Publication of the obligations of the project and the duties of the project, etc., in the field of work environment ; 1)

In accordance with section 35, cf. ~ § 33 and 34, section 73, 1. Act. and section 84, in the working environment, cf. Law Order no. Seventy-seven of seven. September 2010 shall be determined :

Chapter 1

Area and Definitions

§ 1. The notice shall comprise any project that provides the direct basis for :

1) Execution, extension, demolition, change, repair, or maintenance of a construction work.

2) Execution, expansion, change, repair, maintenance and demolition of a production plant.

3) Direction, extension, dismantling, change, repair or maintenance of a technical assistance.

4) Manufacture, use or modification of substances and materials which may be hazardous to, or incidentally, low-level security or health, or process, resulting in a by-product or the occurrence of such substances and materials.

§ 2. The commuting shall also include advice on a specific relationship that affects the working environment within the areas referred to in Section 1.

Paragraph 2. For the purposes of advice, the notice, a statement or declaration on matters of concern to safety and health, expressed at the invitation and for remuneration.

§ 3. The obligations under the notice shall be the responsibility of the undertaking providing a project that provides the direct basis for the implementation of the projects referred to in Section 1.

Paragraph 2. The obligations under the notice shall also be borne by the adviser on matters of concern to the working environment.

Paragraph 3. The obligations under the notice shall also be borne by companies which, for their own use, provide a project which shall constitute the direct basis for the projects referred to in Section 1, or advising on matters of concern to the working environment.

§ 4. If multiple projection delivers a project, each person is responsible for its part of the project.

Paragraph 2. Where there are several projects, each project must help ensure that any interfaces to projects or projects to which other projects are responsible are set up in such a way as to ensure that compliance with this notice is also respected ; will be detected in the interfaces.

Paragraph 3. A projecting that allows parts of a project to project at others must ensure that the overall project fulfils the provisions of the notice.

Paragraph 4. Chapter 2

Duties of the projectable

§ 6. The projection of a construction work must, with its endorses in the project, ensure compliance with the rules of the work environment legislation in the context of the implementation of the project and the maintenance of the project carried out.

Paragraph 2. The project in connection with the study and preparation of a project to build and construction work shall take into account the general principles of the prevention of security and health referred to in Annex 2, in particular :

1) in the context of architectural, technical and / or organizational choices for the planning of the various works or work phases that must be carried out simultaneously or after each other, and

2) during the assessment of the period to be allocated to the performance of the various works or work phases.

Paragraph 3. On the basis of the evaluation referred to in paragraph 1 the projection of a construction work shall be specified in the project, in the interests of the safety and health of the work processes, working methods, materials, constructs and so on which are prescribed, or which are predefined ; the organisation of the individual works or working phases in relation to each other, so that the work may be fully justifiable in the field of safety and health.

Paragraph 4. The projection of a construction work must ensure that the developer's coordinators for safety and health during the preparation of the building project, cf. the notice of the obligations of the developer shall be forfeit in the deliberations of the project and shall be given access to the relevant parts of the project material as referred to in paragraph 1. ONE-THREE. Coordinator must be included when the design of the developer is started and then to the extent necessary during the project.

Paragraph 5. The projection of a technical aid or a production plant must ensure, in the project, that the rules of the working environment legislation can be complied with during the implementation of the project, the finished product and take into account ; foreseeable risks associated with its operation.

Paragraph 6. The projection shall take account of the directions that come from the developer's coordinator.

§ 7. The projection required by the project in the project must ensure that suitable technical aids can be used in the handling of loads during the implementation of the project and the maintenance of the project completed if a manual handling of The burden is a danger to safety and to health.

§ 8. Paragraph 2. § 11. The developer of a project to build or plant work shall inform the developer of its obligations under the work environment legislation relating to the expected character and scope of the project.

§ 12. The project providing a project to build or plant work shall, as part of the project, provide a description of the characteristics of the building or plant (design, design, prescribed materials, etc.) to the extent that it is important ; in the case of safety and health, by working on the maintenance or repair of the building or facilities concerned. The description shall include, in particular, a list of the special conditions to be observed in relation to the safety and health of such future works.

Paragraph 2. Chapter 3

Pensation and appeal

§ 13. The Director of the Health Safety Board may, where special circumstances exist, authorise deviations from the provisions of this notice, where it is deemed reasonable and fully justified and to the extent that it is compatible with Commission Directive 92 /57/EEC of 24. June 1992 laying down minimum requirements for safety and health on temporary or mobile construction sites.

§ 14. The decisions of the labor force following this notice may be subject to section 81 law of work environment.

Chapter 4

Punishment

§ 15. Unless higher penalties have been inflited on the law on working life or other legislation, penalty of fine or imprisonment shall be punishable for two years :

1) Clause section 4, section 6-12.

2) Do not comply with the notice issued in accordance with the notice.

Chapter 5

Entry into force

§ 16. The announcement shall enter into force on the 15th. February, 2013.

Appendix 1

List of special risks and other special conditions

Special risks

1) Work involving particularly serious risk of being buried is to sink or to crash, because of the nature of the activities or the work of work or construction, or because of the nature of the work or construction.

2) Work, which exposes the workers of chemical or biological substances and materials, which either constitute a particular hazard to the safety and health of workers, or where there is a risk of discharges or of a health inspection call for health checks.

4) Work near high voltage power lines.

5) Work that poses danger of drowning.

8) Work under water for which diver equipment is used.

9) Work in a pressure chamber.

10) Work, which involves the use of explosives.

11) Work under conditions where there is a risk of explosion, by the way.

12) The dismantling and dismantling of heavy prefabricated elements.

13) Manufacturing plants in which or can be developed substances and materials which may pose a fire or explosion hazard.

14) Manufacturing plants, which are used or capable of developing substances and materials that are hazardous to health.

Other Special features

Appendix 2

General prevention principles

1) Prevention of risks.

2) Evaluation of risks that cannot be prevented.

3) Combating hazards at source.

4) Adaptation of the work to man, in particular as regards the design of the workplace and the choice of work equipment and work and production methods, in particular with a view to limiting monotonous work and work in a given rhythm and that : reduce the impact of such work on the health.
