Completion on the implementation of the Commission Decision of 23. July 2012 on alteration and repealing different technical specifications for interoperability 1)

In accordance with section 21 h (1) (i), ONE, ONE. pkt., and section 26 (s). ONE, ONE. pkt;, in the law of rail, cf. Law Order no. 1249 of 11. In November 2010, according to section 24 h, paragraph, shall be adopted. 1.

§ 1. The announcement shall be made by the Commission Decision of 23. July 2012 amending Decision 2 0 0 2 / 7 3 1 / EC, 2002 /72/EC, 2002 /73/EC, 2002 /735/EC and 2006 /66/EC and repealing Decision 2002 /730/EC on technical specifications for interoperability ("Omnibus Part 1").

Paragraph 2. The Commission ' s decision, including annexes, has been included in Annex 1 to this notice.

§ 2. The announcement shall enter into force on the 24th. January 2013.

Paragraph 2. The announcement repeals BJ 9-01, Provisions for the implementation of technical specifications for interoperability (TSI) for the maintenance subsystem of the trans-European high-speed rail system.

amending Decision 2 0 0 2 / 7 3 1 / EC, 2002 /72/EC, 2002 /73/EC, 2002 /735/EC and 2006 /66/EC and repealing Decision 2002 /730/EC on technical specifications for interoperability

THE EUROPEAN COMMISSION HAS-

Having regard to the Treaty establishing the Functioning of the European Union,

Having regard to Directive 2008 /57/EC of the European Parliament and of the Council of 17. June 2008 on the interoperability of the railway system in the Community 1) , and in particular Article 6 (2), 1, and

in the following considerations :

(1) In accordance with Article 12 of Regulation (EC) No 2 of the European Parliament and of the Council, 881/2004 of 29. April 2004 establishing a European Railway Agency ("Agency Regulation") 2) the European Railway Agency (hereinafter referred to as ' the Agency ') shall ensure that the technical specifications for interoperability (in the following described "TSIs") must be ensured. are adapted to technical progress, market developments and the social requirements, and propose to the Commission the changes to the TSIs as it dets necessary.

(2) In Decision C (2007) 3371 of 13. In July 2007, the Commission gave the Agency a framework member to carry out certain activities in accordance with Council Directive 96 /48/EC of 23. July 1996 on the interoperability of the trans-European high-speed rail system 3) Directive 2001 /16/EC of the European Parliament and of the Council of 19. March 2001 on the interoperability of the trans-European conventional rail system 4) According to the terms of this framework member, the Agency was asked to review the rolling stock TSI for high-speed trains, wagons, locomotives and passenger carriages, noise, infrastructure, energy, train control and signalling, operation and traffic management, freight and passenger traffic, safety in rail tunnels and accessibility for persons with reduced mobility.

(3) The 31. In March 2011, the Agency issued a recommendation for the specifications for the infrastructure register, the procedure for the detection of the extent to which the basic parameters of the TSI are met on existing lines and on subsequent changes to the TSIs (CERA/REC/04-2011/INT).

(4) The 9. June 2011, in accordance with the opinion of the Committee, Article 29 (2). 1, in Directive 2008 /57/EC, a favourable opinion on the draft Commission ' s implementation decision on the European register of approved types of railway vehicles and the draft Commission ' s implementing decision on common specifications, the infrastructure register of railway undertakings. Following the adoption of two legislative acts based on these proposals, the Commission's implementation decision 2011 /633/EU of 15. September 2011 on the common specifications for the infrastructure register of railway undertakings 5) and the Commission's implementing decision 2011 /665/EC of 4. October 2011 on the European register of approved types of railway vehicles ; 6) , the applicable TSIs shall be updated to ensure the overall context.

(5) For practical reasons, it is preferable to amend a number of TSIs through a single Commission decision to carry out special corrections and updating of the acts. These corrections and updates are not due to the overall revision of the TSIs or the extension of their geographical scope.

(6) The following acts should therefore be amended as follows :

-WHAT? Commission Decision 2002/731/EC of 30. May 2002 on the technical specifications for interoperability of the subsystem ' control command and signalling " of the trans-European high-speed rail system, cf. Article 6 (1). 1, of Directive 96 /48/EC 7)

-WHAT? Commission Decision 2002/72/EC of 30. May 2002 on the technical specifications for interoperability of the infrastructure subsystem ' ; in the trans-European high-speed rail system, cf. Article 6 (1). 1, of Directive 96 /48/EC 8)

-WHAT? Commission Decision 2002/733/EC of 30. May 2002 on the technical specifications for interoperability of the subsystem ' electricity supply ' in the trans-European high-speed rail system, cf. Article 6 (1). 1, in Council Directive 96 /48/EC 9)

-WHAT? Commission Decision 2002/735/EC of 30. May 2002 on the technical specifications for interoperability of the rolling stock subsystem ' in the trans-European high-speed rail system, cf. Article 6 (1). 1, of Directive 96 /48/EC 10)

(7) Decision 2002/731/EC was repealed by Commission Decision 2006 /860/EC of 7. November 2006 concerning the technical specification for interoperability of the subsystem ' train control and signalling " in the trans-European high-speed rail network and amending Annex A to Decision 2006 /679/EC of 28. March 2006 on the technical specification for interoperability of the sub-system ' control command and signalling " of the trans-European conventional rail system 12) Decision 2002/732/EC was repealed by Commission Decision 2008 /217/EC of 20. In December 2007, on a technical specification for interoperability of the infrastructure subsystem in the trans-European high-speed rail system 13) Decision 2002/733/EC was repealed by Commission Decision 2008 /284/EC by 6. March 2008, on a technical specification for the interoperability of the energy subsystem for the trans-European high-speed rail system, 14) Decision 2002/735/EC was repealed by Commission Decision 2008 /232/EC of 21. February 2008, on a technical specification for interoperability of the rolling stock subsystem, in the trans-European high-speed rail system 15) Decision 2006 /66/EC was repealed by the Commission Decision 2011 /229/EU of 4. April 2011, on the technical specification for interoperability of the rolling stock-noise rolling stock-noise of the trans-European conventional rail system 16) .

(8) However, Decision 2 0 0 6 /8 6 0 / EC, 2008 /217/EC, 2008 /232/EC, 2008 /284/EC and 2011 /229/EU contains transitional provisions concerning the application of the decision which they are waiving as regards the continuation of projects approved in accordance with the TSI that are present as annexes to the said Decision, and projects relating to a new section of the line or renewal or modernisation of an existing line located at an advanced stage of development or to be covered by a contract under the execution of the contract ; the date of the communication of Decision 2006 /860/EC, Decision 2008 /217/EC, Decision 2008 /232/EC, Decision 2008 /284/EC and Decision 2011 /229/EU. Therefore, Decision 2 0 0 2 / 7 3 1 / EC, 2002 /72/EC, 2002 /733/EC, 2002 /735/EC and 2006 /66/EC will nevertheless be amended in accordance with this.

(9) The Committee referred to in Article 29 (1). 1, in Directive 2008 /57/EC, adopted at the meeting on 22. and 23. April 2004 to cancel the maintenance TSI that was adopted by Commission Decision 2002/730/EC 17) , and to transfer its contents to the other TSIs. Since then, the content of Decision 2002/730/EC has been included in the revised TSIs for high-speed trains published in 2006, which is why this decision should be repealed as far as clarity is concerned.

(10) The measures provided for in this Decision are in accordance with the opinion of the Committee referred to in Article 29 (3). 1, in Directive 2008 /57/EC,

DECIDUON THIS DECISION :

ARTICLE 1

The Annex to Decision 2002/731/EC is amended in accordance with Annex I to this Decision.

ARTICLE 2

The Annex to Decision 2002/72/EC is amended in accordance with Annex II to this Decision.

ARTICLE 3

The Annex to Decision 2002/733/EC is amended in accordance with Annex III to this Decision.

ARTICLE 4

The Annex to Decision 2002/735/EC shall be amended in accordance with Annex IV to this Decision.

Article 5

The Annex to Decision 2006 /66/EC shall be amended in accordance with Annex V to this Decision.

ARTICLE 6

Decision 2002/730/EC is repealed.

Article 7

This Decision shall apply from 24. January 2013.

ARTICLE 8

This Decision is addressed to the Member States.

ANNEX I

In the Annex to Decision 2002/731/EC (HS CCS-control-command and signalling TSI), the following changes shall be made :

1) Section 6.2 is amended as follows :

a) The third, fourth and fifth subparagraphs are deleted.

b) The following paragraph is replaced by the following :

' The certificate of verification for the on-board and trackside units is, together with the certificates of conformity, sufficient to ensure that a built-in unit can be operated with a lineside unit equipped with equivalent functions without a additional verification declaration for the subsystem. `

2) Section 7.2.1.4 is replaced by the following :

" 7.2.1.4. Registers

Information to be included in the information provided for in Articles 34 and 35 of Directive 2008 /57/EC of the European Parliament and of the Council [ * ] the registers referred to shall be specified in the Commission ' s implementation decision 2011 /633/EU of 15. ' railway undertakings responsible for installing one or more of these systems on their trains shall make contact with the Member State concerned. ` ;

b) Section 2 : Radio, the last paragraph of "INDEX", shall be replaced by the following :

'These systems are currently in use in Member States.'

6) Annex C is deleted.

in Annex E, the following amendments are amended as follows :

a) the second indent of the section ' Module SB (type-examination) `, subsection 3, sixth subparagraph, shall be replaced by the following :

'-the European register of approved vehicle types, including all indications as specified in the TSI; `.

b) The section ' Module SD (production quality assurance) ` shall be made as follows :

i) The second indent of sub-paragraph 6.2 is replaced by the following :

'-the infrastructure register, including all indications as specified in the TSI; `.

(ii) Subdivision 6.7, eighth indent is replaced by the following :

'-the infrastructure register, including all indications as specified in the TSI; `.

c) In the " Module SF (product verification) section, the following changes are made :

ANNEX II

In the Annex to Decision 2002/72/EC (HS INF TSI for infrastructure), the following changes are made :

1) Section 4.1.4 "Maximum load of track (parameter 4)", subsection of the paragraph, second indent, second indent, the second indent of the second indent shall be replaced by the following :

"The technical rules used for these lines are applicable."

Section 4.2.3.1.3 "Long tunnels", fourth paragraph, shall be replaced by the following :

' If platforms are built in specific zones in tunnels with a view to creating easy exit either for protected areas of security or to the nabis defined according to applicable national laws, their height must be between 550 and 760 mm for the purposes of : to ensure compatibility with access to the rolling stock. `

3) Section 4.2.3.2.3 "Exemption in the case of the execution of works", third subparagraph, second indent shall be replaced by the following :

" The railway undertakings operating on the track shall be informed of these temporary derogations, their geographical location, their species, and the means of signaling, by means of notifications, which, where required, describe the specifier ; type of signal used. "

4) Section 4.2.3.2.4 ' Paging for passengers in the event of a distance from the train outside of a station ', the second subparagraph shall be replaced by the following :

' existing lines designed for high speed shall be considered in parallel places at all places where this provision is reasonably capable of being implemented. Where sufficient space cannot be provided, both ends of the zone with limited movement shall be depicted on the ground, and railway undertakings shall be informed of this specific situation. '

5) Section 4.2.3.2.6 is deleted.

Section 4.3.1 ' The lines of wood specially built for high-speed lines shall be replaced by the following :

' Such requirements deviant from those required to achieve the basic performance of the network shall be used for each relevant parameter or interface in a uniform manner in each section of the high-speed line to be considered or is ; planning. "

Section 4.3.2 " Lines specially upgraded for the fifth subparagraph of the fifth paragraph are deleted ;

8) In Section 4.3.3.8a " Missing gauge on the field of free track and on the track marks of the switches and crossings, the following changes shall be made :

In the case of trains equipped with special mechanisms (e.g. courier management), the maximum value for cant deficiency must be determined for each interoperable line when applying the national legal provisions applicable to the type of person concerned ; train. The approval of these trains for entry into service shall be subject to the requirements of the rolling stock TSI. `

b) The sub-section ' Lines specially upgraded for high-speed and connecting lines ', fifth paragraph shall be replaced by the following :

' in the case of lines whose radios have been defined on the basis of the deficiency deficiency values in the table above, interoperable trains equipped with specific mechanisms (curvings management) are allowed to run with higher values for cant deficiency ; provided that the adoption of such values for these trains does not impose restrictions on other interoperable trains. In the case of trains equipped with special mechanisms (e.g. courier management), the maximum value for cant deficiency must be determined for each interoperable line when applying the national legal provisions applicable to the type of person concerned ; train. The approval of these trains for entry into service shall be subject to the requirements of the rolling stock TSI. `

c) The sub-section ' Slines specially constructed or upgraded for high-speed trains and having special characteristics of the third subparagraph shall be replaced by the following :

' in the case of lines whose radios have been defined on the basis of the deficiency deficiency values in the table above, interoperable trains equipped with specific mechanisms (curvings management) are allowed to run with higher values for cant deficiency ; provided that the adoption of such values for these trains does not impose restrictions on other interoperable trains. In the case of trains equipped with special mechanisms (e.g. courier management), the maximum value for cant deficiency must be determined for each interoperable line when applying the national legal provisions applicable to the type of person concerned ; train. The approval of these trains for entry into service shall be subject to the requirements of the rolling stock TSI. `

9) Section 4.3.3.21 "The resistance of the track, switches and crossings shall be replaced by the brake and acceleration forces", the second indent of the first subparagraph of the first subparagraph of the paragraph shall be replaced by the following :

" case 2 : in other braking cases, such as braking, for example. the speed limitation during normal operation or non-repetition or repetition of speed-regulation, use of the brake and the maximum authorized braking force until the publication of the corresponding European specification ; or CEN standard, is determined by the Infrastructure Manager for each interoperable line. ` ;

Section 4.3.3.23 " The second subparagraph of the side-effects of the second subparagraph shall be replaced by the following :

Each Member State shall define, for each interoperable line, the rules applicable to both vehicles and infrastructure in order to guarantee the stability of the vehicles when they are exposed to side winds. ` ;

Section 4.3.3.26 "Passenger platforms", subsection ' existing lines for high-speed trains, lines specially upgraded for high-speed and connecting lines ', third subparagraph shall be replaced by the following :

' If the existing conditions do not permit easy access for disabled passengers, the railway undertaking must provide assistance for disabled people and inform passengers about this. For example, these remedies may be :

-WHAT? mobile ramps for-and on-rise

-WHAT? "Praised Perrons."

Annex B, Table B. 1, Tenth Row " Infrastructure Register (4.2.3.2.6) are hereby deleted.

In Annex D, the following changes shall be amended as follows :

a) In Section D. 2.1. ' Detailed design of the overall structure of the entire construction and construction work ` shall be amended as follows :

i) the second subparagraph is replaced by the

' As a first step intended to allow for seamlessly verifications by the notified body, the adjudicating entity or the infrastructure manager shall draw up, and send to the latter, a verifications book for the person concerned, project that summarems information about the project definition of the planned subsystem to be part of the subsystem ' s technical file, as it appears at this stage of the definition, from the projection that has been the basis for Member State ' s decision to continue. This verification book shall describe in a separate chapter the elements to be imported into the 'infrastructure register' for the line concerned. ` ;

(ii) The sub-section of the infrastructure, distance of distance between track centres, lateral space, access and penetrations ', first indent, first and second subindentations shall be replaced by the following :

'-the structure gauge for each of the trails concerned, as it is a result of the choices made on the basis of the calculations based on the relevant European specifications or, until they are published, UIC folders 505-4 and 506, which are : specified in item 4.3.3 for the " structure gauge " (Section 4.3.3.1) where the calculations are to be attached to the drawings,

ANNEX III

In the Annex to Decision 2002/733/EC (HS ENE-energy TSI), the following changes are made :

1) Section 4.1.1 "Voltage and Frequency", the second subparagraph of paragraph 1 shall be replaced by the following :

" The voltage at the terminals of the distribution station and the pantograph shall comply with Annex N to this TSI. The frequency of the frequency shall comply with Annex N to this TSI. See the conformity assessment in Annex N, Section N. 4. `

2) In section 4.1.2.1 "The geometry of contact lines for AC systems", table 4.2, note 3 shall be deleted.

3) In section 4.1.2.2 " The geometry of the contact wire for DC systems ", Table 4.3, is deleted from Note 4.

4) Section 4.2.2.4 is replaced by the following :

" 4.2.2.4. Dynamic Vehicle Border

The design of the overhead contact line equipment shall comply with the dynamic framework of the vehicles. Which profile to use depends on how the line is defined. Conformity assessment shall be carried out in the energy subsystem. ` ;

Section 4.2.2.5 is replaced by the following :

" 4.2.2.5. Limitation of maximum power consumption

The installed power on high-speed lines and upgraded lines or connecting lines determines the permissible power consumption of the trains. To this end, power limiters must be fitted in the train as described in Annex O to this TSI. Conformity assessment shall be drawn up as part of the assessment of the rolling stock subsystem. ` ;

Section 4.2.2.8 "Electrification of Electric Protection", first subparagraph is replaced by the following :

' It is necessary to coordinate the electrical protection of spreading stations and of traction units in order to derivative short-end optimally. (The requirements used can be seen in Annex E to this TSI). `

7) In section 4.2.2.10 the following changes are made :

a) The third paragraph is deleted.

b) The sub-section " The requirements for the design of the energy subsystem ', third subparagraph, are deleted.

In Section 4.2.2.11, the following changes are made :

a) The section ' General ', third paragraph, shall be replaced by the following :

"The adjudicating entity must make this choice."

b) The subsection entitled ' The following requirements for the control-command and rolling stock ", the fourth subparagraph of the subsystem shall be deleted.

in the case of the execution of the construction worker ', third subparagraph, second indent, the following shall be replaced by the following :

" Whereas railway undertakings operating on the track shall be informed of these temporary derogations, their geographical location, their species and the means of signalling in written communications which describe the special type of signal that : are used. "

Section 4.2.3.5 is deleted.

The second subparagraph of Section 4.3.1.1 " The second subparagraph of the " installed effect " shall be replaced by the following :

' The adjudicating entity shall indicate the type of line in accordance with its function in accordance with Annex F to this TSI. The design of the electrification system shall ensure that the power supply is able to achieve the specified performance. That is why Section 4.2.2.5 is required for the limitation of the power consumption of the rolling stock subsystem. `

Section 4.3.1.4 "Regenerative braking", third paragraph, shall be replaced by the following :

"The adjudicating entity can determine whether regenerative braking is to be allowed on DC systems."

The first subparagraph of section 5.3.1.2 shall be replaced by the following :

" The power capacity depends on the conditions of the environment, i.e. maximum ambient temperature and lowest side rate speed, as well as the permitted temperature of the overhead and duration of the current action. The development of contact lines shall take into account the limits of the maximum temperatures as set out in Annex B to EN 50119, version 2001, in respect of data in EN 50 149, version 1999, paragraph 4.5, table 3 and 4. An analysis shall verify that the contact line can comply with the specified requirements. `

paragraph 14) Section 5.3.2.7 ` means the mean contact force and performance between the cooling release and the pantograph system `, fifth paragraph, shall be replaced by the following :

' The manufacturer of the pantographs shall take into account the changes to be made in the train between the three curves, such as the use of pantographs of 1950 mm or information on the voltage type of the overhead contact line. ` ;

Annex D is replaced by the following :

' ANNEX D

INFRASTRUCTURE REGISTER, INFORMATION ON THE SUBSYSTEM POWER SUPPLY

Information to be included in the information provided for in Articles 34 and 35 of Directive 2008 /57/EC of the European Parliament and of the Council [ * ] the registers referred to shall be specified in the Commission ' s implementation decision 2011 /633/EU of 15. ANNEX IV

In the Annex to Decision 2002/735/EC (HS RST-rolling stock TSI for rolling stock, high-speed trains), the following changes shall be made :

1) Section 4 " DESCRIPTION OF THE SUBSYSTEM ", third subparagraph of the introductable part of the introduction, shall be replaced by the following :

' The general properties of the rolling stock is defined in Section 4 of this TSI. ` ;

2) Section 4.1.1 "Maximum tracer power (BP4)", sub-paragraph a) Dynamic load, second indent, shall be replaced by the following :

"The technical rules used for these lines are applicable."

Section 4.1.2 " Axle pressure (GP 10) ", seventh subparagraph, second indent, second sentence shall be replaced by the following :

"The technical rules used for these lines are applicable."

4) Section 4.1.4 "Vehicle reference profile (BP12)", the second paragraph is replaced by the following :

' Election of the rolling stock profile shall be taken on the basis of the routes on which the rolling stock is to be at risk. ` ;

In Annex E, Table 2, the following note is deleted :

7) The following changes are made to Annex F :

a) The section ' Module SD (QUALITY SECURITY OF PRODUCTION) ` is hereby amended as follows :

i) Subsection 6.2, the ledgeable ' register of rolling stock, including all indications as specified in the TSI, shall be deleted.

(ii) Subsection 6.7, the register of the rolling stock register, including all indications as specified in the TSI, shall be deleted and in the preceding indent the word ' particularly ' shall be deleted ;

b) The section ' Module SF (PRODUCT WORKER) ` is hereby amended as follows :

i) Subdivision 5, the ledgeable ' register of rolling stock, including all indications as specified in the TSI, shall be deleted.

(ii) Subdivision 11, the register of the rolling stock register, including all indications as specified in the TSI, shall be deleted.

c) In the section ' Module SH2 (FULL QUALITY ASSURANCE) `, the ' register of the rolling stock subsection 6.7 shall be deleted, including all indications as specified in the TSI. `

1) Section 4.8.2 is replaced by the following :
