Publication of the depletion of waste from ships and platforms

In accordance with section 2 (2), 3, section 6 (4). 2, section 7, section 21, paragraph 1. 2, section 22, paragraph. 2 and 3, section 23, paragraph. 2, section 24, paragraph 1, and § 61 (3). 1, in the law on the protection of the marine environment, cf. Chapter 1

Scope of application

§ 1. This notice shall apply to all ships regardless of the size, cf. however, paragraph 1 3.

Paragraph 2. The notice shall also apply to platforms, cf. § 14.

Paragraph 3. However, the notice shall not apply to oro ships or other ships owned or used by a state as long as the ship is used exclusively for non-commercial statuses, cf. Section 2 (2) of the law. 2.

Paragraph 4. The notice is designed to take account of the Annex V of the MARPOL Convention.

Chapter 2

Definitions and so on

§ 2. For the purposes of this notice :

1) The MARPOL Convention : the International Convention of 1973/78 on the prevention of pollution from ships, including protocols and subsequent amendments.

2) Wastes : any foodstuff, household and ship-generated waste, plastic, lastreams, madooil, fishing gear and disks, which are carried out at the normal ship ' s normal operation, and which will be continuously or periodic disposed of. Waste not include oil, sewage, liquid substances transported in bulk, air emissions, and harmful substances transported at sea in packaged form, as defined or listed in the other supporting documents of the Annex. In addition, fresh fish shall not include fresh fish or parts thereof, resulting from fishing operations during the voyage when depletion is carried out on the same voyage where fishing took place. In addition, the fresh fish shall not include fresh fish, resulting from aquaculture activities involving the transport of fish, including shellfish, to the place of aquaculture and fish-catching fish, including shellfish, from such facilities and to ports ; processing when depletion is completed during the same voyage.

3) Food waste : any tainted or fresh raw materials, such as fruit, vegetables, milk products, poultry, meat products, and other scraps made on board ships.

4) Household wastes : any form of waste which appears in the areas of the ship, but does not include gray washwater. 5) Waste wastes : any kind of solid waste, including the suspension of waste which arises on board a ship at the ship ' s normal maintenance or operation, or used for the storage or handling of cargo. Waste wastes shall also include cleaning products and additives in washing water, whether they are used in the cargo hold or external surfaces. Waste waste does not include gray sewage, sewage or other similar discharge, which are necessary for the operation of a ship. Waste waste also does not include oil, sewage, liquid substances transported in bulk, air emissions, and harmful substances transported at sea in packaged form, as defined or listed in the other supporting documents of the Annex.

6) Plastic : any solid substance containing one or more high molecular polymers containing one or more high molecular polymers. 9) Fishing gear : any physical device, parts thereof or combinations of devices which may be placed on or in the sea or at the bottom of the sea with the aim of catching the salt water or peach emigration. Fishing equipment shall also include devices for the control of subsequent catches or the harvesting of salt water or peach emigration.

10) Animal beaver : the body of any animal on board the ship as cargo when the animal died or was killed in the ostfield.

§ 3. ' Special sea area ` means a sea area where it is necessary to introduce special mandatory rules in the field of the oceanographic and ecological conditions of the area in respect of the oceanographic and area of the area concerned and the specific traffic of the area in the area of the area concerned ; contamination of the sea of waste.

Paragraph 2. In this notice, the specific marine areas are defined as follows :

Chapter 3

Extraemption of waste outside of particular sea areas

§ 4. Exemption of waste outside of particular sea areas shall be prohibited, except in the case of the types of waste and under the conditions specified in section 5 to 8.

§ 5. The depletion of food waste must be carried out only while the ship is under way and the ship is at least 3 nautical miles from the nearest coast and if the food waste has passed through a finding or forming a formalering plant, cf. however, paragraph 1 3. such a body or formula of food waste must be able to pass through a sieve if the mesh size is not more than 25 mm.

Paragraph 2. Where the food waste has not been treated in accordance with paragraph 1, 1, the discharge must be carried out only when the ship is under way and at least 12 nautical miles from the nearest shore, cf. however, paragraph 1 3.

§ 6. Exemption of cargo residues which cannot be obtained using common available methods by losing may be carried out only while the ship is under way and at least 12 nautical miles from the nearest shore.

Paragraph 2. The cargo residues must not contain any substances that are harmful to the marine environment.

§ 7. Exemption of the animal carcasses must be carried out only while the ship is under way and must be carried out when the ship is as far away from the nearest coast as possible and where possible, while the ship is at least 100 nautical miles from the nearest coast.

§ 8. Cleaning agents and additives contained in the washwater of the ship ' s cargo hold, decks or external surfaces must be exhausted if these substances are not harmful to the marine environment.

Chapter 4

Extraemption of waste within special sea areas

§ 9. Exemption of waste within special sea areas shall be prohibited, except by the types of waste and under the conditions laid down in section 10-13.

§ 10. The depletion of food waste must be carried out only while the ship is under way and at least 12 nautical miles from the nearest coast or the nearest iskant, and if the food waste has passed through a finding or a formula to be used in accordance with a recovery or formalering plant, cf. however, paragraph 1 4. Paragraph 2. In the Antarctic sea area, the depletion of imported bird species, including poultry and parts thereof, must be used in addition to the products referred to in paragraph 1. 1 the conditions laid down shall be made only where the food waste is sterilised.

Paragraph 3. Food waste must not be mixed with any other waste.

Paragraph 4. However, the condition that the ship should be in the process shall not apply if the storage of the waste waste can lead to a health risk to the on-board and the discharge, in order to avoid such a risk.

§ 11. There must be a depletion of cargo residues which cannot be obtained by means of universal access by unloading when loading lists, including detergents and additives, are contained in the cargo water from the ship ' s cargo spaces and where the following conditions are : met :

1) the ship is under way and at least 12 nautical miles from the nearest coast or nearest iskant,

2) cargo residues, detergents and additives in the washing-water from the cargo hold must not contain substances that are harmful to the marine environment ;

3) both the port of departure and the port of arrival must be within the particular sea area and the ship shall not move outside the special sea area under the oils between these two ports ; and

4) there are not enough reception facilities for the cargo residues in question at the time of departure or airport.

§ 12. The following provisions shall apply in particular to the Antarctic sea area :

1) Danish ports from which ships sail to or from the Antarctic sea area must, as soon as practicable, have adequate reception facilities for the reception of waste from all ships, without causing any delay to the ships. Receive plants must be dimensioned in accordance with the needs of ships.

2) Every ship shall have sufficient capacity to hold all waste before entering the Antarctic sea area, while sailing in the Antarctic sea area and must have concluded that the waste can be delivered to a reception system after ; The ship has left the Antarctic sea area.

§ 13. Cleaning agents and additives contained in the washwater of the ship ' s decks or external surfaces may be depleted if these substances are not harmful to the marine environment.

Chapter 5

Exemption of wastes from rigs and so on

§ 14. Waste emptying is prohibited from fixed or liquid platforms, cf. however, paragraph 1 3.

Paragraph 2. The same applies to ships that are devved to or within a distance of 500 metres from such a platform.

Paragraph 3. Extraemption of food waste from fixed or liquid platforms and from ships subject to paragraph 1. However, two may occur if the platform is at least 12 nautical miles from the nearest coast and the waste has passed through a finder's or formalm. Such a body or formula of food waste must be able to pass through a sieve if the mesh size is not more than 25 mm.

Chapter 6

Other provisions

§ 15. Where the discharge is carried out and the waste is mixed with other substances or materials covered by the law on which different provisions apply to discharge, the strictest provisions must be followed.

Chapter 7

Exclusions

§ 16. The prohibition of the waste discharge of waste shall not apply to :

1) the possible loss of fishing gear, provided that all reasonable precautions have been observed in order to avoid such a loss ;

2) the dumping of fishing gear, which is provided for in the interests of the protection of the marine environment or for the safety of the ship or the crew, and

3) The exceptions are listed in section 58 of the law.

Chapter 8

Punishment

§ 17. Unless higher penalties have been inflited on the other legislation, the penalty shall be punished by fine ;

1) the discharge of waste in breach of section 4, section 5 (5). One and two, section 6-9, section 10, section 10. 1, 2, and 3, section 11, sections 13 to 14,

2) violation section 12, or

3) is breaching section 15.

Paragraph 2. The sentence may rise to prison for two years if the infringement has been committed intentionally or by gross negligence and if there is a breach of the infringement proceedings ;

1) damage to the environment or to the detriment of the environment, or

2) obtained or intended for the economic benefit of the person concerned itself or others, including in the case of savings.

Paragraph 3. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

Paragraph 4. Paragraph 2 shall not apply to infringements committed by foreign ships, unless the offence has been committed in the territory of the internal territorial waters. For offences committed by foreign ships in the outer territorial waters, the sentence may rise to prison for up to two years if deliberate and serious pollution of the marine environment is intentional and serious.

Chapter 9

Entry into force

§ 18. This notice shall enter into force on 1. February, 2013.

Paragraph 2. Publication no. 269 of 18. April 2008 on the depletion of waste from ships and platforms is lifted.

Paragraph 3. Publication no. 534 of 21. June 1992 on the depletion of waste from ships and so on, which has been put into force for Greenland at device number. 1012 of 14.
