Publication of syringe of sprayed equipment 1)

In accordance with section 7 (2), 1, no. 1, 2, 5 and 8, section 7 a, section 67, section 80, section 88 (2), 1 and 2, and section 110 (1). 3 in the law of environmental protection, cf. Law Order no. 879 of 26. June 2010, as amended by law no. 446 of 23. May 2012 and law no. 1149 of 11. December 2012, and section 46, section 72, paragraph. 1, no. 4 and section 74 of the Work Environment Act, cf.. Law Order no. Seventy-seven of seven. September 2010, as amended by law no. 597 of 14. June 2011, lov nr. 155 of 20. February, 2013 and Law No. 356 of 9. April 2013, and under the authority vested in me by virtue of the notice. 1076 of 25. November 2011 on missions to the Environmental Management Board of Tasks in accordance with the Law on the periodic functional control of pesticide applications in accordance with Directive 2009 /128/EC of the European Parliament and of the Council, shall be :

Chapter 1

Objections and definitions

§ 1. This notice lays down rules on the regular inspection of pesticide equipment (pesticide equipment), cf. § 2.

§ 2. The announcement shall be made with the derogations provided for in paragraph 1. 2, use of pestis in professional use, cf. § 3, nr. 4 and 5.

Paragraph 2. The following syringes are not covered by the notice :

1) Hand-held syringes with a tank with a capacity of 25 litres or less.

2) Spray that is designed to be carried on the back.

3) Forest machinery on which pesticide pesticide is fitted.

4) Machines disseminating plant protection products and, where appropriate, fertilisers in the form of granules.

§ 3. For the purposes of this notice :

1) Usage view : Showing for the right use of syringes, benefits tables and other materials, as the manufacturer of the syringe, to ensure the correct use of the syringe, including environmental optimal use, made available to the operator of the syringe.

2) " Syn : Review of a syringe, as described in the Environmental Management Board's guidance on syringes, in order to ensure that it complies with the requirements of section 5 and Annex 1.

3) Pesticide : A plant protection product as defined in the Act on chemicals, section 33, 1. Act.

4) Professional use : use of syringe equipment of any person who uses pesticides in the context of its business activities, including sprayers, technicians, employers and self-employed in the agricultural sector and other sectors.

5) Spray equipment : any appliance specifically intended for the application of pesticides, with the accessories necessary for the effective operation of the appliance, e.g., dyes, manometers, filters, and aims and equipment for cleaning the tanks.

6) Horizontal beam (ardusy-sprayed) : syringe used for the application of pesticides along a bom or on tape generating a syringe that is generally corrected downwards.

7) Vertical bombers, air-proof syringes and similar : syringe to the delivery of pesticides on bushes and trees to which fruit trees are made, where the application is mainly carried out on the sides and / or up.

8) Pinning and semi-mobile syringes : fixed syringes are syringes which are mainly used in plant production in flux-use and where the pumping / tank and / or bom or other device with dyes has been fixated. Semi-mobile syringes are injections that are mainly used in plant production in flux-use, and where the pump / tank and bom or other device with dyes are moving.

9) Sync report : The synth report corresponds to the certificate referred to in Directive 2009 /128/EC of the European Parliament and of the Council. 8 and documents the extent to which a syringe complies with the requirements of section 5 and Annex 1 of this notice. The visual report shall indicate, inter alia, the identity of the syringe-owner, identification information for the syringe in the form of the serial number, the sprayed type, the time of monitoring and whether the syringe has been approved for inspection or not.

10) Marker : the sticker of the environmental management label with the identification number and the time limit for the next statutory inspection.

11) The owner of the spraying equipment : Excludes in this notice also the owner or tenant of an agricultural holding which uses or uses borrowed or leased equipment in his holding.

12) Test unit : Business with entity that has a GEP acknowledgement. GEP is an abbreviation for 'Good Experimental Practice', following practice in accordance with the provisions of the Europe-Mediterranean Plant Protection Organization (EPPO), Guideline 181 and 152.

Chapter 2

Deadlines, etc. for syringes of syringes

§ 4. The owner of the sprayed equipment is responsible for the use of equipment for professional production of pesticides only by means of spraying equipment approved in view of the following time limits and in accordance with the rules laid down in this notice.

Paragraph 2. All syringe equipment that has been purchased for or have been applied to a company or a municipality prior to the 26th. November, 2016, may not be used after the 26th. November 2016, unless it has been approved for surveys, cf. however, paragraph 1 3 for new spraying equipment.

Paragraph 3. Spray gear, bought as new equipment after 31. December 2013, review shall be reviewed and approved by five years after the acquisition and then at least every 3. Year to continue to be used.

Paragraph 4. Spray equipment, cf. § 3, nr. 6 and 7 that have been purchased for or have been applied to a company or municipality whose CVR number ends on 0, 1 or 2, ahead of 26. Paragraph 5. Spray equipment, cf. § 3, nr. 6 and 7 for or have been applied to an establishment or a municipality whose CVR number ends on 3, 4, 5 or 6, ahead of the 26. November 2015 must appear before 26. In November 2015, unless the syringe is scheduled to be taken out of use prior to the 26th. November 2016.

Paragraph 6. Spray equipment, cf. § 3, nr. 6 and 7 purchased for or have been applied to an establishment or a municipality whose CVR number ends on 7, 8 or 9, ahead of the 26. November 2016 must appear before 26. November 2016, unless the syringe is scheduled to be taken out of service before this time.

Paragraph 7. Spray equipment in the form of fast-mounted and semi-mobile syringes, cf. § 3, nr. 8 which has been purchased for or have been applied to an establishment or a municipality prior to the 26. November 2016 must appear before 26. November 2016, unless the syringe is scheduled to be taken out of service before this time.

Paragraph 8. The syringe equipment is up until 1. The year of January 2020 shall be reviewed and approved at the latest five years after the first sight, cf. paragraph 4-7, and then at least every 3. Year to continue to be used.

Niner. 9. The EPA shall recognize the surveys of syringes carried out in other EEA countries or in third countries with which the EU has concluded agreement with regard to the guidelines laid down in Directive 2009 /128/EC and can be documented in the display of the Commission ; certificate or similar.

Paragraph 10. Used spraying equipment purchased after the 31. In December 2013, from other EEA countries or from third countries with which the European Union has concluded agreement on this subject, it is up to 1. § 5. The owner of the syringe equipment shall also carry out or have regular calibration and technical checks carried out in accordance with. paragraph 2, of syringe equipment.

Paragraph 2. Spray equipment must at any time be in such a state that it can :

1) Make up and be emptied, easily and completely unleashed by pesticides,

2) pursed easily, but thoroughly,

3) handled safely,

4) ensure precise dosing and delivery,

5) be checked and stopped immediately from the seat driver's seat and,

6) adapted to single, accurate and reproducible.

Chapter 3

Approval as a caretaker

§ 6. Syn of syringe equipment must be carried out by a company approved by the Environmental Management Board.

§ 7. The Danish Environmental Management Board shall approve the caretaker ' s application in accordance with the instructions given by the Board of Directions of the Management Board.

Paragraph 2. Applications for the approval of a company must be submitted on a separate scheme which can be found on the website of the Environment Board. After completion of the schema, the applicant shall send this to the Environmental Management Board.

Paragraph 3. The application shall include, inter alia, the name, address, telephone number, registration number, company registration number, company form, and addresses of all your company's visual address (P-numbers), cf. the instructions of the application.

Paragraph 4. The application shall be accompanied by evidence that the undertaking shall include at least one person with the training required, cf. § 8.

Paragraph 5. The application must be further attached to a list of the required equipment, cf. Annex 2, which the undertaking is in possession of or has access to.

Paragraph 6. The IT communication equipment must be in possession of IT communications equipment that enables the use of IT systems and equipment to enable electronic archiving and electronic transmission of vision reports, etc.

Paragraph 7. The syncing must have a valid liability insurance that covers the syringe of syringes.

§ 8. Entities performing survey must have at least one member of the training as a mechanical engineer, blacksmith, agricultural engineer mechanic, mechanic, or with other relevant training for the type of syringes, or with a proven practical experience experience, which enables the person concerned to assess the technical condition of the syringe and their ability to produce pesticides in accordance with the instructions for the syringe concerned.

Paragraph 2. A caretaker must, with the derogations provided for in paragraph 1. 3-5, do not perform syringes for a company belonging to the same legal entity as the custodian, cf. the definition of legal entity in the Central Business Register.

Paragraph 3. Companies which negotiate new or used injections can take care of these syringes.

Paragraph 4. Companies with a significant number of syringes, such as gardeners and nurseries, can seek approval as a custodian, cf. § 7, also for your own spraying equipment.

Paragraph 5. The defence can obtain approval as a caretaker of its own equipment.

Paragraph 6. In specific cases, a test unit may be approved by the EPA as a caretaker of its own pestis.

§ 9. All persons who carry out spraying equipment must have undergone a course in the implementation of syringe of spray equipment. In so doing, the persons acquire the right to carry out a view of the categories of syringes, in accordance with the categories of syringes, cf. Section 3, paragraph 3. Six, seven and eight.

Paragraph 2. In the course of the course of the year, the following course gives the person the right to inject the syringe of a caretaker for a period of five years. However, the Committee on the Environment may, in this period, convene a compulsory follow-up course, such as, for example, if new standards have been set for the syringe of the syringes which are taught to be taught to be trained in the training staff.

Paragraph 3. A course for syringes of syringes must include the subjects set out in Annex 3.

Paragraph 4. Bid courses must be approved by the Environmental Management Board.

Case examination of the application

§ 10. The EPA shall examine applications for approval as soon as possible.

Paragraph 2. The Environmental Management Board shall take a decision within three months of receipt of a fully substantiated application. The reasons for the decision shall be communicated to the applicant.

Paragraph 3. The period of time may be extended by one month, if the complexity of the case justifies it. The Environmental Management Board shall justify its extension and its duration and shall notify the applicant before the end of the time limit laid down in paragraph 1. 2.

Paragraph 4. Although the EPA has not notified the applicant the decision before the expiry of the time limits laid down in paragraph 1. In the case of 2 or 3, the application shall not be deemed to be granted.

Paragraph 5. refusal of application for approval or a failure to decide on the approval of the time provided for in the period laid down may not be lodged with the second administrative authority.

§ 11. Within one month after the Environmental Management Board has received an application for approval, the Management Board shall send an acknowledgment to the applicant. The Management Board shall at the same time provide the applicant for any missing documents.

Declamation and revocation

§ 12. Approval as a caretaker may be refused or revoked if :

1) the establishment or owner of the undertaking is or is convicted of a criminal offence which undergoes a near-risk of misuse of access to the pursuit of the sight of the company ;

2) the establishment or owner of the establishment has shown that there is reason to assume that the company will not be driven safely, or

3) the establishment does not comply with the requirements in order to be approved as a caretaker.

Paragraph 2. The Environmental Management Board may obtain information from public authorities and request information from the company to assess whether there is a basis for granting or revoking an approval.

Enlightenment to customers

§ 13. Syncing business must inform their customers of :

1) to complain of decisions of the caretaker ' s decisions may be made for the Environmental Management Board and its address, including e-mail address, and

2) inter-branch organizations or similar cases, such as those who are members.

Paragraph 2. If a customer asks for it, the caretaker must inform you of the legislation relating to the equipment for spraying equipment and how you might be familiar with this.

Paragraph 3. The information must be made available before an agreement on surveys shall be concluded or, if no contract is concluded before the delivery of the service. The company itself determines how and in what form the information is given.

Chapter 4

Southern syringes in Denmark, carried out by foreign careers

§ 14. A foreign company wishing to establish itself as a company in Denmark must comply with the rules in Chapter 3, unless there is a temporary or occasional view of the company, cf. § 15.

Non-Persistent and occasional provision of certain services

Notification

§ 15. The first time a company legally established as a caretaker of other EEA countries or in third countries with which the EU has concluded agreement on access to the practice of regulated professions, in the event of a temporary and occasional undertaking to exercise a supervisory role in the Community ; Denmark shall, in writing, report this to the Environmental Management Board in writing.

Paragraph 2. The notification shall follow :

1) The documentation of the company ' s nationality.

2) Attest from the competent authority of the home Member State that the establishment is legally established in one of the provisions referred to in paragraph 1. 1 countries mentioned that it carries out activities carried out in accordance with Directive 2009 /128/EC of the European Parliament and of the Council. 8 and that, at the time of the issuing of the attestation, the undertaking shall not be prohibited by carrying out this undertaking, nor shall it be temporarily.

3) Documentation that employees in the company possess relevant professional qualifications for the execution of syringe equipment.

Paragraph 3. The notification shall be renewed once a year, and renewal is subject to continuous compliance with the requirements.

Paragraph 4. The company shall use the IT system for the EcoManagement System for syringes when filling out vision reports which are accessed via "BusinessInDenmark" on the home page, and access to it by the Environmental Management Board after the Management Board has verified that information ; which has been submitted by the undertaking in connection with the notification.

Information from service providers who provide temporary and occasional services in Denmark

§ 16. Undertakings legally established as a custodiant in other EEA countries or in third countries concluded by the European Union in terms of access to the practice of regulated professions and, as a temporary and occasional undertaking, in Denmark, shall : in addition to the information referred to in Article 13, inform their customers of :

1) the name and address of the public register of the home Member State to which the person concerned is admitted and the identification number of the person concerned or the corresponding identification in this register,

2) name and address of the competent authority of the home Member State and

3) the registration number if the person concerned is operating in the establishment country.

Chapter 5

Syn of syringe equipment

§ 17. Before spraying equipment, this must be cleaned in accordance with the instructions for spraying equipment and the notice of filling and washing, etc., of syringes for the application of plant protection products. A caretaker may refuse to carry out a syringe if it is considered not to be sufficiently cleaned.

Paragraph 2. The syringe of syringes can happen either inside or out of the outside. If it is done by indoors, the syringe of the syringe must be carried out in a room with no drainas and where there is a collection of all liquids used in the guidelines according to the guidelines specified in the instructions for this notice. Alternatively, the viewing company must ensure the collection of all liquids used in the light of the guidelines specified in the guidelines for this notice.

Paragraph 3. In the light of the syringe, the conditions referred to in Annex 1 shall be examined and assessed in accordance with the guidance given by the Environmental Management Board and all test and visual results shall be included in the visual inspection report. Errors and deficiencies repaired by the supervising establishment immediately before or in the field of sight shall also be mentioned in the visual report.

Paragraph 4. Where the spraying equipment is brought to the front of the owner's own matrix, the syringe equipment must be filled with sufficient water to carry out the sight. The water must be collected, fill the sprayed equipment and be taken home with this.

Paragraph 5. The synth report must be downloaded from and completed in the Environmental Management System for syringes, and all test and visual findings are replaced by the EPA and are entered in the context of the implementation of the vision. Cannot on-line connection not be achieved, any entry that is carried out-line or written in writing within 20 days of complete vision must be synchronized with the Environment Management System.

§ 18. After completion of the vision, the vision company signs the visual report, cf. § 17, paragraph 1. 5, and provide this to the syringe owner. If the syringe complies with the requirements of section 5 and Annex 1, the oversight shall be marked by a noticerate on the syringe. The label and view report shall indicate the deadline for the next vision.

Paragraph 2. The syringe owner shall retain and, on request, be able to provide the visual inspection report and the syringe for the supervisory authority or the supervisory authority, or the supervisory authority, must have authorised to assist with the supervision, forward until the next sight.

Paragraph 3. If the syringe cannot be approved, cf. paragraph 1, the visual report shall indicate the defects in which the syringe has been kept and which must be remedied before the injection is approved.

Chapter 6

Agencies, inspection, fee and complaint

§ 19. Paragraph 2. Paragraph 3. The environmental management board may change a vision of a syringe if the sight of the fault has been caused by the wrong outcome.

Paragraph 4. The Committee on the Environment, Public Health and Consumer Protection shall ensure that only syringes which have been subjected to inspection as specified in Section 4 are used for the application of pesticides and to carry out a regular calibration and technical inspection of syringe equipment as specified in section 5 (5). 1. The Office of Natural Acquisito, however, is in charge of soil use.

Paragraph 5. Grounders in paragraph 1. 4 means the agricultural holdings covered by SKAT's use code 05 (Agriculture, Built), 06 (separately rated forest and plantation), 07 (fruit plantation, gardenneri and nursery), 17 (unbuilt agricultural pariezers, etc.), or 01 (inhabitable), or 01 (inhabitable), in the case of buildings with the nature of agriculture or gardenneri.

20. A fee per injection shall be paid per syringe approved for inspection. This fee shall cover the costs incurred by the management of the Environment Board upon administration and supervision following the notice. The fee shall be paid in the context of the inspection by the company from the Environment Management System for syringes of syringes.

Paragraph 2. The fee is at DKK 306.00. The fee shall be adjusted annually per year. 1. On the basis of the most recent published price and salary index in the Finance-Administrative Guidance from the Ministry of Finance. The current fee rate shall be published on the website of the Environment Management website : www.mst.dk. The next regulation will take place on 1. January 2016.

Paragraph 3. Pavement of the fee pursuant to paragraph 1 Not in due time, interest shall be paid in accordance with the rules of section 88 (1). TWO, TWO. and 3. pkton, in the law of environmental protection.

Paragraph 4. The fees have been added to the panting.

§ 21. The owner of the syringe and the caretaker shall make available to the authorities or persons the competent authority of the authorities or persons authorized by the competent authority in the context of their duties following the notice.

§ 22. The Environmental Management Board may, in exceptional cases, dispense with the rules of the notice.

-23. Decisions taken by the caretaker companies may be brought to the EPA.

Paragraph 2. The time limit shall be four weeks from the date on which the decision was issued.

Paragraph 3. A decision shall be made, irrespective of the fact that the decision has been lodged.

Paragraph 4. The decisions of the environmental management and of the Natural Acquilices shall not be made for the second administrative authority following the notice.

Chapter 7

Punishment

§ 24. Unless higher penalties have been inflished on any other law, penalty shall be punished

1) the pesticide which uses or is used to inject an injectable syringe to the application of pesticides, cf. § 4,

2) the operator of the sprayed equipment which does not comply with the rules laid down in section 5 (5). 2 or

3) the one issuing a certificate of approval for a specific spraying equipment without the equipment complying with the rules in the notice, cf. § 18.

Paragraph 2. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

Paragraph 3. The sentence may rise to prison for two years if the infringement has been committed intentionally or by gross negligence and if there is a breach of the infringement proceedings ;

1) damage to human or animal life or animal health or, therefore, hazard,

2) damage to the environment or caused by danger, or

3) obtained or intended to be economically advancuable, including in the case of savings, for the person concerned or others.

Chapter 8

Entry into force

§ 25. The announcement shall enter into force on 1. January 2015.

Paragraph 2. Publication no. 1536 of 13. December 2013 on the overhaul of the sprayed equipment shall be repealed.

Appendix 1

Requirements for a syringe

The following points must always be reviewed by the syringe of syringes pursuant to Directive 2009 /128/EC, and it is necessary to check that the spraying equipment meets the description below all points. The vision is based on the guidance of the Environmental Management Board on the syringe of syringes.

The guidance is largely based on Standards DS/EN 13790-1 and DS/EN 13790-2 and will, where necessary, be continuously updated as it is issued by other CEN standards for the syringe of syringes.

In the case of a syringe, the operator shall pay particular attention to the fact that the syringe meets the requirements of this Annex.

1) Requirement parts

For the protection of the operator, the forecasting of a power supply and power roof must be installed and in good condition, and protective equipment. Motive and rotating power transfer parts must be able to operate unhindered.

2) Pumping

The pump needs to be close. Pumping capacity must be adapted to the equipment and the pump shall operate properly to ensure stable and sound injection speed.

3) Repiping

Diflation devices must ensure good circulation, so that a steady concentration is achieved in all the syringe in the tank.

4) Tank for spray-fluid.

tanks for spraying, including indicator of tank content, filling equipment, sirens and filters, cleaning and purification devices and intermix equipment must operate in a manner that minimizes discharges, unbalanced concentration distribution, exposure of the the operator and residues of syringes.

5) Systems and control systems and regulatory systems

All devices for measuring, opening and closing, and setting the pressure or service must be properly calibrated and operating properly and be without incarpeas. It must be easy to regulate the pressure and handle the pressure-setting devices when spraying. The pressure-setting devices must maintain a constant work pressure at constant pumpeat-speed for the safety of steady spraying.

6) Touch and serpen

Stirs and serpents must be in good order, so interference in the flow of liquid or spillage caused by leaks is avoided. There must be no leakage from pipes or serpents when the system is powered by the highest possible pressure.

7) Filtering

In order to avoid any turbulence and unequations in the column, filters must be in good condition and the size of the filters shall correspond to the size of the dyes mounted on the syringe. If a system for setting the filter log is provided, it shall function properly.

8) Inject bom (equipment where spraying takes place by means of a horizontal bom that is placed in close range from the crop or the material to be processed).

The syringe must be in good condition and steady in every direction. The fastening and adjustment systems and devices for oscillation and inclination compensation shall function properly.

9) Dedices

Dyses must function properly, so that the dripping does not occur when the spraying is set. In order to ensure an evenly split image, the performance of the individual diver must not significantly differ from the information supplied by the manufacturer supplied benefits tables.

10) Liquid distribution

The syringe must be distributed evenly in the target area. The level of balance must be ensured both for the sides and the ospired (by the treatment of highly-growing crops).

11) Air shall be disinterested in equipment where the spraying liquid is spread by air

The blower must be in good condition and must ensure a stable and reliable air flow.


Appendix 2

Equipment requirements for vision companies

A company must, prior to the establishment of surveys, be in possession of or have access to the following equipment :

1. In the regular place of vision, a suitable room without drainas and the possibility of fluid, used at the sight, or in a place that satisfies the requirements for the construction and operation of detergents for pesticide delivery equipment, cf. the notice of filling and washing etc. of syringes for the application of plant protection products.

2. A sprayer (or similar equipment) or a hand-held scanner (electronic sanizer test).

3. Ordinary tool and measuring tool, including the flow gauge and manometer.

4. IT communication equipment and Internet connection.

5. Collection-basket and pumpegear (where the situation stresses it).


Appendix 3

Course in syringe of syringes

A test equipment class shall be carried out as a labour market training that must have a duration of at least 20 hours and include the following topics :

1. The legislation and its guidelines on syringes and sprayed inspections.

2. Requirements for the test site and test equipment.

3. The structure and operation of the various syringes.

4. Calibrating the various syringes.
