Annuntation of the fruit and vegetable scheme 1)

In accordance with paragraph 1 (1), 1-5, section 4, paragraph 4. One, section 5 a, section 22, paragraph. Article 24 (2) and Article 24 of the European Community regulations on schemes under the common agricultural policy funded by the European Guarantee Fund for agriculture and so on. (The agricultural aid code (s) cf. Law Order no. 244 of 28. February 2013, according to section 5 (5), shall be adopted. 1, no. 1, in the notice. 512 of 23. April 2015 on the Office of Natural Business Authority and powers :

Chapter 1

Scope of application

§ 1. The Office of Natural Acquisitions may offer a commitment to the distribution of fruit and vegetables to children in educational establishments within the framework of the European Union fruit and vegetable market framework under the common organisation of the market in the European Union, agricultural products. Supplements may also be provided for accompanying measures.

Paragraph 2. Supplements shall be granted to fresh, unprocessed fruit and vegetables. However, products may be prepared or bought in the event of their living up to the requirements of the food type key mark for fruit and vegetables.

Chapter 2

Definitions

§ 2. In the case of a school fruit and vegetable sector, this notice shall mean an arrangement which means that students at a given school are offered fruit and vegetables from 1 to the teaching day. August to 30. June.

Paragraph 2. A school is understood to mean a teaching institution, where there are in kindergarten and 1 to 10. class steps or equivalent level shall be taught in accordance with the primary school law or given a class that is the target of what is commonly required in primary school.

Paragraph 3. A day of instruction shall mean a day in which an active, bulleted education is carried out and where there is a meeting for the pupils.

Paragraph 4. An accompanying measure shall mean the measures to promote the knowledge of nutrition, health and fruit and vegetables, including ecology, for example, when reading and discussing educational material.

Paragraph 5. Regulation No 2, The Commission Regulation No 288/2009 is understood. 288 /2009/EC of 7. April 2009 laying down detailed rules for the application of Council Regulation (EC) No In the case of Community support for the distribution of fruit and vegetable products, fruit and vegetable products and fruit products to children in educational establishments, in the framework of a school fruit scheme, processed fruit and vegetable products.

Paragraph 6. Regulation No 2, The European Parliament and Council Regulation (EC) No 1308/2013 is understood. 1308/2013 of 17. Chapter 3

Authorities and controls

§ 3. The Office of the Natural Safety Agency shall be responsible for administrative and physical checks on the administration of the scheme.

Paragraph 2. It shall be the responsibility of the saviors to provide the necessary assistance for inspection purposes and to ensure that the schools are involved in inspection purposes.

Paragraph 3. The Office of the Natural Business Authority may, in accordance with the section 22 (a) of the law, obtain the information necessary to carry out checks.

Chapter 4

Commitment and payout application

§ 4. The following may be supported, cf. Regulation 288/2009, Article 6 (1). 2 :

1) Education institutions.

2) Municipalities.

3) Suppliers and / or distributors of fruit and vegetables.

4) Organizations that are specifically created to participate in the school fruit and vegetable system.

Paragraph 2. School-free time schemes cannot apply for subsidies.

Paragraph 3. Applicants referred to in paragraph 1. 1, no. 2, 3 and 4, is required to record the name and address of the educational institutions and / or, if appropriate, by way of an address. the educational authorities and the quantities of products which have been sold or delivered to the educational institutions or the educational authorities, cf. Regulation 288/2009, Article 7 (1). 3.

§ 5. The application for an undertaking and an application for payment of grants shall be submitted on a special scheme available when it comes to the Natural Business Authority and is available on the Home Affairs website of the Natural Acquisitions.

Paragraph 2. The application for a commitment to the year 2015/2016 shall be received in the Office of Natural Acquireation, no later than 4. June 2015.

Paragraph 3. Applications for payment of grants may be submitted three times a yearly basis on the basis of the following :

1) August 1 to 31. December,

2) 1 January to 31. May, and

3) June 1 to 30. June.

Paragraph 4. An application for payment of grants shall be received in the Office of Natural Acquisitions no later than the last day of the third month following the expiry of the period referred to in paragraph 1. 3 where the products are distributed.

Paragraph 5. In the application for an undertaking, the applicant shall indicate to which or which accompanying measures it intends to apply, cf. Section 2 (2). 4.

Paragraph 6. In Annex 1 to this notice, a number of proposals are proposed for accompanying measures. The Benefit Board shall provide accompanying measures for free of charge, cf. in Annex 1, no. 1. If the applicant does not wish to use the accompanying measures of the Natural Business Management Agency, the applicant may instead apply for subsidies for the costs of accompanying measures to which the applicant itself will apply.

§ 6. The Office of the Natural Acquisitation Management Board shall decide on commitments after the expiry of the application, cf. Section 5 (5). 2.

1) A priority is given to applications for schools that have not previously received EU grants under the school fruit scheme.

3) Priority is given to applications from municipalities or vendors who are applying to the whole class or schools.

4) Priority shall be given to applications for schools with a high level of coverage for participating students in kindergarten and 1 to 8. class steps at the school concerned.

Paragraph 4. In the event that the subsidy from the European Union is reduced, the Services of Natural Acquilices may be reduced in the already committed commitments. The fences will be reduced proportionally.

§ 7. By way of derogation from Section 6, paragraph 3, and 4, can up to 10%. in the case of the total grant pool, fruit and vegetables are awarded with planned power measurement of increased consumption of fruit and vegetables. Paragraph 2. Classes participating in other schemes with a focus on nutrition, fitness and healthy ways of life can also obtain an assurance from paragraph 1. 1. Priority shall, however, be granted to applications with planned power measurement.

Paragraph 3. Applications for paragraph 1. 1, must include at least four schools and must be submitted by the organisation responsible for the initiative.

Paragraph 4. In the light of the individual application, the Danish Agency shall evaluate whether or not an undertaking may be obtained in accordance with paragraph 1. 1.

Chapter 5

Conditions for grants

§ 8. Supplements shall be made subject to compliance with the following conditions :

1) The distribution period shall cover the teaching days of the school year 2015/2016.

2) Undertakings may not be transferred to upcoming year or used retroactive.

3) The school shall hang a billboard on the main entrance or use an Internet banner on its website, which illuves that school is involved in the scheme. The Wildlife Board shall place the placate and the banner at its disposal.

4) The applicant shall ensure that the application for grants and its original accounting documents are kept available for at least five years from the date of payment of grants.

5) Appeal shall be subject to the application of an accompanying measure, for example as listed in Annex 1, cf. Regulation 288/2009, Article 5.

6) Applying if the project or part thereof is covered by the EU procurement rules or the rules of the contract law, keep records to ensure that the EU procurement rules or tenderer's rules have been complied with, available for at least five years from the date of closing date ; down payment.

§ 9. No provision shall be granted to products excluded from Regulation 1308/2013, cf. Regulation 1308/2013 Article 23 (1). 3.

§ 10. The eligible expenditure may not include expenditure to which other European Union aid has been received.

Chapter 6

Payment of grants

§ 11. The payment of grants is conditional on the following conditions :

1) All applied expenditure for the fruit and vegetable fruit of the year's fruit and vegetable sector have been kept and documenting.

2) The conditions laid down in sections 8 and 9 are fulfilled.

Paragraph 2. The payment of grants shall be made on the basis of the account of the attribution of the subsidy to the eligible expenses incurred. The payment of grants must be submitted in a special scheme and shall be accompanied by evidence of the quantities actually delivered. Schema for payment request is available on the Home page of the Natural Business Business Page.

§ 12. However, the maximum allocation of grants for distribution is 75% of the cost of the expenditure :

1) $2.00. per pupil per. the educational day of organic fruit and vegetables ; and

2) $1.25. per pupil per. the daily learning day of conventional fruit and vegetables.

Paragraph 2. If they deliver the products at no charge to the school, they may in section 4 (4). 1, no. 2-4, referred to in paragraph 1 shall apply for the holders referred to in paragraph 1. 1 the maximum amounts per pupil per. Education day.

Paragraph 3. The maximum amount of aid for accompanying measures is 75% of actual expenditure, but the subsidy may not amount to more than 15% of the pledged pledges to be used.

Paragraph 4. The amount of the subsidy may not exceed the last approved consent.

Paragraph 5. Supplements are not provided for VAT.

Paragraph 6. The payment of grants shall be made to the application for NemKonto.

§ 13. The Office of the Natural Safety Agency may require the accuracy of information to be used for the payment of grants, certified by the municipal auditor or by registered auditor.

Chapter 7

Changes and obligation to provide information

§ 14. Changes made to the application after the defendant is given may be approved by the Conservation Board on condition that the change in accordance with the provisions of the Natural Business Management Board may be approved in accordance with the aim of the scheme and within the scheme as determined in : European Union acts. The request for an amendment to an application shall be approved by the Natural Acquire Management Board before the change is initiated.

§ 15. The Presentas shall be obliged without undue delay to grant to the Natural Business Authority the conditions which may result in the disbursement of the whole or part of the subsidy, and therefore not to be paid or which will result in : the aid already paid out must be repaid. Paragraph 2. Anyone who has received an undertaking pursuant to this notice shall be obliged to notify to the Natural Business Authority if they are aware that they will not be able to make full use of the plaintianal. Chapter 8

Disposal and repayment or reduction of grants

§ 16. The Office of the Natural Acquisius Management Board may decide on the lapse of pledges and withdrawal of grants, if :

1) the applicant has given inaccurate or misleading information or information of significance for the decision of the case,

2) the applicant shall not provide the necessary guidance and assistance in carrying out the checks provided for in Chapter 3, fails to ensure that the schools contribute to the necessary guidance and assistance in carrying out the checks provided for in Chapter 3, or omits to supply accounts, payment certificates, etc., which are necessary for the implementation of the checks,

3) the notification obligation has not been met, cf. ~ § 14 and 15, or

4) the conditions for grants have not been met, cf. ~ 8, 9 and 10. ~

Paragraph 2. Notwithstanding paragraph 1 1, of course, the National Services Agency may maintain the charge or make a proportional reduction of the total value of eligible expenditure if the EU procurement rules or the rules of the tender have not been complied with.

Chapter 9

Appeal access

§ 17. Decisions taken by the Natural Business Authority may be subject to appeal to the Ministry of Appeal for the Ministry of Health.

Paragraph 2. The complaint shall be written and submitted by the Office of the Natural Acquirea Management Board.

Paragraph 3. The time limit shall be four weeks for decisions taken pursuant to this notice.

Paragraph 4. Within six months of the decision, the Committee of the Ministry of Health may not exceed the limit of the time limit when the overrun of particular grounds is excruciatable.

Paragraph 5. The National Services Agency may resume a case after a complaint has been lodged.

Paragraph 6. Decisions taken by the Ministry of Appeal for complaints in complaints may not be brought to the second administrative authority.

Chapter 10

Entry into force

§ 18. The announcement will enter into force on the eighth. May 2015.

Paragraph 2. Publication no. 522 of 26. May 2014 on the school fruit scheme is lifted. However, the decision shall continue to apply to undertakings notified pursuant to this and to payment applications submitted but are not yet completed.
