Publication on the use of chemical substances and mixtures in control agents 1)

In accordance with section 7 a in the law of chemicals, cf. Law Order no. 878 of 26. June 2010, as amended by law no. 294 of 11. April 2011 and Law No 277 of 19. March 2013, determined according to Article 45 (3). 1 :

§ 1. This notice contains lists of substances which the EU Commission has assessed and decided either to include or not include as active substances as active substances into the Biocidal Regulation and the plant protection product regulation. The notice also contains a list of substances which the EPA has assessed in accordance with section 15 in the notice of control measures and authorised or refused the use of pesticides which are not covered by the biocidal Regulation.

§ 2. Annex 1 contains a list of active substances which the EU Commission has decided to include as active substances for biocides by the 15th. July, 2013.

§ 3. Annex 2 contains a list of assets listed in Annex II to Commission Regulation (EC) No 2. The European Commission has decided not to include in the list of authorised active substances for biocidal products.

§ 4. Annex 3 contains a list of plant protection products for which a disclaviation period was issued under Article 46 of the plant protection product.

§ 5. Annex 4 contains a list of plant protection products which may not be held after the 2. September or 15. December 2012.

§ 6. Appendix 5 shall include a list of assets to which the EPA has assessed in accordance with section 15 in the notification of control measures.

§ 7. The announcement will enter into force on the eighth. April 2014.

Paragraph 2. Publication no. 24 of 8. In January 2014 on the use of chemical substances and mixtures in control funds are hereby repealed.

Appendix 1

Biocidal products, approved until the 15th. July 2013

In general for all products :

The appendix includes the biocides which were approved before the biocidal Regulation should apply the 1. September, 2013.

The purity as indicated in column 4 below is the minimum purity used for the assessment of the stock in respect of the inclusion in this Annex. The active substance in the product placed on the market may have the same or any other level of purity if technical equivalence has been demonstrated with the estimated substance.

For the examination of an application for product approval, shall be assessed whether sections of the population may be exposed to the product, and the uses of applications and exposure scenarios that have not received a representative treatment in the risk assessment ; at Community level.

If this is the case, an assessment of the scenarios relevant to the active substance and product concerned is carried out.

The application must demonstrate that the risk may be limited to an acceptable level and appropriate measures or be given special conditions or be communicated to the extent to limit the risks identified.

If a product contains more than one active substance, the deadline for conformity with Article 16 (3) shall be determined. 3, in Directive 98 /8/EC, at the last moment, which is determined for the current substances in the product. Deadlines shall be fixed after the 1. September 2013, in accordance with Article 89 of Regulation (EU) No, 528/1012 (biocidal Regulation).

An application shall contain adequate residue studies which provide an opportunity to assess the risks to the consumer.
In the light of this, appropriate measures shall be taken or shall be given special conditions to limit the risks identified.
Authorisation shall also be granted on the following special conditions :
1) The Products may be supplied only in a useful form, and only for professionals with special training.
