DECREE Nº 262.-
THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,
CONSIDERING:
I.-That by Decrees numbers 261 and 262 issued this day, this Assembly has created in the national territory Courts of Judgment, Courts of Instruction, Courts of Peace and Courts of Penitentiary and Enforcement of the Penalty; and has converted into the Courts of Instruction, Courts of the previously existing Penal;
II.-That the creation and conversion of so many judicial bodies, which will have to apply criminal and penal procedural law, which will enter into force on the next twentieth day of April, implies the integral modification of the Organic Law Judicial in relation to the current structure of courts that the same slogan;
III.-That while the modifications are introduced pertinent to the aforementioned organic legislation, it is convenient to regulate by special decree, the jurisdictions, attributions and residences of the courts and courts of the Republic;

Court of Penitentiary Surveillance First and Execution of the Penalty-Residence: San Salvador. You will be aware of the matters of your jurisdiction dealt with in the Courts of Judgment residing in San Salvador; the Courts of Instruction residing in San Salvador and San Marcos; and the Peace Courts resident in San Salvador, San Marcos, Panchimalco, Rosario de Mora, Santiago Texacuangos and Santo Tomás.
It will also exercise prison and prison surveillance in the people who are admitted to the La Esperanza prison. The knowledge of the plenary trial in the criminal proceedings dealt with in the Courts First, Fourth and Seventh of Instruction, with residence in San Salvador and Court of Instruction with residence in San Marcos, will be the responsibility of the Tribunal Primero de Sentence with residence in San Salvador.-The same knowledge will be the case to the Court of Judgment with residence in Mexico, regarding the Court of Instruction with residence in Mexico.

THE PROCESSES RESULTING FROM A TRAFFIC ACCIDENT INITIATED BEFORE 20 APRIL OF ONE THOUSAND NINE HUNDRED AND NINETY-EIGHT SHALL CONTINUE TO BE DEALT WITH BY THE COURT OF LAW AND IN ACCORDANCE WITH THE LAW OF SPECIAL PROCEDURES ON ACCIDENTS. OF TRANSIT, UNTIL THIRTY-ONE DECEMBER OF A THOUSAND NINE HUNDRED AND NINETY-NINE. (1) (2)
Art. 3. THE CRIMINAL AND CIVIL PROCESSES IN THE FIELD OF FINANCE, WHICH AT THE TWENTIETH OF APRIL OF A THOUSAND NINE HUNDRED AND NINETY-EIGHT ARE IN THE PROCESS, WILL CONTINUE TO BE KNOWN UNTIL THE THIRTIETH OF SEPTEMBER OF A THOUSAND NINE HUNDRED AND NINETY-NINE, ACCORDING TO THE LAWS. SUBSTANTIVE AND PROCEDURAL ISSUES WITH WHICH THEY WERE INITIATED. (1) (2)
Art. 4.-The knowledge of the processes of transit referred to in Art. 35 of the Law of Special Procedures on Traffic Accidents, which will be initiated after twenty April of one thousand nine hundred and ninety-eight, shall correspond to the Judges of First Instance and Courts with jurisdiction in civil matters; those that will apply; the procedures contained in Titles IV and V of the aforementioned Law.
Art. 5.-The knowledge of the civil processes in the field of finance, which will be initiated after 20 April of a thousand nine hundred and ninety-eight, shall be the responsibility of the Judges and Courts with civil jurisdiction, and shall be dealt with in accordance with the provisions of the civil judgments according to the amount, prescribes the Code of Civil Procedures.
Art. 6. This decree will be incorporated into the Law of the Judicial Organic Law.
Art. 7. The provisions of the Law and other laws and legal precepts contained in other ordinances, which contradict or oppose the provisions of this decree, are hereby repealed.

Art. 8.-This Decree shall enter into force on the twentieth day of April, one thousand nine hundred and ninety-eight, upon publication in the Official Journal.
