(The consequences of the impact of annexes as a result of Croatia's entry into the EU)

§ 1

Notice no. 936 of 16. September 2004 on the procedures for the conclusion of contracts in the field of water and energy supply, transport and postal services, as amended by the notice of publication No 2 ; 325 of 11. April 2006, Notice no. 598 of 7. June 2007 and Notice no. 894 of 17. August 2011, the following changes are made :

1. Foot notation the title of the notice shall be replaced by the following :

" 1) The commotion contains provisions implementing Directive 2004 /17/EC of the European Parliament and of the Council of 31. March 2004 on the coordination of procedures for the conclusion of contracts in the field of water and energy supply, transport and postal services ("utilities for utilities") , (EC Official Journal 2004 # In 134, page 1) and the Council Directive 2013 /16/EU of 13. May 2013 on the adaptation of certain directives on public procurement due to the accession of the Republic of Croatia, the EU-Official Journal, no. "L 158, page 184."

2. I Annex 1, Section Annex I : the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. ' 90/11 ", which, in accordance with special provisions, deal with the construction or management of fixed networks for the operation of the public in relation to the production, transport and supply of gas and heating to fixed networks, such as companies ; which deal with such activities on the basis of the authorisation to engage in energy-related activities under the energy law (Croatia's statesingly number. 120/12). '

3. I Annex 1, Section Annex II, the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. ' 90/11), subject to specific provisions, concern itself with construction (delivery) or management of fixed networks for the operation of the public in the context of production, transport and supply of electricity and electricity to fixed networks ; such as companies dealing with such activities on the basis of the authorisation to engage in energy-related activities in accordance with the law on energy (Croatia's statesingly number. 120/12). '

4. I Annex 1, Section Annex III, the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. ' 90/11 ", which, in accordance with special provisions, deal with the construction or management of fixed networks for the operation of the public in the case of the production, transport and supply of drinking water intended for fixed networks such as companies ; the establishment of local self-governing units acting as a public service provider of water supply services or waste water-off services under the law of water supply (Croatia's stateside number. 153/09 and 130/11). `

5. I Annex 1, Section Annex IV ; the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. ' 90/11 ", which, in accordance with special provisions, deals with the delivery or management of networks to serve the public in the case of rail transport. ` ;

6. I Annex 1, Section Annex V, the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. 90/11, subject to special provisions, deal with the provision or management of fixed networks to serve the public in the case of urban transport by rail, rail, tram, bus, trolley bus, or rail transport, such as companies dealing with such activities in the form of public services, under the provision of the provision of services (Croatia's statesingly number. 36/95, 70/97, 128/99, 57/00, 129/00, 59/01, 26/03, 82/04, 110/04, 178/04, 38/09, 79/09, 153/09, 411, 84/11 and 90/11). '

7. I Annex 1, Section Annex VI the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. Directive 90/11), in accordance with special provisions, in the provision of postal services and other services which do not include postal services in accordance with Article 112 (1) of the law. 4. "

8. I Annex 1, Section Annex VII ; the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. 90/11, subject to special provisions, concern itself with the use of a geographical area for the purpose of investigation and extraction of oil and gas, such as those engaged in such activities in accordance with the law of mining (Croatia's statesingly no. 75/09 and 49/1. ` ;

9. I Annex 1, Section Annex VIII ; the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. 90/11, subject to special provisions, concern itself with the use of a geographical area for the purpose of the investigation and extraction of coal and other fixed fuels such as companies engaged in such activities in accordance with the provisions of the Directive ; for the law of mining (Croatia's statesingly no. 75/09 and 49/1. ` ;

10. I Annex 1, Section Annex IX, the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. 90/11, subject to special provisions, concern itself with the use of a geographical area in order to make sea ports, river ports and other transport terminals accessible to operators in sea or river transport, such as : undertakings engaged in such activities under the Law on Maritime and Sea ports (Croatia's statesing no. 158/03, 100/04, 141/06 and 38/09). `

11. I Annex 1, Section Annex X, the following paragraph shall be added after subparagraph ' France ` :

" Croatia

Contracting entities referred to in Article 6 of Zakon o javnoj nabavi (Narodne novine broj 90/11) (law on public procurement, Croatia's statehead No. 90/11), subject to special provisions, concern itself with the use of a geographical area in order to make airports and other terminal equipment available to airlines available, such as those engaged in such matters ; activities under the law of airports (Croatia's statesing # 19/98 and 14/11) ` ;

§ 2

The announcement shall enter into force on the 18-1. November, 2013.
