DECREE NO 670

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

CONSIDERING:

I.-That Article 1 and 2 of the Constitution of the Republic recognize the person

as the origin and end of the activity of the State.

II. establishes the Constitution in its Art. 119 declares itself of social interest the

construction of houses, being born an obligation on the part of the State to procure

that all of El Salvador has access to a housing that meets the conditions

III.-That article 33 of the Law on Equality, Equity and Eradication of Discrimination

Against Women states that special programs should be created to facilitate

access to housing for women heads of family in the context of eradicating the

unprotected and the housing vulnerability.

IV.-That there is a problem on the part of women heads of family to be able

to obtain a decent housing, in view of a very limited scope to programs of

financing housing.

V.-That in the same spirit of the approval of the Law of Equality, Equity and

Eradication of Discrimination Against Women, it becomes necessary that the Law of the

National Fund for Popular Housing, establish the facilities so that women

family members can obtain credits that will allow solve your problem of

access to housing and seek the most favorable conditions for financing

housing of social interest.

in use of its Constitutional powers and at the initiative of the Deputy Carmen Elena Calderon

of Escalón.

DECRETA the following:

REFORM OF THE LAW OF THE NATIONAL PEOPLE ' S HOUSING FUND

Art. 1.-Replace Art. 40, by the following:

" Art. 40.-The Housing Contribution shall be unique, direct, transparent and not

discriminatory for reasons of politics, race, sex or religion. In case of natural disaster, calamity

public or state of emergency qualified by the Executive or Legislative Body, or in a fortuitous case or

higher-strength qualified by the Fund's Board of Directors, new Contribution may be awarded to the

affected family.

May be beneficiaries of the Housing Contribution, family groups, or women,

when they are the only ones responsible for the household, who are running to receive it because they lack

a suitable housing solution and sufficient income to obtain it; in the case of the

women referred to above, they will be entitled to preferential treatment as regards the requirement of the

formal requirements to be met to access that benefit.

In case of approval of the Contribution the only beneficiaries of the property will be the children of

the woman making the request.

Housing contributions may only be granted to beneficiaries who

check the property on the land for housing or that with the contribution product u

other donations from national or foreign agencies, complement the necessary resources

for their acquisition.

Special contributions to refers to Art. 36, literal c, may only be intended

to benefit the members or contributors of the institution that make such contributions. "

Art. 2.- This Decree will enter into force eight days after its publication in the

Official Journal.
