DECREE N ° 348

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That Art. 1 of the Constitution recognizes the human person as the origin and the end of state activity and it is their duty to assure the inhabitants

the enjoyment of freedom, legal certainty and good common.

II.-Which dated August 24, 2015, was declared in unanimous judgment by

The Constitutional Chamber of the Supreme Court of Justice, which are called "Terrorist Groups" the gangs or gangs whatever their name or criminal organization that seeks to take the exercise of the

powers belonging to the State's sovereignty; frightening and putting at serious risk or systematically and indiscriminately affecting the fundamental rights of the population or part of the population.

the object of preventing, investigating, sanctioning and eradicating the crimes described in the Law; as well as all its manifestations, including its financing and related activities, which are evidenced by the intention to provoke states

of alarm, among others.

IV.-That for the reasons set forth above, it becomes necessary to issue the reforms

legal pertinent to the Special Law Against Acts of Terrorism, in order to harmonize this normative body with the Resolution of the Chamber of Constitutional for a better typicity of the crime and applicability of the Law by the authorities

corresponding.

DECRETA, the following:

REFORM OF THE SPECIAL ACT AGAINST ACTS OF TERRORISM

Art. 1.-Reform the literal m) of Art. 4, as follows:

" m) Terrorist organizations: They are those groupings with a certain structure from which links are born to some extent stable or permanent, with hierarchy and discipline and with means They seek the use of violent or inhuman methods with

the express purpose of instilling terror, insecurity, alarm, arrogate the exercise of powers belonging to the sovereignty of the States or to systematically affect the fundamental rights of the population or part thereof, of one or more countries.
