law, that among its purposes is the promotion and representation of the country and the Central American Region, through the holding or participating in fairs, exhibitions, congresses, conventions
or any other event of a similar nature.
III.-That the International Center of Fairs and Conventions of El Salvador, needs a legal framework in budgetary matter responding to its nature and
current need; as well as redefining the privileges of its administrative structure, in order to attend to the activities that the institution develops.
IV.-That under the above, it is necessary to introduce reforms to the Law in order to establish the relevant attributions and update the provisions that are necessary for the operation of the
Institution.
FOR TANTO,
in use of its Constitutional powers and on the initiative of the President of the Republic, through the Minister of Economy.
DECRETA the following:
REFORMS TO THE LAW OF THE INTERNATIONAL CENTER OF FAIRS AND CONVENTIONS OF EL SALVADOR ISSUED BY LEGISLATIVE DECREE NO 220 OF DATE 19 OF
JANUARY 2007
Art. 1.-Reform the first paragraph of Art. 1, as follows:
" Art. 1.-Create the International Center of Fairs and Conventions of El Salvador, as an institution of public law, which may be abbreviated as a Center of Fairs and Conventions, or CIFCO, and that in the course of this Law may also be called the Institution with legal personality and own property, with economic, financial and administrative autonomy, and whose domicile will be the City of San Salvador. "

Art. 2.-Replace Art. 10 by the following:
" OF THE PRESIDENT
Art. 10.-The Chairman of the Board of Directors shall be the Legal Representative of the Institution,
shall represent the institution and the Board in front of all staff; administratively shall be the hierarchical superior and shall also have the following attributions:
a) Administer the Institution and fulfill its purposes as provided by this Law, and which have not been expressly reserved for the Board of Directors;
b) Lead the Market Promotion of the Institution, through its participation and assistance in all national events or international events of interest for the development of institutional purposes;
c) Negotiate and subscribe, subject to the authorization of the Board of Directors, the acts, conventions, alliances and all manner of contracts that are necessary for the fulfilment of the purposes
of the Institution, in accordance with this Law;
d) Present the project of the institutional budget and its modifications, as well as the annual operating plan to the Board;
e) Contry, as authorized by the Board Directive, administrative and operational staff of the Institution; as well as remove and promote it within the parameters
established by the Board of Directors;
f) Run the acts designated by the Board of Directors;
g) Grant powers if necessary, subject to the authorization of the Board of Directors;
compliance with the applicable laws and regulations, the goods and services necessary for the fulfilment of the objectives of the Institution within the approved budget;
i) Issue internal circulars, containing organizational guidelines; reports, rules and administrative controls that make it easier for employees to execution of their
functions;
j) Propose, for the approval of the Board of Directors, the remuneration regime of the
officials and other staff of the Institution;
k) Represent the Institution, by designation of the Board of Directors, to bodies
national and international;
l) To participate or represent the country in the international events that are of interest for the purposes of the Institution;

m) Present to the Board of Directors, any report within its competence requested by the same; and,
n) Submit monthly to the Board of Directors the state of institutional financial situation. "
Art. 3.-Replace Art. 12, by the following:
" OF THE EXECUTIVE DIRECTOR
Art. 12.-The Chairman of the Board will propose to this, a person for the position of Director
Executive of the Institution.
The functions of the Executive Director shall be of an administrative nature, which it entrusts or
delegate the Board of Directors or the President; will ensure the orders given by the Board of Directors and the President.
The Executive Director will be responsible for ensuring compliance with the purposes of the institution and will have for that case, for the authorisation of the Presidency, powers to administer and monitor the daily activities of the
The Executive Director, upon authorization of the Presidency, may delegate to each event, the administrative acts in the Area Managers.
The person who performs the office of the Executive Director shall devote all of his or her activity to the exercise of his or her duties and shall not be permitted to serve any other paid position, except those of a teaching character or that of members of central government commissions, within the relevant legal constraints
. "
Art. 4.-Replace Art. 14, by the following:
EXECUTIVE DIRECTOR
Art. 14.-They are the responsibility of the Executive Director of the Institution, the following:
a) Directing the administrative operations of the CIFCO that are delegated to it by the Presidency;
b) Direct to the different Management the correct and effective of the various institutional dependencies, as established by the policies and procedures
institutional and all the regulations applicable to the institutional activity, so that it will be responsible to the Presidency and the Board of Directors of the above;
c) Set general guidelines for (d) Leading institutional strategic management;

e) Direct and control the performance of all institutional dependencies;
f) Submit monthly to the Presidency, the institution's financial situation statements;
g) Run the acts designated by the Board and the Presidency;
h) Develop the institutional budget project and its modifications, as well as the plan
annual operation and submit them to the Presidency;
i) Present to the Presidency, prior to the approval of the Board of Directors, the changes
necessary in the rules of participation of any event that benefits the development of the same;
j) Elaborate the report of work institutional, as well as any other report that within its competence is requested by the Presidency or the Board of Directors;
k) Attend the Board meetings and the working committees with a voice, but without a vote;
l) Be the Secretary of Acts of the Board of Directors and the person in charge of guarding the book of
Acts of Board of Directors; and,
m) Present to the Board of Directors and to the Presidency, within the first quarter of each year,
its work report. "
Art. 5.-Intercalase between Arts 19 and 20, Art. 19-A, as follows:
BUDGET EXECUTION
Art. 19-A. During the implementation of the budget, the Fairs and Convention Center may extend its budgetary allocations, both by the specific sources of revenue, and by the expenditure, with the amounts that they receive in excess of the estimates of income, whose sources are specified
in the Law of the Institutional Budget and approved by the Board of Directors, which shall be communicated to the General Directorate of the Budget and to the Directorate General of Accounting Government, for their corresponding records. "
Art. 6.-Substitute in Art. 23, point (a), by the following:
" (a) The remuneration of the members of the Board of Directors shall be fixed on the basis of the allowance; having the President assigned a monthly salary, determined by the Board Agreement Directive, in accordance with the existing Wage Law. "
Art. 7. This Decree shall enter into force eight days after its publication in the Official Journal.
