Publication of the calculation and payment of tax and subsidies under the law of apothecary activities

In accordance with section 49, 52, 53, paragraph 1. 1, and section 71 b (b), 1, in the case of apothecary, cf. Law Order no. 855 of 4. August 2008, as amended by law no. 465 of 18. May 2011 :

Chapter 1

Scope of application

§ 1. The notice shall apply to persons who have been authorised by the Board of Health to operate one or more pharmacies of the section 15 of the apothecary.

Chapter 2

Equation

§ 2. The turnover that provides the basis for the calculation of ordinary charges and grants under Article 49 of the apothecary shall be calculated as the pharmacist of the apocalypse :

1) apothecary reserved medicinal products for which the register price is calculated in accordance with section 2 (2). 1, in the notice of the calculation of consumer prices and so on on medicinal products, and

2) prescribed dose-speed charges, deducted from the rebate expenses provided for in the case of point (s). One and two, the amounts are being carried out exoc. VAT.

Paragraph 2. For apothecaries, pursuant to Article 12 (1) of the apothecary. 3, approved for the establishment of package action for the purpose of trade in dosed medicinal products for other pharmacies, shall be taken into account for the placing on the market of medicinal products, including the time being. dose shall not be made in the case of a dose fee, in the case of trade in the balance of goods in accordance with paragraph 1. 1.

Paragraph 3. In the case of the negotiation of dose-dispensed medicinal products for the consumer, cf. The Article 11 (1) of the apothecary. 1, no. 10, do not include dosispacation charges not in the statement of the turnover in accordance with paragraph 1. 1.

§ 3. The Minister for Health and Prevention is setting a limit for payment of ordinary tax and subsidy.

Paragraph 2. The threshold for the payment of ordinary charges and grants has been set at 39.500,000 kr.

Paragraph 3. Apotees whose turnover, cf. § 2, in a calendar year exceeds the threshold limit, cf. paragraph 2, the State shall pay a provisional turnover tax of 3.6% of the difference.

Paragraph 4. To apothecary, if turnover, cf. § 2, in a calendar year is less than the threshold limit, cf. paragraph 2, the State shall pay a provisional statement of sales of 3.9% of the difference in the difference, cf. however, paragraph 1 Five and six.

Paragraph 5. In the case of pharmacies referred to in Annex 1, no provision shall be made from the State.

Paragraph 6. For apothecaries authorised to operate an additional unit listed in Annex 1, the cardboard grants shall be granted only on the basis of turnover in accordance with paragraph 1. 4 and 7. 7.

Paragraph 7. For apothecaries authorised to operate one or more pharmacies of the section 15 (3) of the apothecary, 2, the levy shall be calculated on the basis of the total turnover of the pharmacies to which the apothecary has authorization, in accordance with the rules laid down in paragraph 1. 3-6.

Paragraph 8. The minister for health and prevention shall determine and communicate to the pharmacies of January the final percentages for the previous calendar year of the final percentage for the payment of sales tax and grants referred to in paragraph 1. 3 and 4, as well as the final amount referred to in paragraph 1. The final tax and subsidy rates as well as the limit shall be determined in such a way as to provide for the total payment of the apothecary and the total amount of the State aid.

Chapter 3

The pharmacist system ' s pension scheme and sector charges

§ 4. The turnover that provides the basis for the calculation of levies to the pharmacist system's pension scheme and sector fees, cf. Section 5-6, opuled as the gross turnover of the apocalypse, excluding. the placing on the market of medicinal products for the production of animals, deduced payment of rebate expenditure and losses to outstanding debts. The amounts are being taken off-the-track. VAT.

Paragraph 2. For apothecaries authorised to operate one or more pharmacies of the section 15 (3) of the apothecary, 2, shall be calculated in accordance with paragraph 1 1 the charge to the apothecary ' s Pension Scheme and the sector charges on the basis of the total turnover of the pharmacies to which the apothecary has authorization.

Paragraph 3. For apothecaries, pursuant to Article 12 (1) of the apothecary. 3, approved for the establishment of package action for the purposes of trade in doses dispensed medicinal products to other pharmacies, shall not include the circulation of medicinal products for the purposes of such trade not in the statement of the turnover in accordance with paragraph 1. 1., however, the dose fee shall be included in the statement of the conversion of the turnover in accordance with paragraph 1. 1.

Paragraph 4. In the case of the negotiation of dose-dispensed medicinal products for the consumer, cf. The Article 11 (1) of the apothecary. 1, no. 10, do not include dosispacation charges not in the case of the circulation of turnover in accordance with paragraph 1. 1.

§ 5. The pharmacy shall pay the State a charge to the pharmacist's pension scheme for provisional 1.719% of the turnover, cf. § 4, stk.1.

Paragraph 2. The Minister for Health and Prevention of Prevention shall lay down and notify the pharmacies of January for the final rate referred to in paragraph 1 in January of the preceding calendar year. The final rate of duty shall be determined in such a way as to provide for the total payment of the charges referred to in paragraph 1 of the apothecary. 1, and the total payments by the State to the pharmacist system ' s pension scheme.

§ 6. Sector charges include payments to reimbursements for additional units, cf. Article 15 (3) of the apothecary. 2, apothecary allowances, apothecary allowances, fee fees, exceptional grants and replacements, cf. The administration of the apothecary of the apothecary, section 51 and section 70, health management, transport of electronic prescriptions, the training of pharmacies, certificates in accordance with Article 75 of the Schengen Convention, the expedition of dose-dispensed medicinal products, creditor ' s creditor ' s creditor system and accreditation to the Danish Quality Model.

Paragraph 2. The chemist shall pay the State a charge to reimbursements for additional units, cf. Article 15 (3) of the apothecary. 2, at a provisional 0,105% of the turnover, cf. Section 4 (4). 1.

Paragraph 3. The pharmacy shall pay the State a charge to the apothecary allowance for provisional 0,341% of the turnover, cf. Section 4 (4). 1.

Paragraph 4. The pharmacy shall pay the State a charge to the apothecary allowance for provisional 0,081% of the turnover, cf. Section 4 (4). 1.

Paragraph 5. The Pharmacy pays to the State a charge for the fee for the pharmacist watchdog of the provisional 0,473% of the turnover, cf. Section 4 (4). 1.

Paragraph 6. The chemist pays the State a charge of extraordinary grants and compensation, cf. The apothecary Act, section 19, § 51 and § 70, of the provisional 0,059% of the turnover, cf. Section 4 (4). 1.

Paragraph 7. The Pharmacy pays to the State a charge for the administration of the Health Management Administration for a provisional 0,065% of the turnover, cf. Section 4 (4). 1.

Paragraph 8. The pharmacy shall pay the State a charge on the cost of transport of electronic prescriptions for the provisional 0,015% of the turnover, cf. Section 4 (4). 1.

Niner. 9. The Pharmacy pays to the State a levy for the training of farm finance for the provisional 0,515% of the turnover, cf. Section 4 (4). 1.

Paragraph 10. The Pharmacy pays the State a tax to be used for the reimbursement of pharmacofinance students at provisional 0,216% of the turnover, cf. Section 4 (4). 1.

Paragraph 11. The pharmacy shall pay the State a charge to the credit for the preparation of attestations pursuant to Article 75 of the Schengen Convention for the provisional 0,020% of the turnover, cf. Section 4 (4). 1.

Nock. 12. The Pharmacy pays the State a charge to reimbursements for the expedition of dose dispensed medicinal products for the provisional 0,090% of the turnover, cf. Section 4 (4). 1.

Paragraph 13. The pharmacy shall pay the State a charge to the credit system for the grant of cranes for provisional 0.049% of the turnover, cf. Section 4 (4). 1.

Paragraph 14. The pharmacy shall pay the State a charge to use the accreditation of the pharmacies following the Danske Quality Model of the provisional 0,114% of the turnover, cf. Section 4 (4). 1.

Paragraph 15. The Minister for Health and Prevention shall lay down and notify the pharmacies of January the final rates for the preceding calendar year in respect of the charges referred to in paragraph 1. 2-13. The final rates of duty shall be determined in such a way as to ensure that there is a consensus between the total payments of the apothecary, as referred to in paragraph 1. 2-14, and the total payments made by the State to reimbursements and subsidies in section 9-24.

Chapter 4

Other charges

§ 7. The turnover that provides the basis for the calculation of the tax to reimbursements for the expedition of prescription medicinal products is to be calculated as the gross free movement of goods by the apocalypse. The amount shall be discharged in the first place. VAT.

Paragraph 2. For apothecaries authorised to operate one or more pharmacies of the section 15 (3) of the apothecary, 2, shall be calculated in accordance with paragraph 1 Paragraph 1 shall, on the basis of the total turnover of the pharmacies to which the apothecary has authorization.

§ 8. The pharmacy shall pay the State a charge to reimbursements for the expedition of prescription-only medicinal products for the time being 2,133% of the turnover of free trade goods, cf. Section 7 (2). 1.

Paragraph 2. The Minister for Health and Prevention of Prevention shall lay down and notify the pharmacies of January for the final rate referred to in paragraph 1 in January of the preceding calendar year. The final rate of duty shall be determined in such a way as to provide for the total payment of the charges referred to in paragraph 1 of the apothecary. 1 and the total payments made by the State for the expedition of prescription-only pharmacies as referred to in section 25.

Chapter 5

Deposits and allowances

§ 9. For each additional unit, cf. Article 15 (3) of the apothecary. 2 that is associated with the pharmacy shall be awarded by the following amounts per Years. , cf. however, paragraph 1 2 :

1) In the mount wound, 1,479,000 kr. per Years.

2) 1. years after the association : 1,317,000 kr. per Years.

3) 2 years after the association : 1,157,000 kr. per Years.

4) 3 years after the association : 994,000 kr. per Years.

5) 4 years after the association : 834,000 kr. per Years.

6) 5 years after the association : 673000 kr. per Years.

Paragraph 2. For apothecaries who, after the apothecary Act, section 15, paragraph. 2, the authorization shall be granted to operate one or more pharmacies covered by it in section 3 (3). The aid referred to in Annex 1 shall be awarded to 5 in 2010 and in the following year grants as a pharmacist branch, cf. § 10.

§ 10. For each chemist branch affiliated to the pharmacy, a grant of DKK 512 000 is granted. per Years.

§ 11. For each apothecal sale associated with the pharmacy, a subsidy shall be awarded on 72,000 kr. per Years.

§ 12. To apothecary, watchdog, cf. notice of the hours of notice and watchkeeping of the apothecary, including supporting documents, are given to a list in pharmacies (fattest rates), and a fixed subsidy, on the one hand, an activity-dependent supplement as the number of prescription spec available in the vagary.

Paragraph 2. The flat-rate supplement is 5K DKK. a year.

Paragraph 3. The activity-dependent grant shall be allocated in accordance with the amount of the on-call time available in the watchful as follows :

1) For the number of receptive speedis up to 25 000 a year, a grant of 1,450,000 per year shall be granted. a year.

2) For the number of receptive speds in the range of 25,001-40,000 per year, a grant of 1,425 000 DKK a year.

3) For the number of receptive speds in the range of 40.001-45,000 each year, a grant of 1,375,000 DKK is eligible. a year.

4) For the number of receptive speds in the range 45,001-50,000 per year, a grant of 1,275,000 DKK is eligible. a year.

5) For the number of prescription speditions in the range 50.001-55,000 a year, a grant of 1,225 000 DKK a year.

6) For the number of prescription spec available at 55,000 per annis, a grant of 1 000 DKK is eligible. a year.

Paragraph 4. The number of receptive spec in the Medicinal Products Register of the year before provides the basis for the positioning and payment of the monthly list of provisional grants to the pharmacies of the apothecary. Finally, the calculation of subsidies is carried out at the same time as a financial settlement in accordance with the annual accounts, cf. also Chapter 7 on the calculation of fees and subsidies.

§ 13. To apothecary, watchdog, cf. notice of the opening hours of the apothecary and watchkeeping, including annexes, shall be given to list II apothecary of the following grants :

Paragraph 2. To one pharmacy in a town referred to in list II, cf. Annexes to the notice of the opening hours of the apothecary and the watchdog shall be granted a grant of 168 000 kr. per Years.

Paragraph 3. If several apothecaries in a town referred to in a list of II attend to the watchdog, including call watchdog, cf. notice of the opening hours of the apothecary and the watchdog section 8 (3). paragraph 3, section 9. 2 as well as section 10, the proceeds shall be proportionate between the pharmacies.

§ 14. To apothecary, watchdog, cf. notice of the opening hours of the apothecary and watchdog, including annexes, are given to list III, a, apothecary of the following grants :

Paragraph 2. To one pharmacy in a town named in list III, a, cf. Annexes to the notice of the opening hours of the apothecary and the watchdog shall be eligible for a grant of 1,404,000 kr. per Years including call watchdog.

Paragraph 3. If several apothecaries in a town referred to in a list of III, a are responsible for the watchdog, including call watchdog, cf. notice of the opening hours of the apothecary and the watchdog section 8 (3). paragraph 3, section 9. 2 as well as section 10, the proceeds shall be proportionate between the pharmacies.

§ 15. To apothecary, watchdog, cf. notice of the opening hours of the apothecary and watchdog, including annexes, are given to list III, b, apothecary of the following grants :

Paragraph 2. To one pharmacy in a town named in list III, b, cf. Annexes to the notice of the opening hours of the apothecary and the watchdog shall be granted a subsidy on 792000 kr. per Years including call watchdog.

Paragraph 3. If several apothecaries in a town referred to in a list of III, b, provide watchdog, including call duty duty, cf. notice of the opening hours of the apothecary and the watchdog section 8 (3). paragraph 3, section 9. 2 as well as section 10, the proceeds shall be proportionate between the pharmacies.

§ 16. To apothecary, watchdog, cf. notice of the opening hours of the apothecary and watchdog, including annexes, shall be given to list III, c, apothecary of the following grants :

Paragraph 2. To one pharmacy in a town named in list III, c, cf. Annexes to the notice of the opening hours of the apothecary and the watchdog shall be eligible for a grant of DKK 575,000 DKK per Years.

Paragraph 3. If several apothecaries in a town referred to in a list of III, c, attend to the watchdog, including call duty duty, cf. notice of the opening hours of the apothecary and the watchdog section 8 (3). paragraph 3, section 9. 2 as well as section 10, the proceeds shall be proportionate between the pharmacies.

§ 17. Exceptional supplements and replacements, cf. The apothecary Act, section 19, § 51 and section 70, shall be granted on the basis of actual costs, application and practical assessment.

Paragraph 2. The Board of Health shall award criteria, procedure and application time limits for exceptional grants following the Article 51 of the apothecary.

§ 18. The Board of Health shall receive compensation for the surveillance and administration of the board, as well as the costs of covering the transport of electronic prescriptions, cf. The apothecary Act, section 71b.

§ 19. To the Pharmakon responsible for the pharmaceconomy training, cf. The announcement of pharmac-economic education shall be paid annually.

Paragraph 2. The Board of Health shall pay the annual contribution of EUR 50,7 million. DKK Months of the same high rates.

20. To apothecary, authorizing the authorization to operate one or more pharmacies of the section 15 (3) of the apothecary. 1 and 2, which are hiring pharmacalumas, shall be granted a grant.

Paragraph 2. The amount of the subsidy depends on how far the student is in training, so,

1) there is for 1. the year ever grants a grant of 60 000 kr. per pupil per. the year at which the year is calculated from 1. September to 31. August,

2) there's for two. the year ever grants a grant of DKK 36,000. per pupil per. the year at which the year is calculated from 1. September to the 31. August, and

3) that for 3. the year ever grants a grant of 24,000 kr. per pupil per. the year at which the year is calculated from 1. September to the 31. August.

§ 21. In the case of the establishment of certificates pursuant to Article 75 of the Schengen Agreement, the certified statement shall be paid for each completed certificate of 50 kr. excl. VAT.

§ 22. For the expedition of dosisdispensed medicinal products, a subsidy of 3 kr is granted. excl. VAT per expedition, as well as the fee payable by the pharmaceutical user.

-23. For the purpose of covering the cost of the pharmacies for the administration and interest-related costs of the credit system for crankhouse appropriations, a grant of DKK 30 kr is payable. excl. VAT per a patient with a chronic grant per. Month.

Paragraph 2. In the case of compensation for losses of debts owed by the creditor system in the case of cranes, the pharmacy has not been notified to the Health Services, when the pharmacy has moved the medicine user at least twice.

§ 24. The accreditation of the pharmacies shall be paid a yearly contribution to the ICAS responsible for the Danish Quality Model.

Paragraph 2. The contribution relates to a flat-rate contribution, an activity-specific payment, and an amount of training and updating of surveyors, including in relation to changing quality standards.

Paragraph 3. NHS will make the payment to IKAS.

Paragraph 4. For the cost of the pharmacist for accreditation according to the Danish Quality Model, which takes place every 3. Year, grant a grant of 100 000 cages when accreditation or accreditation have taken place.

Chapter 6

Other grants

§ 25. For each prescription medicinal packaging, the dispensary of the dispensary of the pharmacy and associated additional units, cf. Article 15 (3) of the apothecary. 2, apothecary branches and apothecal sale shall be awarded in the case of a grant of 50 cents, cf. however, paragraph 1 2.

Paragraph 2. Conducion medicinal products are not paid for the production of medicinal products intended for production.

Chapter 7

Afretion of Tax and Supplements

SECTION 26. In the case of preliminary charges referred to in section 3-8, monthly payments shall be payable on the basis of the turnover of the apothecary in the previous part of the year as specified in section 2, sections 4 and section 7.

Paragraph 2. In the event of the transfer of the year, a tax on off-front apothecary shall be calculated and taken into account for the applicable provisional rates. However, if the holder has been replaced by the end of the year, duties shall be discharged at last.

Paragraph 3. In the case of the holder of the year, charges for the new holder on the basis of the changeover are calculated on the basis of the conversion of the holder.

Paragraph 4. For the purposes of calculating provisional duties, the apothecary shall report to the Board of Health for business and so forth, cf. sections 2, sections 4 and section 7, in the pharmacy and associated additional units, cf. Article 15 (3) of the apothecary. 2, apothecary branches and apothecary elk for the previous month or period specified by the Board of Health. The report shall be made by the health department by the Board of Health at the latest by 5. in the following month. § 27. The payment of grants is monthly.

Paragraph 2. In the case of the holder of the year, the grant for the new holder on the basis of information shall be calculated according to the change of the holder.

Paragraph 3. For use in the calculation of grants, the pharmacies must report information to the Board of Health in the case of turnover and other activity information in the pharmacy and associated additional units, cf. Article 15 (3) of the apothecary. 2, apothecary branches and apothecary elk for the previous month or period specified by the Board of Health. The report shall be made by the health department by the Board of Health at the latest by 5. in the following month, cf. Section 26 (1). 4.

Paragraph 4. Supplements in accordance with section 20, section 23 (4). 2 as well as section 24 (4). 4 the subsidy shall be paid on the basis of reported information from the pharmacist to the Health Care Board. The subsidy will come to the payment from the Board of Health at the latest by 15. in the following month or in exceptional cases, at a time of health at the time of the Health Services.

§ 28. On the basis of the reported information on the payment of the tax and the grant of grants, cf. ~ § 26-27, the apothecary shall receive the pharmacy with attached additional units, cf. Article 15 (3) of the apothecary. 2, apothecary branches and apothecary alg, about the 15th. in the following month, a total account of the payment of the charges and received subsidies.

Paragraph 2. Pharmacies, where the levy exceeds received subsidies, shall pay the amount on one of the Health Services set date around the 15th. in the following month or in exceptional cases, at a time of health at the time of the Health Services.

Paragraph 3. An apothecary, where the grants exceed the tax, shall receive the amount from the Board of Health at the latest by 15. in the following month or in exceptional cases, at a time of health at the time of the Health Services.

§ 29. Finally, the calculation of taxes and subsidies for a financial year shall be made simultaneously with the submission of annual accounts for the year in question. In the event of the transfer of the year, the charge and subsidy shall be paid for the elapsed period during the submission of the annual accounts for the period in question.

Paragraph 2. For the time being paid for the provisional charge or too highly received a provisional grant, the Board of Health shall be paid no later than two months after the submission of the annual accounts.

Paragraph 3. For a very long-time charge or a provisional grant, a grant may be shown from the Board of Health at the latest two months after the receipt of the annual accounts.

Chapter 8

Entry into force

-$30. The announcement shall enter into force on the 18-1. March, 2013.

Paragraph 2. The notice shall take effect on the calculation and payment of fees and grants from and from January 2013.

Paragraph 3. Publication no. 169 of 20. February 2012 on the calculation and payment of tax and subsidies under the 'apothecary company' is hereby repealed.
