Completion of Health Consultation Agreements for pig herds

In accordance with section 8 b, section 11, paragraph 1. 1, 3 and 4, section 12 (2). 3 and 4, section 15 and section 38 (3). 4, in the Law on veterinarians, cf. Law Order no. 875 of 29. June 2013, and paragraph 34 a, paragraph 1. 1-3, section 47, paragraph. 1, Section 51, section 61 (1). Paragraph 70 (1) and 70 (1). 3, in the law on animals of animals, cf. Law Order no. 873 of 29. June 2013, shall be determined :

Chapter 1

Scope and definitions

§ 1. This notice shall apply to health advice in pig herds, cf. Section 14, paragraph 14. 1 and 2, in the animal law.

§ 2. For the purposes of this notice :

1) Mandatory Health Advisory Agreement : The responsibility of the crew responsible for concluding health advice for a pig herd whose size exceeds one or more of the threshold values laid down in the notice.

2) Voluntary health care consulting agreement means that the person responsible for the crew can agree on health advice for a pig herd whose size does not exceed one or more of the threshold values laid down in the notice.

3) Crew : The pig or pig crew registered on a CHR number.

4) veterinarian : veterinarian with whom the crew responsible for the crew has reached agreement on health advice, cf. § 34 a (3) (a) 1-3, in the law of the team of animals.

5) ' Extreme ' means the veterinarian who, in agreement with and reporting from the crew veterinarian, carries out his obligations under the health advisory agreement in the event of the maternity or medical or other long-term absence of the marketing doctor in the case of the animal health care service.

6) Audit : The systematic and documented process whereby the crew veterinarian reviews the self-control programme of the crew responsible, including the documentation of the execution of the self-control, as well as actions in relation to what is described in : the self-control program.

7) Trade Consultant : A consultant with natural scientifis or agricultural training.

8) Stable school : A group of 5-8 herds in category General advice with the basic health advice.

9) Disease diagnosis : Diagnosis of a disease that occurs on a regular basis in the crew and characterized by the symptoms described by the veterinarian.

Chapter 2

Conclusion and termination of agreement

§ 3. A health advisory agreement shall be concluded between the crew responsible for the crew and a veterinarian.

§ 4. A health advisory agreement can only include one CHR number.

Paragraph 2. A health advisory agreement includes all the pigs on the CHR number.

Paragraph 3. In particular, the FDA may grant a derogation from the requirement referred to in paragraph 1 in specific cases. 2. Dispensation may be made subject to specified conditions.

Paragraph 4. The Food Authority may withdraw a derogation on a serious or repeated infringement of the conditions or rules on health advice.

§ 5. The crew responsible for the crew shall enter into the compulsory health advice agreement if the number of pigs on the CHR number (on stable or external) per person. 31. In the preceding year, greater than or equal to one or more of the following threshold values are :

1) 300 lakes, guilders or orns,

2) 3 000 slaughtering wines (30 kilograms-butchery), or

3) 6,000 piglets (7-30 kg).

Paragraph 2. In particular, the FDA may, in exceptional cases, grant a derogation from the requirement for compulsory health advice in the cases referred to in paragraph 1. 1, no. 2 and 3 if there are no pigs on the CHR number in a consecutive period of not less than 3 months. Dispensation may be made subject to the conditions specified.

§ 6. The crew responsible for the crew may enter into agreement on optional health advice if the number of pigs on the CHR number is less than the threshold values referred to in section 5 (5). 1.

§ 7. If the crew responsible for the crew is agreed on optional health advice, cf. Section 6, shall carry out own checks on animal welfare in accordance with the Ministry of Justice ' s publication on own control of animal welfare.

§ 8. An agreement on health advice, cf. sections 5 and 6 shall be entered into in writing by the use of the contract listed in Annex 1 to the notice.

Paragraph 2. The official veterinarian must be submitted within eight days of the conclusion of the Agreement to this effect at www.vetreg.dk.

Paragraph 3. The official veterinarian must keep the agreement reached and the crew responsible for the crew shall keep a copy of the contract. The documents must be kept for the duration of the agreement and up to a year after termination of the agreement. The documents must be available on request immediately for and be handed over to the inspection authority.

§ 9. A health consultation agreement may be terminated by each of the parties on a month's notice.

Paragraph 2. The official veterinarian must, within eight days of termination of the Agreement, make a report on this subject at www.vetreg.dk.

§ 10. If an agreement on the compulsory health advice is terminated, the crew responsible shall conclude a new agreement with a different veterinarian. The new agreement shall apply from the date of termination of the previous agreement.

§ 11. An agreement on health advice is automatically lifted when the crew is reported as being reported in CHR.

Placement of advice in counselling categories

§ 12. When the first time an agreement on health advice for a crew after this notice is concluded, the crew shall be placed in category Extra consulting, cf. however, Section 17.

§ 13. The Food Management Board shall take a decision that a crew shall be placed in the " Purpsing advice " category, if

1) the person responsible for the herd shall pass a fine or receive final judgment on the infringement of rules concerning animal welfare, animal health or use of medicinal products for animals on condition that the infringement is concerned ; or

2) the antibiotic consumption of the crew exceeds one or more of the limit values set for antibiotic consumption, cf. notification of limit values for bovine animal consumption in bovine animals and pig herds.

§ 14. A crew that has been placed in the " Purpated advice " category for 12 months is placed in the " Additional Consultancy " category, if

1) the person responsible for the crew has not been fined or received a final judgment on the infringement of rules as referred to in Article 13 (3). 1, no. 1, in the last 12 months, and

2) the antibiotic consumption of the crew has not exceeded one or more of the limit values set for antibiotic consumption, cf. the notification of limit values for bovine animals for bovine animals and pig herds over the last 12 months.

§ 15. A crew that resides for 12 months in the Extra Consulting category will be placed in the " Regular Consultancy " category if :

1) the person responsible for the crew has not been fined or received a final judgment on the infringement of rules as referred to in Article 13 (3). 1, no. 1, in the last 12 months, and

2) the antibiotic consumption of the crew has not exceeded one or more of the limit values set for antibiotic consumption, cf. the notification of limit values for bovine animals for bovine animals and pig herds over the last 12 months.

§ 16. After the termination of an agreement on health advice and subsequent conclusion of a new health advisory agreement, the crew of the category in which it was placed at the time of the said notice shall be continuing in the category in accordance with the said termination. however, paragraph 1 Two and three.

Paragraph 2. Contain which may cause, but have not yet taken place in the " Purpated advice " category, and which have taken place prior to the termination of an agreement on health advice or the conclusion of a new health advice agreement ; lead to the location in the Purpy advice category.

Paragraph 3. If, for a herd, for which an agreement on voluntary health advice has been concluded, more than 12 months from the termination of this Agreement to the conclusion of a new health advisory agreement, the crew shall be placed in the " Extra " category ; consultancy.

§ 17. When the first time is agreed on health advice for a crew, the crew may be moved to a category of general advice within 12 months on the basis of a veterinary declaration, cf. § 18.

Paragraph 2. Notwithstanding paragraph 1 1 may be concluded on health advice with stable school, cf. section 30-36, when the first time an agreement on health advice for a crew is concluded after this notice.

§ 18. The official veterinarian may, at the request of the crew responsible for the crew responsible, have completed a statement, cf. § 17, paragraph 1. 1 if the following conditions are met :

1) The crew does not exceed the prescribed limit values for antibiotic consumption and mortality, cf. section 19 and notification of limit values for bovine animal consumption in bovine animals and pig herds ;

2) the person responsible for the crew shall keep records of the use of medicinal products in the herd in accordance with the applicable rules ;

3) an own control programme on animal welfare is available for the crew ; and

4) the person responsible for the herd must indicate that there is no

a) pending cases of infringement of animal welfare, animal health or use of medicinal products for animals ;

b) any such cases, which have been fined or sentenced within the last 12 months of the preceding 12 months.

Paragraph 2. The person responsible for the crew shall, with its signature, confirm the accuracy of the facts referred to in paragraph 1. 1, no. 4.

Paragraph 3. The official veterinarian must keep the statement and the crew responsible for the crew shall keep a copy of this crew. The documents must be kept for at least one year after notification, cf. paragraph 4, and shall be available on request immediately for and handed over to the inspection authority.

Paragraph 4. The veterinarian must carry out a report on the issue of the declaration at www.vetreg.dk, after which the crew can change category.

§ 19. Each year, a national limit value for sows is established each year.

Paragraph 2. The limit value for sweeer, cf. paragraph 1, set for

1) 2012 to 20% and

2) 2013 to 16%.

Paragraph 3. In the case of mortality at a limit of mortality, a mortality rate shall be interpreted as an average over 12 months above the limit value of the calendar year in which the 12 months period expires.

Chapter 3

Base Agreement

20. The crew responsible for the crew may enter into one of the following basic health advice base agreements :

1) agreement on multidisciplinary health advice, cf. § § 28-29, or

2) agreement on health advice with stable school, cf. § § 30-36.

§ 21. The crew responsible for the crew shall be present at consultative visits.

§ 22. The veterinarian's advice must be at least comprising the animal welfare of the crew.

Paragraph 2. Each advisory visit shall include at least the points set out in Appendix 3 of the notice.

Paragraph 3. The veterinarian must, before each advisory visit, extract the key figures for the crew that are relevant to the advisory role.

-23. The official veterinarian must carry out audits of the official control of the animal welfare checks.

Paragraph 2. The official veterinarian must at least 1 month after ascertaining that an own control programme for animal welfare in the crew is established, prepare a plan for the auditing. The date of preparation must be indicated on the plan. The official veterinarian must revise the audit plan with a maximum of 12 months. The auditing plan must be available immediately for and be presented to the inspection authority immediately.

Paragraph 3. The auditing shall include the points set out in Annex 2 of the notice.

§ 24. When the stock market doctor has found that the crew responsible has established an own control programme for animal welfare in the crew, cf. in Annex 2, no. 1, the official veterinarian of the marketing veterinarian shall be submitted by the veterinary surgeon at www.vetreg.dk.

§ 25. The veterinarian must, after every consulting visit, draw up a written visit report, which shall contain at least :

1) description of the auditing of the points referred to in Annex 2, cf. however, section 23 (3). 3,

2) evaluation of the responsibility of the crew responsible for the part of the self-control programme that has been audited by the advisory visit, and

3) the description and assessment of the points referred to in Annex 3.

Paragraph 2. The official veterinarian must, within eight days of the consulting time, return the visit report to the crew responsible in the signed order.

Paragraph 3. The official veterinarian must keep a copy of the visitor report for at least two years. The copy must be available on request immediately for and be handed over to the inspection authority.

SECTION 26. The men responsible for the crew will have to sign the issued visitation report.

Paragraph 2. The crew responsible for the crew shall keep the visitors report for at least two years. The visitors ' report shall be available on request immediately for and be handed over to the inspection authority.

§ 27. In the case of herds covered by a basic health advice, the official veterinarian may prescribe or supply prescription medicinal products to the person responsible for the treatment of pigs or for the treatment of a group of pigs in : up to 5 days.

Cross-disciplinary health advice

§ 28. Agreement on multidisciplinary health advice for crews placed in the archiptable advice, additional advice, and general advice is available.

§ 29. The agreement must include at least 2 annual advisory visits, cf. section 21-27, at the same time the participation of a professional consultant.

Health Consulting with StaldSchool

-$30. Agreement on health advice with stable school for herds can be entered into the " Regular Consultancy " category, cf. however, section 17 (3). 2.

§ 31. The agreement shall include at least :

1) an annual advisory visit, cf. § § § 21-27, and

2) participation in stable school.

§ 32. Fathers responsible for attending a stable school must have at least one annual stable school visit.

Paragraph 2. The crew responsible shall participate in at least 75% per annas. of the stable school visits to the other participants in the stable school.

§ 33. A call for stable school visits shall include at least the points set out in Annex 4.

§ 34. Stable participants must appoint a tutor (facilitator) for all stable school visits for a period of at least one year.

Paragraph 2. Tovholder must be a veterinarian or a professional consultant.

Paragraph 3. The Tovholder shall have completed a course containing at least equivalent to that described in the Food Management website, www.fvst.dk. Documentation of course required for or extradite must be presented at the request of the request for or to be delivered to the inspection authority.

$35. The crew responsible shall have the anching-up of :

1) they call it a visit to the stable school visits,

2) the relevant material shall be sent to the stable school participants prior to the visit ;

3) tovholder produces a report, cf. Annex 4, on the basis of the stable school visit, and

4) the report within 8 days of the visit shall be sent to the stable school participants and the crew veterinarian, unless this is the tovholder.

Paragraph 2. The crew responsible shall designate at least one solution model, cf. Annex 4, Section B, which shall be carried out in the crew before the next visit to the house.

§ 36. The crew responsible and the crew veterinarian shall keep the stable report for at least two years. The stables report shall be presented at the request immediately and be presented to the inspection authority immediately.

Chapter 4

Quotation Module

§ 37. An agreement on health advice containing added to the selection module must include at least 12 annual consulting visits, cf. however, paragraph 1 2.

Paragraph 2. However, in the case of herds consisting of slaughter of pigs (30 kilograms-butchering), which are placed in the purptive advice and additional advice, the agreement must cover at least six annual advisory visits.

§ 38. A health advisory agreement with the addition of the adoring module must include at least 9 annual consulting visits, cf. however, paragraph 1 2.

Paragraph 2. However, in the case of herds consisting of slaughter only (30 kilograms-butchers) and placed in the category of general advice, the agreement must cover at least 4 annual advisory visits.

§ 39. The official veterinarian may reach an agreement with the second veterinarian for the taking of goods until 50%. of the annual advisory visits.

Paragraph 2. The veterinarian is responsible for the required number of consulting visits to be carried out.

§ 40. In the case of the maternity or sick leave or absence of a temporary absence of expected duration of at least six months, the official veterinarian may reach an agreement with a deputy on the protection of the health care advisory agreement for up to 24 months.

Paragraph 2. The veterinarian must, before the deputy take over the health advisory agreement, carry out a report on this subject at www.vetreg.dk.

§ 41. The crew responsible for the crew shall be present at consultative visits.

§ 42. An advisory visit shall include at least the points listed in Annex 5 (A).

Paragraph 2. At least every 3. month, a consulting visit shall also include the points listed in Annex 5, Section B and C.

Paragraph 3. At least every six months a consultative visit shall also include the points listed in Annex 3.

§ 43. In herds subject to the requirement for compulsory health advice, cf. Section 5 (5). 1, no. 1, the veterinarian must in the period 1. June 2013 to 31. August 2013 One Count of

1) the number of lakes in the danger path, with easy shoulder wound,

2) the number of lakes in the danger path with severe shoulder wounds,

3) the number of lakes at risk in all,

4) the number of lakes in the drain path (sickness path) with easy shoulder wounds and

5) the number of lakes in the heavy shoulder patches (sickness and sickness).

Paragraph 2. The census in a crew shall be carried out in one day or two consecutive days.

Paragraph 3. For use for assessment of shoulder wound, cf. paragraph 1, the following scale of a standing sow shall be used for measuring the wound on the hardest offensive shoulder in an area of 6 cm x 15 cm with the highest point of the shoulder (tuber spina scapulae) as the centre :

1) No or lower shoulder wounds : no skin alternated or skin changes and wounds in the broadest location of less than two cm.

2) Light shoulder wound : a approximated round of wounds with well-defined edges which, in the broadest place, are at least 2 cm, but are not a difficult shoulder wound.

3) Shoulder wounds : a approximated round of wounds with well-defined edges which, in the broadest place, are at least five centimeters, and are surrounded by a bullet-wled rand.

Paragraph 4. Within 10 days after the count, cf. paragraph 1, notify the veterinary surgeon at www.vetreg.dk reporting ;

1) the number of lakes at risk, with easy shoulder wound at the count time of the count,

2) the number of lakes in the danger path, with severe shoulder wounds on the count time,

3) the number of lakes at risk at the time of the count,

4) the number of lakes in the loading path (sickness path) with light shoulder wounds at the time of the count,

5) the number of lakes in the heavy shoulder wound, with severe shoulder wounds at the time of the count and

6) the total number of lakes in the crew at the time of the count.

Paragraph 5. Reporting, cf. paragraph 4, even if the number is 0, must also be made.

§ 44. The veterinarian must carry out audits of the control of the crew responsible for animal welfare.

Paragraph 2. The official veterinarian must at least 1 month after ascertaining that an own control programme for animal welfare in the crew is established, prepare a plan for the auditing. The date of preparation must be indicated on the plan. The official veterinarian must revise the audit plan with a maximum of 12 months. The auditing plan must be available immediately for and be presented to the inspection authority immediately.

Paragraph 3. The auditing shall include the points listed in Annex 2 on an annual basis.

§ 45. When the stock market doctor has found that the crew responsible has established an own control programme for animal welfare in the crew, cf. in Annex 2, no. 1, the official veterinarian of the marketing veterinarian shall be submitted by the veterinary surgeon at www.vetreg.dk.

§ 46. In addition to herds covered by a health advisory agreement with an additive, the veterinary medicinal product may prescribe prescription-responsible medicinal products to the person responsible for :

1) processing for up to 35 days for crews in the purpy advice and additional advice, in category General advice for up to 50 days and to herds of slaughter only for the age of 63, until 63 days of the pigs of the crew, which may be used for the crew ; are expected to be attacked by a disease which the veterinarian has already diagnosed in the herd and for which a statement of information is available ;

2) post-treatment for up to five days of individual animals for a disease for which a stock diagnosis is not available and the veterinarian has opened the examination of each animal ; and

3) processing for up to five days by a pig of pigs for a disease for which a statement of information is not available.

Paragraph 2. For the treatments referred to in paragraph 1. 1, no. 1, the veterinarian must give medicinal products only to the first five days.

§ 47. The crew responsible for the crew shall keep records of medical applications, cases of disease and deaths in the crew.

Paragraph 2. The records shall be presented to the veterinarian at the first on-call visit.

§ 48. The vet must have at least every 3. month, cf. however, paragraph 1 3, prepare a written report on the basis of the advisory visits to the crew.

Paragraph 2. The report shall include :

1) description of the auditing of the points referred to in Annex 2, cf. however, section 44 (3). 3,

2) evaluation of the responsibility of the crew responsible for the parts of the self-control programme that are audited since the last report,

3) the description and assessment of the points referred to in Annex 3, cf. however, paragraph 1 3,

4) summarying of the points listed in Annex 5, since the last report,

5) clinical evaluation of the state of health and the development of the state of health of the crew since the last report,

6) description of the marketing diagnoses, which are expected to be resolver in the period up to the next report,

7) assess whether the sales diagnosis shown by the latest report shall continue to be current ;

8) the evaluation of actions taken in accordance with agreed action plans, as outlined in the latest report,

9) assessment of the supply of medicine on the basis of the state of health of the crew and the marketing of the crew, as well as the records of the crew responsible since the last report, and

10) agreed action plans for the period up to the next report on the basis of paragraphs 4 to 9.

Paragraph 3. The points referred to in paragraph 1. 1, no. 3, must be at least described and evaluated in the report every 6. Month.

Paragraph 4. In the case of slaughtering vine herds in the convalescated advice and additional advice, cf. § 37, paragraph. 2, the veterinarian must at least draw up a report every 4. Month. For slaughtering vine herds in category General, cf. § 38, paragraph. 2, the veterinarian must at least draw up a report every 6. Month.

Paragraph 5. The veterinarian must, within eight days of the preparation of the report, deliver this in a signed order to the crew responsible.

§ 49. The men responsible for the crew will have to sign the delivered report. With its signature, the crew responsible confirms that it would take action in accordance with the agreed action plans, which are stated in the report.

$50. In the termination of an agreement on health advice, cf. section 9, in the light of the reports from the last year, the crew veterinarian shall draw up a written progress report on the crew.

Paragraph 2. The report shall include :

1) a general description of the conditions which have been relevant to the welfare and health status of the crew, including the incidence of disease, stable conditions, feeding and production ; and

2) the evaluation of the effects of the operations carried out and of the entire medical supply and other measures taken in accordance with the action plans.

Paragraph 3. The official veterinarian must, at the end of the agreement, hand over the report to the crew responsible in the signed order.

Paragraph 4. However, the progress report may be omitted if the termination is made in the case of shift between veterinarians with the same practice number.

§ 51. The crew responsible for the crew must retain reports, cf. $48 and $50 for at least two years. The reports shall be available on request immediately for and be handed over to the inspection authority.

§ 52. The veterinarian must carry a record of records for each contact with the crew.

Paragraph 2. The journal shall contain :

1) information on prescribed and supplied medicinal products, including the preparation names, quantity, dosage and treatment period, as well as for the diseases to which the medicinal products are to be used ;

2) information on the detention times notified to the crew responsible ;

3) results of laboratory examinations and other documentation, which form the basis of the advisory work ;

4) conclusions of each advisory visit ; and

5) copy of reports.

Paragraph 3. The official veterinarian must keep the file for at least two years. On request, the original journal must be presented immediately and shall be handed over to the inspection authority.

§ 53. When a different veterinarian, cf. section 39, performs advisory visits, this veterinarian must, within eight days of the consulting time, send a copy of the Conclusions of Conclusions for the visit, cf. § 52, paragraph. 2, no. 4, and other journal records for the crew veterinarian.

Chapter 5

Penalty and effective provisions

§ 54. With fine punishment, the person violating paragraph 4, paragraph 4, is punished. One and two, section 5, paragraph 5. 1, sections 7 and 8, section 9 (4). 2, § 10, § 18, § § 21-27, § § 29, § § 31-39, section 40, paragraph 2, sections 41-49, section 50 (4). 1-3, and section 51-53.

Paragraph 2. In the same way, the person who is in breach of a condition is punished in accordance with section 4 (4). Article 5 (3) and section 5 (5). 2.

Paragraph 3. The sentence may rise to a maximum sentence for two years if it has been committed by the action or omission, with a set of or gross negligence, and there is a breach in the infringement proceedings ;

1) any injury to human or animal health or induced danger ; or

2) obtained or intended for the economic benefit of the person concerned itself or others, including in savings.

Paragraph 4. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of Chapter 5 of the penal code.

§ 55. The announcement will enter into force on the 28th. February 2014.
