1 Decree N ° 355 the Legislative Assembly of the Republic of EL SALVADOR, considering: I.-that the Arts. 1 and 2 of the Constitution of the Republic establishes that El Salvador recognizes the human person as the origin and purpose of the activity of the State and that everyone has the right to life, to physical and moral integrity, freedom, security, work, property and possession, and to be protected in the preservation and defence of the same; Recognizing her in article 22 of the Magna Charter, the right to freely dispose of their property and to pass the property in the way in which to determine the laws.
II. that by means of Legislative Decree N ° 534, of date 07 November 2013, published in the official journal N ° 223, Tome N ° 401, 28 of that same month and year, issued the special law of extinction of domain and the administration of the goods of origin or illegal destination, which aims to regulate the procedure governing the action of extinction of domain in favor of the State , on those goods that fall within budgets that give rise in law.
III.-that the only one that exists in El Salvador for the construction of the heritage and wealth is the honest working and with strict adherence to the laws of the Republic; therefore not have any protection, in the case of economic interest, origin or destination of illicit goods.
IV.-that for the above reasons, becomes necessary to issue legal reforms relevant to the special law of extinction of domain and the administration of the goods of origin or illegal destination, in order to ensure the strict adherence to the law.
Therefore, use of his constitutional powers and at the initiative of the members José Antonio Almendáriz Rivas, Guillermo Antonio Gallegos Navarrete, Misael Mejia Mejia, Norman Noel Quijano González, Rodrigo Avila Avilés, Alberto Roger Blandino Nerio, Ana Vilma Albanez de Escobar, Juan Pablo Herrera Rivas, Reynaldo Antonio López Cardoza, José Nohé Reyes Granados, José Francisco Merino López, Santiago Flores Alfaro and Carlos Mario Zambrano Campos.
DECREES, as follows: reforms to LA law special of extinction of domain and of the administration of the goods of origin or destination illicit 2 Art. 1.-reform the third paragraph of article 23, as well: "if measures have been enacted precautionary in the investigation phase, the Special Prosecutor should the onset of action of extinction of domain request or impose the file accordingly within a maximum period of ninety days, extendable by the judge for a period of time equal, under penalty of lifting the measure, to avoid affecting the rights of third parties of good faith free of guilt. The foregoing without prejudice to disciplinary measures and criminal proceedings to which any place."
Article 2.-reforming the literal f) of the first subparagraph of article 27, as well: "f) enact measures precautionary relevant collateral subject to the action of extinction of domain and subject to ratification by the judge specialized within five working days."
Article 3.-this Decree shall enter into force eight days after its publication in the official journal.
