Notice On (A)-Funds And Members ' Conditions During The Strike And Lockout (Conflict)

Purline Section 61 (2). 4, in the Act of Unemployment Insurance, etc., cf. Law Order no. 348 of 8. April 2014, and after negotiating the Employment Council, the following shall be adopted :

§ 1. A member that is subject to conflict, cf. § 2, and which is lefant as a result of the conflict, see § 3, doesn't have the right to the daily money.

Paragraph 2. Paragraph 1 shall also apply to a Member who is employed at a reduced period and which receives additional benefits.

§ 2. A member is subject to conflict if :

1) a conflict within the area of professional competence in the Member State of the Member State, and the member at the start of the conflict are employed in a conflict-affected activity, or

2) The member is employed in a conflict of conflict in the start of the conflict, and the Member's salary and working conditions must be assumed directly in the face of the decline of the conflict.

Paragraph 2. A member is subject to conflict even if the member is not an employee of the company on the day the conflict starts. However, this only applies if the Member has a longer-lasting, fixed association to the company, and it is because of the conflict that the Member for a period of time is not working in the company.

Paragraph 3. A member not covered by paragraph 1. 1 and 2 are not covered by conflict, even though the Member is discharged or dismissed as a result of a conflict.

§ 3. A member that is free and subject to conflict, cf. Section 2 shall be deemed to be leeded as a result of the conflict, cf. however, paragraph 1 2-4.

Paragraph 2. A Member is not available as a result of conflict if it is documented that unemployment is caused by other circumstances.

Paragraph 3. A member whose daily money has been halted by conflict, cf. § 1, is entitled to unemployment benefits if the member of the conflict is given other work and the new working relationship has had a lasting period of at least five weeks. It is a prerequisite that the Member belongs to a case of a non-stop payment of benefits resulting from conflict, cf. § 5.

Paragraph 4. A Member who has not had the right to daily money as a result of a conflict is entitled to a daily coin immediately after the end of the conflict, if the Member is leaced and, incidentally, satisfies the right of the right to benefits.

§ 4. A Member who does not have the right to receive benefits because of conflict, cf. § 1, may not as a transfer member have the right to the daily money in another a box, cf. however, section 3 (3). 3.

§ 5. A box must stop for the payment of daily allowances to all members if a non-collective conflict comprises 65%. or more of the members of the case that are either receiving additional benefits or are not receiving benefits from the case of a case.

§ 6. A case of a case that has members who are subject to conflict shall immediately begin at the start of any conflict :

1) the number of members covered by the conflict ; and

2) the number of members who do not receive benefits from the case of a supplementary daily allowance.

Paragraph 2. The A box shall, within three days of any conflict, have to determine whether a daily payment may be paid, cf. § 5.

Paragraph 3. The A box shall immediately give the Director of the Labor Market and Recruitment Management Board if it determines that the daily allowances cannot be paid, cf. § 5.

Paragraph 4. At the same time, the A box is required to provide relevant job centres and Workhome centres to be notified of any conflict, whether or not the decisions made by the box have been taken and the basis for that.

§ 7. A Member who does not have the right to receive benefits because of conflict, cf. Section 5, which is being transferred to another a box because the member of the conflict is going to work elsewhere, can once again receive unemployment benefits if the Member, by the way, meets the conditions for having the right to benefits. It is a prerequisite that the one-box to which the Member has been transferred has not halted the payment of daily money as a result of conflict.

§ 8. The announcement will enter into force on the 23rd. February 2015.

Paragraph 2. At the same time, notice No 103 of 14. February 2001 on the points made by the cases and members of the Member States during the strike and the lockout (conflict).
