DECREE N ° 410

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR

CONSIDERING:

I.-That by Legislative Decree No. 74, dated September 8, 1988, published in Official Journal No. 176, Volume No. 300 of the 23rd of the same month and year, was issued

the Law of Creation of the Fund for Economic Development and Social of the Municipalities.

II.-That by Legislative Decree No. 850, dated April 17, 2009, Published in Official Journal No 81, Volume N ° 383 of 6 May of the same year, the municipalities were empowered to use up to fifty percent of the seventy and to fifty percent from the first of May 2009 to 30 of

April 2010. Five percent of the resources allocated by that Fund, for the realization of the activities concerning the collection, transport and final disposal of the

solid waste and the technical closure of the open-pit botheries that I know They generate in their municipalities, which has been extended in various fiscal years with different percentages.

III.-That by Legislative Decree No. 607, dated January 16, 2014, published in Official Journal No. 29, Volume No. 402 of February 13 of the same year, the municipalities of the country were authorized to make use of these funds, in an

percentage of fifteen percent, as of December 31, 2014.

IV.-That by Legislative Decree No. 82, dated August 13, 2015, published

in the Official Journal No. 173, Volume No. 408 of 23 September of the same year, the municipalities were empowered to take effect from the validity of the Decree and Until September 30 of the year 2016, they can use up to fifteen percent of the

seventy-five percent, of the resources allocated by the FODES, for the realization of the activities concerning the collection, transport and final disposal of solid waste and the technical closure of the open pit (s) to

Municipalities.

V.-That to date municipalities still need to make use of these funds,

since the Ministry of the Environment and Natural Resources has only partial advances in the National Comprehensive Management Plan. Solid Waste, therefore, it is necessary to extend the effects of Decree No.

82, dated August 13, 2015, for one more year in order to temporarily empower the municipalities, so that they can use up to the fifteen percent of the seventy-five percent of the resources allocated by the FODES,

Municipalities continue to meet the needs demanded by the population in the collection, transportation, final disposal of solid waste and technical closure of the open pit.

DECCRETA:

Art. 1.-Extended until 30 September 2017, the effects of the Legislative Decree

N ° 82, dated August 13, 2015, published in Official Journal No. 173, Volume N ° 408, of September 23 of the year two thousand fifteen.

Art. 2.-This Decree shall enter into force from the day of its publication in the Official Journal.
