Publication of aid for the promotion of fisheries control through projects on traceability

In accordance with section 3, section 5, section 7, paragraph 4, and section 11 (4). Amendment No 4. 1552 of 20. December 2006 on the development of the fisheries and aquaculture sector (fisheries development law) and in accordance with the text of the text. 163 ad § 24.26.30 of the 2014 Finance Act will be determined by the authorization :

Chapter 1

Objec-use and use

§ 1. The purpose of the notice is through grants to investments to support the implementation of the common fisheries policy by ensuring the traceability of fishery and aquaculture products on all stages of production, processing and distribution ; catches or harvests for retail sales in accordance with Article 58 of Council Regulation (EC) No ; 1224/2009 of 20. (EC) No 1627/94 and (EC) No 1966, 2006.

§ 2. The Office of Natural Acquisitions may, within the appropriation framework, provide a commitment to the purchase and installation of traceability systems.

§ 3. Commitment of grants may be awarded to assembly centres, auction houses, owners of fishing vessels, producer organisations, processors and retailers.

Paragraph 2. The Office of the Natural Acquisius Management Board may, by means of a concrete assessment, consent to undertakings other than those referred to in paragraph 1. 1.

Chapter 2

Definitions

§ 4. For the purposes of this notice :

1) Collectals : Companies where the landed fish is set up for the first sale.

2) Retailers : Companies that sell the fish directly to the consumer.

Chapter 3

Administration

Inspection

§ 5. The National Services Agency shall carry out physical checks and administrative checks as well as the subsequent financial control of projects receiving subsidies.

Paragraph 2. The Office of the Natural Business Authority may, where necessary, seek to obtain information from other authorities as necessary in accordance with the Clause 12 of the Fisheries Development Act.

Applications for grants of grants

§ 6. Application can be submitted from the 15th. August 2014 and shall be received in the Office of the Natural Acquisius at the latest by 15. September, 2014.

Paragraph 2. The application for a commitment to grants must be submitted to a special scheme, which is available on the Home Affairs website of the Natural Acquisius.

Paragraph 3. The Office shall sign off on receipt of the application and may, in connection with this, permit the implementation of the project.

Decision and selection

§ 7. The Office of the Natural Acquidition Management Board may be refused or partially rejected in cases where the Benefit Board of Natural Acquidition assesses that :

1) the application is not sufficiently enlightened,

2) the application cannot be accepted pursuant to Article 10 of Regulation (EC) No 2 of the European Parliament and of the Council. 508/2014 of 15. May 2014 on the European Sea and Fisheries Fund and the repeal of Council Regulation (EC) No 7. 2328/2003, (EC) 861/2006, (EC) No, 1198/2006 and (EC) No, Regulation (EC) No 791/2007 and Regulation (EC) No (EC) No 1255/2011,

3) the effect of the project not adequately applied in order to achieve the purpose of the subsidy scheme shall not be adequately used,

4) the effect of the project is not sufficiently seen in relation to the total cost of the project ; or

5) the estimated expenditure of the estimated expenditure is not justified.

§ 8. The Office of the Natural Acquisitions Committee shall select the applications for a grant on the basis of specified criteria.

Paragraph 2. The Department of Natural Services shall publish the selection criteria on the home page of the Natural Acquisition and in the instructions for the subsidy scheme at the latest by 15. August, 2014.

Chapter 4

Constraints for grants of grants

§ 9. It is a condition of pledges for a project to :

1) the necessary authorisations from public authorities have been obtained prior to the first payment application,

2) shall provide for the information requested by the Services of the Natural Acquilitigation of the Natural Safety Agency,

3) the project is terminated by the date specified in the case,

4) the project is not sold, substantially amended or moved outside the programme area for five years from the final payment ;

5) tille holder shall submit payment request, inventory of eligible expenses, all expenses supporting documents, the supporting documents and the final report to the Natural Acquidation,

6) tilaves if the project or part thereof is covered by the EU procurement rules or the rules of procedure, holds documents that document that the EU procurement rules or the rules of the contract have been complied with, available for at least five years from ; closing down payment, and

7) tiling the saver shall ensure that the inspection authority has access to the control of the project.

Paragraph 2. The Office of the Natural Acquids shall lay down in the defendant ' s obligation to provide information on the public cofinancing of the project, including the claim for signage.

Chapter 5

Eligible expenditure

§ 10. Eligible expenditure may include :

1) costs for the procurement and installation of scanners, bar-bar readers and printers, equipment, standard software, and update of existing software, RFID tags, and readers, electronic chips or similar to tags, fish boxes, etc.,

2) fees for consultancy assistance in the implementation of the project ; and

3) technical assistance for purchased software for up to two years after installation.

Paragraph 2. Investments referred to in paragraph 1. 1, no. 1, must be developed on the basis of internationally recognised standards in accordance with Article 67 (1). The Commission's implementing Regulation (EC) No 8 (8). 404/2011 of 8. April 2011 laying down detailed rules for the application of Council Regulation (EC) No 1224/2009 establishing a Community control system in order to ensure compliance with the rules of the common fisheries policy.

Paragraph 3. The costs must be required to complete the project and must be directly related to the implementation of the project.

§ 11. The eligible expenditure may not include :

4) expenditure to which other EU grants are provided ;

5) expenditure received from the second public authority,

11) expenditure relating to activities to which the saver is required to carry out in accordance with other legislation ;

12) the expenditure incurred by the FDA prior to the operation of the Natural Agency, before the Office of the Conserenal Office, has authorised the project ;

13) simple reacquisitions ; and

14) general operating costs.

Chapter 6

Calculation of grants

§ 12. The Wildlife Agency may grant subsidies in the up to 80%. for the eligible expenditure.

Paragraph 2. If the appropriation of the appropriation framework is not sufficient to grant consent to all eligible applications, the Services of Natural Acquisitions shall be reduced in accordance with paragraph 1. 1 mentioned grant percentage.

Chapter 7

Changes to Project and Delegation of Commitment

§ 13. Amendment of a project may be approved by the Natural Business Authority on condition that the change is in accordance with the project ' s purpose. The application for a change to a project must be approved by the Natural Business Authority before the change takes place.

Paragraph 2. A request for a change to a project must be received in the Natural Business Authority within two months before the date of completion of the project.

Chapter 8

Payment of grants

§ 15. The payment of grants shall be made on the basis of the account of the attribution of the subsidy to the eligible expenses incurred. § 16. The request for payment must be received in the Natural Acquire Management Board no later than three months after the date of completion of the project.

Chapter 9

Notify obligations

Chapter 10

Wastes of commitments and repayment or reduction of grants

§ 19. The Office of the Natural Business Authority may decide on the lapse of pledges and repayment of grants, if :

1) the applicant has given inaccurate or misleading information or has dissent information of significance for the decision of the case,

2) tillies shall override his duties according to section 11 (1) of the Fisheries Development Act. 2,

3) the tilaves do not comply with its notification obligation after section 18,

4) the project is not carried out in accordance with the case, or

5) the conditions for pledges of grants are not met.

20. By way of derogation from paragraph 19, the Benefit of the Natural Acquidation Management Board shall maintain or make a proportional reduction of the total value of eligible expenditure if the National Business Authority considers that the following is not complied with :

1) The condition in section 9 (4). 1, no. 4.

2) The condition in section 9 (4). 1, no. 6.

3) Conditions laid down in section 9 (3). 2.

4) § 19, nr. 1.

5) § 19, nr. 3.

6) The EU procurement rules or the rules in the tender law.

§ 21. In the event of non-compliance with the conditions laid down in section 20, the subsidy will be reduced proportionally, based on an assessment of the nature and gravity of the infringement, and any loss of the European Sea and Fisheries Fund.

Chapter 11

Force majeure

§ 22. The Wildlife Agency may recognise cases of force majeure and other extraordinary circumstances which prevent the granting of the project from carrying out the project and thus does not result in the loss of commitments and recovery or reduction of subsidies.
