DECREE N ° 247

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That by Legislative Decree Nº 476, dated October 18, 1995, published in Official Journal No. 222, Volume 329, of November 30,

same year, the Law of the Military Career was issued, which is the legal instrument governing, in accordance with the Constitution, the professional practice of such a career.

II.-That by Legislative Decree No. 882 dated November 30, 2005, published in Official Journal No. 12, Volume No. 370 of January 18, 2006, reforms were introduced to the Law of the Military Career, regarding the increase of

service time at certain degrees.

III.-That in order to extend the professional life of the Officers and Sub-Officers,

favoring the social security of the same, it becomes necessary to extend the service time within of the military career.

in use of its Constitutional powers and at the initiative of President of the Republic of Mauritius Funes Cartagena from 2009-2014, through the Minister of National Defense José Atilio Benitez

DECCRETA, the following:

REFORMS TO THE LAW OF THE RACE MILITARY

Art. 1.-Reform, the first paragraph of Article 6, as follows:

"In the cases referred to in the previous article, the military career shall be thirty

and six years of service time."

Art. 2.-Reform Article 60, as follows:

" Art. 60.-The time of service, with the degree to the Officers, will be in the following degrees or their equivalents:

Sublieutenant ........................... 5 years Lieutenant ................................ 6 years

Captain ................................. 6 years Major ....................................... 7 years Lieutenant Colonel ................... 6 years Colonel ................................. 6 years

Art. 3.-Replace Article 113, by the following:

" Art. 113.-The Military Hospital shall provide permanent and lifelong medical care, without any distinction, to all Officers and Sub-Officers who acquire their right to a pension according to the Law of the Social Security Institute of the Armed Forces, except those who have caused a loss

before complying with the minimum time regulated in that Law, in order to be entitled to the said pension. "

Transitory

Art. 4.-To those who are within the legal budgets currently contemplated by the Military Laws to acquire the right to medical care, Article 113 of

this Law will not apply to them.

Art. 5.-This Decree shall enter into force eight days after its publication in the Official Journal

.
