1 Decree N ° 348 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-Art. 1 of the Constitution recognizes the human person as the origin and purpose of the activity of the State and its obligation to ensure the inhabitants the enjoyment of freedom, the legal security and the common good.
II.-that dated August 24, the year 2015, has been declared unanimous verdict by the Constitutional Division of the Supreme Court of Justice, which are called "Terrorist groups" gangs or gang any name or criminal organization seeking to usurp the exercise of powers within the scope of the sovereignty of the State; bullying and putting at serious risk or systematic and indiscriminately affecting the fundamental rights of the population or part of it.
III. that by means of Legislative Decree N ° 108, dated September 21, 2006, published in the official journal N ° 193, volume N ° 373, October 17 of that year, was issued the law special against acts of terrorism, in order to prevent, investigate, punish, and eradicate the crimes described in law; as well as all its manifestations, including its financing and related activities, that the same show intended to provoke States of alarm, among others.
IV.-that for the reasons previously given, becomes necessary to issue legal reforms relevant to the law special against acts of terrorism, to end to harmonize the regulatory body with the resolution of the Constitutional Division for a better type of crime and enforcement by the relevant authorities.
Therefore, use of his constitutional powers and at the initiative of the members José Antonio Almendáriz Rivas, Guillermo Antonio Gallegos Navarrete, Misael Mejia Mejia, Norman Noel Quijano González, Rodrigo Avila Avilés, Alberto Roger Blandino Nerio, Ana Vilma Albanéz de Escobar, Juan Pablo Herrera Rivas, Reynaldo Antonio López Cardoza, José Nohe Reyes Granados, Jose Francisco Merino López, Santiago Flores Alfaro, Carlos Mario Zambrano Campos and white rose vines.
DECREES, the following: reform to the law special against acts of terrorism 2 article 1.-reforming the literal m) 4 article, as well: "m) terrorist organizations: are those groupings provided with certain structure which are born links to some extent stable or permanent, with hierarchy and discipline and appropriate means, seek to violent or inhumane methods with the express purpose of instilling terror" insecurity, alarm, assume the exercise of powers belonging to the sovereignty of States or systematically affect the fundamental rights of the population or part of it, in one or more countries.
For the purposes of this Act, shall be deemed as such those declared by the competent authority of the country and the framed in the listings of the United Nations, international agencies which El Salvador is a party, as well as those established by bilateral agreements."
Article 2.-this Decree shall enter into force eight days after its publication in the official journal.
