The full text of the Ordinance amending the Ordinance on health consultancy contracts for cattle herds

§ 1

In executive order No. 177 of 26. February 2014 on health consultancy contracts for cattle herds shall be amended as follows: 1. The introductory part shall be replaced by the following:

» Pursuant to section 8 (b), article 11, paragraphs 1, 3 and 4, § 12, paragraphs 3 and 4, article 13, paragraph 2, section 15 and section 38, paragraph 4, of the law on veterinary surgeons without prejudice. lovbekendtgørelse nr. 464 of 15. may 2014, and section 34 (a), paragraphs 1-3, section 47, paragraph 1, section 51, section 61 (1), section 66 (a) (1) and (2) and section 70, paragraph 3, of the law on the keeping of animals, see. lovbekendtgørelse nr. 466 of 15. may 2014, be determined in accordance with the authorisation pursuant to bekendtgørelse nr. 558 of 28. may 2014 about food administration tasks and powers: ' 2. paragraph 4 is replaced by the following: ' article 4. A health advisory agreement may only include one CHR-number, see. However, paragraph 2.

(2). There can be one comprehensive agreement on health advice for bovine holdings, which have been granted exemption to interoperability, see. Decree on the marking, registration and movement of cattle, pigs, sheep or goats, when the following conditions are met: 1) All bovine animals subject to the interaction is recorded on one of samdriftens CHR-numbers.

2) the person responsible for the treatment performs at the opening records of medical treatments in the herd by electronic transmission to Animal registration.

3) the person in charge of the crew have notified the crew veterinarian and information centre for agriculture, cattle, to the use of medicinal products is desired registered in Animal registration.

4) Crew to report to Animal veterinarian registration of medicinal products prescribed and supplied within 2 days.

5) the person in charge of the crew has informed the Centre of excellence for agriculture, cattle, to the reported information must be available to the crew and for the vet inspection authority for at least 5 years.

(3). A health advisory agreement includes all cattle on CHR-number.

(4). Food agency may request, in exceptional cases, grant exemption from the requirement referred to in paragraph 3. A derogation may be made subject to specified conditions.

(5). Food agency may revoke a waiver granted pursuant to paragraphs 4 through gross or repeated violation of the terms or the rules about health advice. '

3. section 8 shall be replaced by the following: ' article 8. An agreement on health advice, see. sections 5 and 6, shall be concluded in written form for the purposes of the contract, which is reprinted as annex 1 to the Decree.

(2). If there is entered into one comprehensive agreement on health advice for more CHR-numbers, see. section 4, paragraph 2, all the included CHR-numbers appear on the contract.

(3). Crew veterinarian shall within 8 days after the conclusion of the agreement make reporting about this at www.vetreg.dk. Reporting of one comprehensive agreement on health advice, see. section 4, paragraph 2, shall be made on the CHR-number, where the animals are registered in CHR.

(4). Crew veterinarian shall retain the agreement reached and the person responsible for the herd shall retain copy thereof. The documents must be kept for the whole period of validity of the agreement and until 1 year after termination of the agreement. Documents must be presented on request immediately and handed over to the supervisory authority. '

4. In article 16, paragraph 1, shall be deleted: ', see. However, paragraphs 2 and 3. ' and replaced by: ' without prejudice to article. However, paragraph 2-4. '

5. In article 16 paragraph 4 is added: ' (4). Crews, of which concluded one comprehensive health advisory agreement, see. section 4, paragraph 2, should be placed in category: 1) tightened up the advice, if one or more of the crews affected by the overall health advisory agreement were placed in this category, see. § 13, prior to the conclusion of the overall health advisory agreement, or 2) extra advice if one or more of the crews affected by the overall health advisory agreement were placed in this category, see. § 14, prior to the conclusion of the overall health advisory agreement, see. However, no. 1.«

6. In article 66, paragraph 1, shall be inserted after ' violating ': ' section 4, paragraphs 1 to 3, «, and» § 4 (1) and 2.0 ' shall be deleted.

7. In article 66, paragraph 2, shall be inserted after ' in accordance with ': ' section 4 (4) ', and ' § 4, paragraph 3.0 ' shall be deleted.

8. Annex 1 is replaced by the text in annex 1 to this notice.
