Completion on the duties and powers of the Food Management Board

In accordance with paragraph 110 (1), 3, in the case of fisheries and fish farming (fisheries law), cf. Law Order no. 978 of 26. § 1. The announcement concerns the duties and powers of the Food Board in Denmark. The functions and powers of the Management Board in Greenland have been described in the announcement of the Authority's and Greenland Authority's duties and powers in Greenland, on the part of the food and veterinary sector administered by the Minister for Food.

Tasks

§ 2. The FDA is a management board under the Ministry of Food, Agriculture and Fisheries. The Governess implements the policy of the Food Department in food, veterinary conditions, including animal welfare and animal feed. The management is led by a CEO, a number of vice presidents and a veterinary director.

§ 3. The Food Management Board shall carry out checks and inspections, and issue rules relating to food, veterinary conditions, including animal welfare, feed and individual areas within fishing. The Management Board shall conduct investigations and provide information and advice in the areas mentioned. The Management Board shall also monitor the state of health of the livestock and wild fauna in Denmark and, where necessary, in other countries.

§ 4. The Food Safety Management Board is preparing legislative proposals, preparing and laying down administrative legislation, preparing guidelines, plans and programmes and decisions in concrete matters under national rules and acts of the European Union ; the areas in which the Director of the Food Authority is charged.

Paragraph 2. The Management Board is preparing cases to be submitted to the Minister for Food, Agriculture and Fisheries.

Paragraph 3. The Management Board shall prepare matters which shall be decided by the Ministry of the Committee on the Board of Appeal.

Paragraph 4. Management makes notification to the EU Commission in accordance with the rules on the notification of the implementation of EU acts, notification of state aid and on notification after the Information Process duredirective with regard to technical standards and requirements.

Paragraph 5. The management takes part in the treatment of EU cases and international dossier, which is presented to the Minister.

§ 5. The Danish Food Authority provides technical advice and other assistance to the Minister for Food, Agriculture and Fisheries and other public authorities, etc.

Paragraph 2. Management shall carry out the guidance and information activities of other public authorities, organisations and private sectors.

§ 6. The Management Board shall carry out the presidency and the secretariat for :

1) The Danish Codex Alimentarius Committee.

2) The Ministry of Food, Agriculture and Fisheries Advisory Committee on Disease in the Aqual animals.

3) The Ministry of Food, Agriculture and Fisheries Advisory Committee on Inspecting Expenses.

Paragraph 2. The Management Board shall perform the secretariat for the Veterinary Health Council and a member of the secretariat shall include an employee with a legal nominees examination. The Management Board shall deal with matters to which the Management Board shall apply to tasks for which the management authority is responsible for the purposes of this notice, by the way, the law or other authority.

Paragraph 3. The Management Board shall perform the secretariat of the Animal Attempting Council.

§ 7. Compensation for food, agriculture and fishing activities by the Director of the Food Authority, unless otherwise provided for in section 9-10 or in any time applicable to the Confeit of the Natural Acquisitions ; tasks and powers :

§ 8. The vessels shall be in accordance with the text of the text. 2) The glance to lay down rules on redress, including the time-limits, the effect of a complaint to resume a case after a complaint has been filed, that decisions may not be brought to the second administrative authority, and on forms of claim to the complaint.

3) The glance to appoint the President and Vice-President of the Veterinary Health Council, and to lay down rules on the Council's activities and the establishment of a Council Secretariat and the composition and operation thereof, cf. Section 28 of the Law on veterinarians.

4) The glance to set up a Veterinary Fund, and to appoint the other members, cf. Section 36 c, on the side of animals of animals.

5) The gagination to set up committees to assist in the administration of special areas in food law, cf. § 58, paragraph. Five in the law of food.

6) The order of the Animal Ethics Council to appoint the President and Vice-President of the Council and to lay down rules for the Council ' s activities in accordance with the Rules of Procedure shall be established, cf. The section 25 of the animal protection slots.

7) The conclusion of the Special Council for Animal Control Questions, to appoint the President-in-Office of the Council and to lay down rules for the establishment of the Council in a Rules of Procedure, cf. section 26 of the animal host slots.

8) The glance to reduce the Council on the hold of Special Animals, to appoint the President-in-Office of the Council, and to lay down rules for the Council ' s activities in accordance with rules of procedure, cf. section 26 (a) of the animal protection.

§ 10. Notwithstanding the provisions of section 7, the following powers shall be exercised by the Minister for Food, Agriculture and Fisheries of the Veterinary Director of the Food and Food Authority :

1) Fighting animal diseases in Chapter 6 of Chapter 6 of the Boxes of Animals.

2) Chapters in Chapters 2 to 6 and 8-9 of the Law on veterinarians concerning the rights of farmers, the duties of veterinarians, the supervision of certified veterinary doctors and the deprivation of rights of the veterinary surgeons.

Paragraph 2. The veterinary director shall refer to the provisions of paragraph 1. 1, mentioned directly to the department.

Paragraph 3. The Veterinary Director shall keep the Director of the Food Authority running the Director on the basis of the tasks assigned to the veterinary director, cf. paragraph 1.

Paragraph 4. The Director shall perform the following functions :

1) Retracting third countries in cases where special zoosanitary guarantees are required to export it.

2) The European Union is a matter of the European Union on the issue of zoosanitary conditions.

3) Represents Denmark in the International Organisation for Epizootics (OIE).

4) Represents Denmark in the European Mouth and Klovesick Commission (EUFMD).

Paragraph 5. The veterinary director shall refer to the provisions of paragraph 1. 4, mentioned functions to the Director of the Food Authority.

§ 11. The following powers granted to the Minister for Food, Agriculture and Fisheries in accordance with the Eco-laws, shall be exercised by the Director of the Food Authority for aquaculture of fish and food and feed with animal content, which is intended for dogs, Cats and other pet animals :

1) The provisions of the provisions of Article 6 of the law to establish rules on the design and use of the eco-label symbol (Ecolabel).

2) The following provisions shall be granted in accordance with the provisions of section 7 and 8 of the Act and to refuse authorization, and to provide for authorization, including applications, etc.

3) The vessels shall be notified under the provisions of section 10 and 11 of the order of the law.

4) The provisions of Article 12 of the Act of the law to take decisions in accordance with section 10 (4) shall be requested. 1-4, and section 11, paragraph 1. 2, for the courts, as well as legal proceedings against the authorization holder.

5) The provisions of the provisions of Article 13 of the law to lay down rules or regulations to implement the directives and decisions of the European Union and to lay down the rules and implement the measures necessary for the use of the European Union ; of the regulations laid down by the European Union on matters covered by the laws of the ecology of the European Union.

§ 12. The following powers granted to the Minister for Food, Agriculture and Fisheries pursuant to section 22 of the Act of Biekeeping shall be exercised by the Director of the Food Safety Board :

1) The Befing in section 13 (3). 1, no. 3, cf. Law Order no. 585 of 6. July 1985, to lay down detailed rules on the control of live bees, including larvae and other pubic products, as well as beekeeping products entering or out of the country.

2) The Befing in section 13 (3). 3, cf. Law Order no. 585 of 6. July 1995, to levy charges on the implementation of the one in no. 1 the checks provided for in or out of the country in the case of the person who leads live bees.

3) The Befing in section 15, paragraph 1. 2, cf. Law Order no. 585 of 6. July 1995 to lay down rules on fines for the infringement of the rules laid down in paragraph 1. 1.

4) The Befing in section 15, paragraph 1. 3, cf. Law Order no. 585 of 6. July 1995, to impose an obligation on companies, etc., in accordance with the rules of the penal code 5. Chapter.

§ 13. The following powers of the minister for food, agriculture and fisheries, in accordance with the law of pharmacist activities, shall be exercised by the Director of the Food Safety Management Board :

1) The post of Title 9 (4) of the law. 3, to lay down rules on the treatment of veterinary medicinal products for animals.

2) The post of law 72, paragraph 1. 2, to lay down rules on penalties for breaches of the rules laid down in paragraph 1. 1.

3) The post of the Act of Title 72, paragraph 1. 3, to impose on companies, the state, municipalities and municipal communities, executable responsibility.

§ 14. The powers of the Minister for Food, Agriculture and Fisheries, in accordance with the Law on Fisheries and Fish and Fish (Fisheries Law), shall be exercised by the Director of the Food Safety Agency :

1) Exasions under the law of the law to lay down rules and implement measures to comply with :

a) Council Regulation (EC) No, 1005/2008 on a Community scheme intended to prevent, deter and eliminate illegal, unreported and unregulated fishing (the 'IUU Regulation') , Commission Regulation (EC) No, 1010/2009 of 22. October 2009 laying down detailed rules for the application of Council Regulation (EC) No Regulation (EC) No 1005/2008, Council Regulation (EC) No 1224 of 20. Nov 2009 establishing a Community audit scheme to ensure compliance with the common fisheries policy (CFP), amending Regulation (EC) No 2020/20. 847/96, (EC) No, 2371/2002, (EC) No, 811/2004, (EC) No, 768/2005, (EC) No, EUR 2115/2005, (EC) No, (EC) No 2166/2005, 8/388/2006, (EC) No, 509/2007, (EC) No, (EC) No 676/2007, no. 1098/2007, (EC) No, 1300/2008, (EC) No, Regulation 1342/2008 and repealing Regulation (EEC) No 2, (EC) No 2847/93. (EC) No 1627/94 and (EC) No Regulation (EC) No, 1966 and Commission Regulation (EC) No 404/2011 of 8. April 2011 laying down detailed rules for the application of Council Regulation (EC) No 1224/2009 establishing a Community audit scheme to ensure compliance with the common fisheries policy (CFP) with respect to the control of fish and fishery products imported into the EU from third countries other than by direct landing in : the port, control of export to third countries of imported fish and fishery products from third countries, provided that they have not undergone processing in Denmark, checks on fish and fishery products after the first caret trade, and control of ; farmed fish ; and

b) Commission implementing Regulation (EU) No 793/2013 of 20. August 2013 laying down measures for the Faroe Islands in order to ensure the conservation of the Atlantic-Scandinavian herring, cf. Article 5 of the Regulation, with the exception of direct landings.

2) The eyes of the Act of Title 112 c, § 114 a, § 117, paragraph 1. Paragraph 1 (1). 2, no. 1-4, paragraph 1. 3 and paragraph 1. 4 § § § 118-120 and § 121, paragraph 1. 2-3 in order to carry out checks on compliance with

a) Council Regulation (EC) No, in writing.-1005/2008 on a Community system to prevent, deter and eliminate illegal, unreported and unregulated fishing and Commission Regulation (EC) No 1472/EC. 1010/2009 of 22. October 2009 laying down detailed rules for the application of Council Regulation (EC) No Regulation (EC) No 1005/2008, Council Regulation (EC) No 1224 of 20. Nov 2009 establishing a Community audit scheme to ensure compliance with the common fisheries policy (CFP), amending Regulation (EC) No 2020/20. 847/96, (EC) No, 2371/2002, (EC) No, 811/2004, (EC) No, 768/2005, (EC) No, EUR 2115/2005, (EC) No, (EC) No 2166/2005, 8/388/2006, (EC) No, 509/2007, (EC) No, (EC) No 676/2007, no. 1098/2007, (EC) No, 1300/2008, (EC) No, Regulation 1342/2008 and repealing Regulation (EEC) No 2, (EC) No 2847/93. (EC) No 1627/94 and (EC) No Regulation (EC) No, 1966 and Commission Regulation (EC) No 404/2011 of 8. April 2011 laying down detailed rules for the application of Council Regulation (EC) No 1224/2009 establishing a Community audit scheme to ensure compliance with the common fisheries policy (CFP) with respect to the control of fish and fishery products imported into the EU from third countries other than by direct landing in : the port, control of export to third countries of imported fish and fishery products from third countries, provided that they have not undergone processing in Denmark, checks on fish and fishery products after the first caret trade, and control of ; farmed fish ; and

b) Commission implementing Regulation (EU) No 793/2013 of 20. August 2013 laying down measures for the Faroe Islands in order to ensure the conservation of the Atlantic-Scandinavian herring, cf. Article 5 of the Regulation, with the exception of direct landings.

3) The eyes of the provisions of Article 130 (1) of the law. 2, to lay down rules for penalties for violation or attempted violation of the provisions of rules laid down in paragraph 1. 1, and the powers under the provisions of Article 130 (3) of the law. 4, to impose an obligation on companies, etc., in accordance with the rules of the penal code 5. Chapter.

4) The post of Title 132 of the Act of Title 132 to carry out confiscation in matters relating to the infringement of those referred to in paragraph 1. Paragraph 1 of this Regulation and of rules laid down in paragraph 1 1 in the areas mentioned, and the powers under the rule of law 133 to indicate that claims for confiscation can be adopted without legal proceedings.

5) The post of the Act of Title 133 to indicate that the case can be determined without legal proceedings in the case of the adoption of a fine-having-enoted egg.

§ 15. For matters covered by the administration of the European Community regulations on schemes under the common agricultural policy funded by the European Guarantee Fund for Agriculture and so on. (agricultural aid law), the following shall be exercised by the Director of the Food Authority :

1) The eye of the Act of Section 4 (4). 1, to lay down rules for the control of compliance with the Regulations referred to in § 16.

2) The post of Title 4 of the law to establish rules on publication, etc. as regards the Regulations referred to in section 16.

3) The provision of the provisions of Article 5 of the law to lay down rules for a total or partial payment of the costs of monitoring compliance with the Regulations referred to in Section 16 and to lay down rules for the total or partial payment of particular services ; carried out within the territory of these Regulations.

4) The post of Title 20 (2) of the law. 1 to add interest rates for late payment of charges payable and fees applicable to the Regulations referred to in Section 16.

5) The Befing of the Act of Section 24 to lay down rules on penalty for infringement of the Regulations referred to in § 16 and by rules laid down in paragraph 1. 1 and 2, or to try to do so.

6) The post of the Act of Title 29, paragraph 1. The following shall be the case in respect of a breach of the Regulations referred to in Section 16 and by rules. 1 and 2, to indicate that the case can be determined without legal proceedings in the adoption of a fine-egg-class egg.

§ 16. The following powers granted to the Minister for Food, Agriculture and Fisheries in accordance with the law on nature conservation 1) shall be exercised by the Director of the Food Safety Authority :

1) The vessels shall be in accordance with the provisions of Articles 30 and Section 71 (1). 2, to lay down rules on dissemination of the knowledge of animal species, the registration of animal populations and breeding programmes for the implementation of Council Directive 1999 /22/EC of 29. March 1999 on the team of wild animals in zoos.

2) The post of the Act of Article 89 (5). 3, to lay down rules on penalties for breaches of the rules laid down in paragraph 1. 1.

3) Table of eyes only after Article 89 (5). 4, to impose an obligation on companies, etc., in accordance with the rules of the penal code 5. Chapter.

§ 17. In the areas in which the Food Authority has been granted the powers in the legislation in force, the Management Board shall also administer the European Union regulations.

§ 18. The Minister for Food, Agriculture and Fisheries may decide that powers under Clause 7 to 8 and sections 10 to 16 shall be exercised by the Director of the Food and Veterinary Director, by the Minister.

Paragraph 2. The Minister can give instructions for the exercise of the powers conferred on them by the Governors of the Governors.

Clause

§ 19. Decisions taken by the Director of the Food Authority, the veterinary director or by other authorities or institutions, including private institutions, in the context of the taking of tasks in accordance with the provisions of section 7, no. 1-13, section 11-12, § § 14-15 and § 17 mentioned laws and regulations relating to matters covered by these laws may be enclamed to the Ministry of Appeal of the Ministry.

Paragraph 2. The time limit is four weeks. Complaguing must be submitted by the authority which has made the decision.

Paragraph 3. The Ministry of the Ministry of Health may not exceed six months after the decision may be overwritten when the time limit for specific reasons is excruciatly.

Paragraph 4. Decisions taken by the Director of the Food Service after it in section 7, no. 14 mentioned law and regulations on matters falling within the provisions of section 7 (2), The laws of the Ministry of Health may be complained of the Ministry of Appeal 6-13. The complaint may be lodged by the Food Authority.

Paragraph 5. Decisions taken by the Director of the Food Authority after the text marking referred to in Article 8 may be subject to appeal to the Ministry of Appeal for the Ministry of Health.

20. Decisions taken by the Director of the Food Authority as a result of a notification by a consumer or a consumer organisation of a possible breach of the law on food, rules issued by virtue of this or of the European Union Regulations, decisions, decisions or other immediately applicable EU legal acts in the area of the food law may be enclamed to the Committee of the Ministry of the Ministry of the following surveyors of the following surveyors :

1) The Consumer Council,

2) Denmark's Active Consumers,

3) The Grøn Week of the Country Organization and

4) NOAH.

Paragraph 2. The Minister for Food, Agriculture and Fisheries may take a decision that, in accordance with the rules laid down in paragraph 1, foreign country consumer organisations, who are responsible for general consumer interests, can appeal against a decision. 1.

Paragraph 3. A consumer organisation which, pursuant to paragraph 1, 1 and 2 of the proceedings shall be subject to a decision as part of the appeal proceedings.

Paragraph 4. The time limit is four weeks. Complaguing must be submitted by the authority which has made the decision.

Paragraph 5. The Ministry of the Ministry of Health may not exceed six months after the decision may be overwritten when the time limit for specific reasons is excruciatly.

§ 21. The Director of the Food Management Board shall, in the case of the veterinary director, resume a case after a complaint has been lodged, with the exception of decisions taken in accordance with Article 7 (2). 14 mentioned law.

§ 22. The Director of the Food Authority or the Veterinary Director, cf. Section 10 may grant a derogation from the laws, regulations or rules granted under section 11 to 16, where the derogation is laid down by the law or rules issued under the law.

-23. The announcement shall enter into force on the 15th. June 2014.
