DECREE NO 236

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That the Constitution of the Republic establishes in its Art. 3, that all persons are equal before the Law. Likewise, in Article 63, second indent, El Salvador

recognizes indigenous peoples, so it will adopt policies to maintain and develop their ethnic and cultural identity, worldview and spiritual values.

II. Article 144 of the same Constitution, regulates that the International Treaties concluded by El Salvador with other States or with International Organizations, constitute Laws of the Republic.

III.-That by Legislative Decree No. 27, Date 23 November 1979, published in Official Journal No 218, Volume No 265 of the same date, ratified

the International Convention on the Elimination of All Forms of Racial Discrimination, which establishes for its implementation the "Committee for the Elimination of Racial Discrimination", which will be competent, among others, for to examine the reports submitted by the States on the measures they have

the provisions contained in the Convention.

IV.-Which according to Art. 14 of the aforementioned Convention, it is necessary that

States Parties declare that they recognize the competence of the Committee to receive and examine the communications of persons or groups of persons within their jurisdiction, who claim to be victims of violations by

that State, of any of the rights provided for in the Convention; to count on the aforementioned recognition by the Republic of El Salvador.

V.-That recognizing the importance of the Committee for the Elimination of Racial Discrimination and being congruent with respect and the application of the

International Convention on the Elimination of All Forms of Racial Discrimination necessary to declare the recognition of the competence of the aforementioned Committee and which is established in Art. 14 of

the Convention, since it seeks to avoid any exclusion, restriction or preference based on race, color, lineage or national or ethnic origin.

in use of the authority established in Art. 131, Ordinary 7th of the Constitution in relation to Art. 168, Ordinary 4th of the Constitution, and at the initiative of the President of the Republic, through the Minister of Foreign Affairs.

DECCRETA:

Art. 1.-The competence of the Committee on the Elimination of Racial Discrimination to receive and examine the communications of persons or groups of persons, within the jurisdiction of the State Party, which is alleged to be victims of violations by that State, of

any of the rights stipulated in the International Convention on the Elimination of All Forms of Racial Discrimination, as established in Art. 14 of the Convention.

Art. 2.-This Decree shall enter into force eight days after its publication in the Official Journal.
