DECREE NO 295
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
CONSIDERING:
I.-That in Art. 3, paragraph 1 of the Constitution, it is established that all persons are equal before the Law and that for the enjoyment of civil rights they will not be able
to establish restrictions that are based on differences of nationality, race, sex or religion.
II.-May 4, 2007, the Assembly Legislative of El Salvador ratified the "Convention on the Rights of Persons with Disabilities and its Optional Protocol," instruments that not only contemplate the existing legal framework in
this issue, but also strengthen the work that it is developed with various sectors in order to promote a more just, more equitable and more supportive society.
III.-That the aforementioned Convention establishes in its Art. 9.-ACCESSIBILITY.-In order for people with disabilities to be able to live independently and participate fully in all aspects of life,
States Parties shall take appropriate measures to ensure the access of persons with disabilities, on equal terms with others, to the physical environment, transport, information and communications, including the
systems and information and communications technologies, and other public or public use services and facilities, both in urban and rural areas and that these measures include the identification and removal
of obstacles and Access barriers.
IV.-That on June 4, 1951, Decree 232 was issued, containing the " Law of
Urbanism and Construction, " which was published in Official Journal No. 107, Volume No. 151 of June 11, 1951. Thus also, on 31 January 1986, Decree 274 was issued, which contains the "Municipal Code", which was published in the
Official Journal No 23, Volume No 290 of 05 February 1986.
V.-That the aforementioned legal instruments regulate the
elaboration, approval and execution of Urban and Rural Development Plans, and that for this reason it becomes necessary to reform both Laws to relate the established regulations, in the Convention on the Rights of Persons
with Disabilities.

DECRETA the following:
MUNICIPAL CODE REFORM
Art. 1.-Reform the number 3 of Art. 31 as follows:
3.-" Develop and control the execution of the plan and local development programs, which at the time of their elaboration must strictly comply with the universal design of
accessibility for persons with disabilities, established in Art. 9 of the Convention on the Rights of Persons with Disabilities. "
Art. 2.-This Decree shall enter into force eight days after its publication in the Official Journal.
