Annunciation of measures to maintain the security of electricity supply

In accordance with section 27 d (1), 2, in the light of the electricity supply, cf. Law Order no. 1329 of 25. November 2013, as authorised pursuant to section 4 (4), 1, in the notice. 436 of 11. May 2012 on the tasks and powers of the Energy Management :

Scope of application

§ 1. The commotion shall include the measures to be taken by Energinet.dk according to Article 27 d (1) of the Energy Management Board. 2 and 3, in the field of power supply.

Measures and authorization

§ 2. Energinet.dk may, according to the approval of the Energy Management Board, implement necessary measures, including the purchase of strategic reserves, if these measures are considered necessary to maintain sufficient security of energy.

Paragraph 2. For the purpose of strategic reserves, the following shall be understood as follows :

1) Electrical capacity, as Energinet.dk can enter the electricity markets, in situations where there is no balance between the quantity of electricity offered in the market and the quantity of the demand.

2) Agreements on reduction or cutting off users ' electricity consumption, as in those in paragraph 1. 1 situations of this type can be activated.

Form and content of the application

§ 3. Energinet.dk's application for section 2 (2). 1, shall be written and accompanied by a number of information, cf. paragraph 2.

Paragraph 2. The people in paragraph 3. Paragraph 1 shall include at least the following :

1) An inventory of the security of electricity supply in the short and longer term.

2) Information which documents the application of the necessary measures for the maintenance of an adequate security of supply. Alternative solutions must be included and shed light.

3) Information on why the security of the electricity supply security is not sufficiently secured by already or planned for a reserve capacity.

4) Information on why the applications submitted are a priority over other measures.

5) Information on how often and how long the application measures are expected to be applied.

6) Information on how and to what extent it is ensured that the applied measures will operate in the best possible way with the electricity market, including, in particular, the market.

7) A statement of the costs expected to be associated with the application of the measures applied. Such a statement would be confidential for the sake of a future tender process.

8) Other societal and competitive effects of the application of the measures applied.

Paragraph 3. The Energy Management Board may ask Energinet.dk for more information than those referred to in paragraph 1. Two mentioned. The Energy Management Board may, in addition, make requirements in such a way as to ensure the security of electricity supply after paragraph 2, no. One, do it.

Paragraph 4. The application shall be the Agency for Energy Management at the latest six months before the application of the measures to be carried out by Energinet.dk.

Permission of energy management

§ 4. The implementation of measures in accordance with section 2 (2). 1, may be subject to authorization by the Energy Management Board.

Paragraph 2. The Energy Management Board may provide terms in a permit in accordance with paragraph 1. 1. Such terms may include requirements concerning :

1) the implementation of measures must be carried out in accordance with the procedure for offering or other transparent and non-discriminatory procedures ;

2) the application of the measures applied shall have a time-limited duration ;

3) the application of the measures applied for as far as possible must be technologinutral and does not strengthen the dominant position of a dry market in such a way as to restrict the negative impact of competition to the maximum possible level ;

4) measures are kept within the estimated expenditure framework, as set out in the framework of the expenditure framework. Section 3, paragraph 3. 2, no. 7,

5) the measures to be notified or to the State aid shall be notified by the Commission, not to be implemented before the approval or approval of the European Commission is available,

6) Energinet.dk yearly shall inform the Agency for the Agency of the measures which have been granted for authorisation following this notice, and circumstances relating to such measures, and

7) Energinet.dk per annual shall inform the Energy Management Board of the expenditure incurred by the implementation of measures after this notice has been published.

Entry into force

§ 5. The announcement will enter into force on the 12th. December 2014.
