1. Decree No. 295 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-referred to in article 3, subparagraph 1st of the Constitution, that all persons are equal before the law and for the enjoyment of civil rights shall not be restrictions based on differences of nationality, race, sex or religion.
II. on October 4, 2007, the Legislative Assembly of El Salvador ratified, "Convention on the rights of las people with disability and your Optional Protocol", instruments that contemplate not only the legal framework existing in this area, but also, to strengthen the work being carried out with various sectors to promote a fairer, more equitable and more solidarity-based society.
III.-that the above-mentioned Convention provides in its article 9.-the accessibility-a. purpose that people with disabilities can live independently and participate fully in all aspects of life, States parties shall take appropriate measures to ensure the access of people with disabilities, on an equal basis with others, to the physical environment , transportation, information and communications, including systems and technologies of information and communications, and other services and facilities open to the public or public use, both in urban and rural areas and that these measures include the identification and elimination of obstacles and barriers to access.
IV.-that the 4 June 1951, was issued the Decree 232, containing the "law of urban planning and construction", which was published in the official journal N ° 107, take N ° 151 of June 11, 1951. Thus, on 31 January 1986, was issued Decree 274, containing the "city code", which was published in the official journal N ° 23, take N ° 290, 05 February 1986.
V-governing the aforementioned legal instruments concerning the elaboration, adoption and implementation of urban and Rural development plans, and that for this reason becomes necessary to reform both laws relate the regulations laid down in the Convention on the rights of people with disabilities.
Therefore, in use of his constitutional powers, de el Diputado David Ernesto Reyes Molina initiative and with the support of the Deputy Mártir Arnoldo Marín Villanueva.
2 DECREES the following: reform to the code MUNICIPAL article 1.-reforming the paragraph 3 of article 31 as follows: 3.-"Develop and monitor the implementation of the plan and local development programmes, which at the time of its elaboration must comply strictly with universal design of accessibility for persons with disabilities, article 9, of the Convention on the rights of persons with disabilities."
Article 2.-this Decree shall enter into force eight days after its publication in the official journal.
