Publication of authorisations to use radio frequencies 1)

In accordance with sections 19 and 20, section 21 (1). 3, section 31, Section 54 (4). 2, and section 58 (3). Six, in law number. 475 of 12. June 2009 on radio frequencies shall be fixed as follows :

Permit Duration

§ 1. A permit shall be issued with a duration covering the rest of the calendar year in which the authorisation is issued and the 15 following calendar years, unless applied for a shorter duration, cf. however, paragraph 1 2-6 and section 4 (4). 4.

Paragraph 2. A test permit, see. Article 13 (1) of the law. 1, shall be issued with a duration of 1 year unless a shorter duration has been requested.

Paragraph 3. Notwithstanding paragraph 1 1 may be subject to the auction or public procurement procedure in accordance with the auction or the open procedure, cf. Article 10 (1) of the law. 3, no. Paragraph 1, section 11, paragraph 11. 3, no. Paragraph 12 (1) and 12 (2). 3.

Paragraph 4. Notwithstanding paragraph 1 1 and 2 may be issued with a shorter duration if the frequency plan appears in accordance with the frequency plan, cf. Article 4 of the law that the other use of the radio frequencies to which the authorisation relates shall be applied.

Paragraph 5. Notwithstanding paragraph 1 1 and 2 a permit may be issued with another duration if any such impact of international cooperation cooperation or cooperation in the European Union is provided.

Paragraph 6. Establishment of the duration of authorisations to use radio frequencies in certain frequency bands is shown in Annexes 1 and 2.

§ 2. Permissions that have been issued before 1. In October 1997, and which has been issued without duration, has a duration of 15 years from 1. in January 2010, unless otherwise specified in Annex 1 of the notice.

§ 3. A permit shall be valid from the date of issue unless otherwise specified in the authorization.

Permission Renewal

§ 4. The validity of a permit issued in accordance with Article 7 (3) of the law. Paragraph 1, or Section 12 (2). 4, at the end of the next term for the payment of the frequency charge following the expiry of the duration of the authorisation. Such authorization may, upon completion of its expiry, be renewed by the granting of the consent holder to pay the levying of the frequency tax for the authorization by the authorisation holder. The authorization shall be renewed by a duration of 15 years, unless otherwise specified in Annex 1 to the notice.

Paragraph 2. Renewal of paragraph. 1 cannot happen if :

1) The Management Board before the expiry of the period of authorisation has granted the authorization holder that the authorization may not be renewed ; or

2) it appears from the frequency plan, cf. Article 4 of the law that the other use of the radio frequencies to which the authorisation relates shall be applied.

Paragraph 3. The Management Board may renew a permit issued in accordance with the provisions of Article 7 (3) of the law. Paragraph 1, or Section 12 (2). 4, for a period limited period, if :

1) The Management Board before the expiry of the duration of the authorisation has received an application to use radio frequencies covered by the authorization of a person other than the authorization holder, and

2) there is a frequency range in accordance with the provisions of Article 7 (3) of the law. 6, or the Corporate Management Board shall carry out an examination of the frequency of the spectrum.

Paragraph 4. If the Danish Agency shall renew a permit for a period of limited time in accordance with paragraph 1. 3, shall determine the duration of the authorisation, which expires at the latest when a new permit is granted to use the radio frequencies to enter into force following the issue under the Clause 7 (3) of the Act of Procedure. Paragraph 1, section 10, paragraph 10. 4, section 11, paragraph 1. 4, or Section 12 (2). 4.

Granting of plans to grant authorizations

§ 5. Permission holders subject to the law on the central enterprise register shall inform the Acquisitions Management Board their plans to transfer a permit or share thereof before the transfer takes place.

Paragraph 2. The Management Board shall publish information on the awarding holder's plans for transfers received in accordance with paragraph 1. 1.

Confidentiality for the permission of the consent holders

§ 6. The content and existence of radio signals received by others other than that for which they are determined may not be used shall be made public or disclosed to the unauthorized person.

Paragraph 2. The confidentiality of paragraph 1. Paragraph 1 shall not apply to radio communications intended for general public use, such as emergency signals, navigation signals, ham radio or radio or television programmes.

Penalty provisions

§ 7. The penalty will be penalised by the penalty that violates paragraph 5 (5). Paragraph 1, or Section 6 (1). 1.

Paragraph 2. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

The entry into force, etc.

§ 8. The announcement shall enter into force on 1. June 2014.

Paragraph 2. Publication no. 1246 of 25. October 2013 on authorisations to use radio frequencies are lifted.

Appendix 1

The duration of the permissions to use radio frequencies in certain frequency bands

1) Permissions to use radio frequencies covered by the national unit of MUX 8, cf. Annex 2, which is intended for digital radio or television, shall be issued with a limited duration and shall be suspended without further notice at the time specified in a political decision on the final use of the frequencies, but not later than 31 of the date of the final use. December 2015.

2) Permissions to use radio frequencies in frequency bands 384,8-385,0 MHz and 394,8-395 MHz are issued or are renewed with one duration to the latest 16. October 2016.

3) Permissions to use radio frequencies in frequency bands 410-430 MHz and 440-445 MHz, as with notice no. 1140 of 4. In December 2009, on authorisations to use radio frequencies, a duration shall be added to 31. December 2011, prolonged by one duration until 31. December 2015.

4) Permissions to use radio frequencies in frequency band 470-494 MHz for purposes other than any other purpose shall be issued with a duration of up to a period of up to 1 years from the date of issue, but at the latest to the end of the third date. April 2020, after which the authorisations are to be suspended.

5) Permissions to use radio frequencies in frequency bands 870-876 MHz and 915-921 MHz frequency bands shall be issued or renewed for one duration to the latest by 31. December 2016, and then the authorizations will be suspended.

6) Permissions to use radio frequencies in the frequency bands 1427-1452 MHz, 1452-1492 MHz and 1492-1518 MHz are issued with a duration of the 31. December 2015, the authorisations will be suspended. However, this does not apply to fixed services (radio-set connections) between oil platforms or similar installations in the North Sea.

7) Permissions to use radio frequencies in frequency bands 1980-2010 MHz and 2170-2200 MHz issued in accordance with Commission Decision No 2 449 /2009/EC of 13. May 2009 on the selection of operators of pan-European systems providing mobile satellite services is issued with a duration of 18 years from the date of the decision and expires on the 12. May 2027, and then the authorisations will be suspended.

8) Permissions to use radio frequencies in the frequency band 2300-2400 MHz are issued or are renewed for one duration to the latest on 31. December 2015, the authorisations will be suspended. However, this does not apply to fixed services (radio-set connections) between oil platforms or similar installations in the North Sea.

9) Permissions to use radio frequencies in the frequency band 3400-3800 MHz are issued with a duration of no later than 31. December 2015, the authorisations will be suspended.

10) Permissions to use radio frequencies in the frequency band 3800-4200 MHz are issued or renewed by one duration to the latest on 31. December 2019.
