Order on seat grain1)

Pursuant to section 1-4, Section 3(1), and Section 4(2) of Regulation (EC) No 195 of 12 March 2009,:

§ 1. A party grain of a kind referred to in Annex 2 shall only be sold as grains for seeding after the rules of this notice.

Substances. 2. The provisions on sale also apply to the sale, sale, distribution, delivery and other form of transfer to or without any remuneration.

3. Notwithstanding paragraph 1 and 2, the notice does not apply to

1) supply of cereals for official control, testing and examination,

2) delivery of grains for processing or packing provided that the recipient does not obtain ownership to the grain, and

3) 3) sale of grain for breeding of plants for decoration purposes.

4. The states referred to in Annex 10 to this notice are approved by the Council of the European Union, which are equal to a Member State. Please refer to the Council Decision No 2003/17/EC with subsequent changes.

Registration of companies

§ 2. A company with the seat here in the country that produces and resort grains or leads the seat grain into the country for sale must be registered in the Danish Nature Agency.

Substances. 2. If a registered company owns or is the company no longer required by paragraph 1, the Danish Agency shall be notified in writing.

3. A registered company must conduct accounting of purchases, holdings and sale of seat grains. The account must contain information about quantity, reference or breeding batch number for incoming and outgoing parties as well as on the sender and receiving of these. The account must be kept for at least three years.

4. The control may terminate a company's registration if the company has no later than 30 days after claim has paid due fees according to the notice of payment for control, etc. with seed and seat grains.

5. (1) 1-4 does not apply to a company that buys the brand and sealed seat grains in the country and sells it without breaking the seal.

Legislation

§ 3. The company shall be based on a written contract between the breeder and a registered company.

Substances. 2. (1) 1 does not apply to breeding in areas owned or used by a registered company.

§ 4. For the breeding of seat grains that wish approved for certification must be applied to an issue that meets the conditions laid down in paragraph 2 and 3.

Substances. 2. The party must be of a black

1) is admitted to the Danish variety list, in accordance with the announcement of a list of approved varieties of agricultural plant and vegetable species (sorts list), or

2) is admitted to the European Community common variety list, or

3) 3) was reviewed for admission to the Danish variety list and the black is recorded before the breed is notified to final certification, or

4) is permitted in a state that is not a member of the European Union, provided that the breed must be carried out to this State.

3. 2 applies only to varieties (ingrown lines and hybrids) which are only to be used as components in hybrid varieties, if the seed of the blacks must be sold with the indication of the variety name.

4. The committee shall be certified as a pre- basis, basic grain or, for other species than rye, as certified seat grain 1th generation, cf. section 16.

5. No. 4 may a party foreseeable material, in accordance with Section 16(1)(a) of Section 16 of Section 16(1) of Article 16(1) of the Danish Nature Agency shall be used for breeding, if the party is produced on the responsibility of the owner or its representative and its variety characteristics correspond to the variety description. §§ 9-12 is equivalent.

§ 5. A party not produced here in the country shall comply with the conditions laid down in Section 4 and Section 12(1) and 3 of Section 12(1) and shall be notified to the Danish Nature Agency before submitting.

Substances. 2. Review of a party produced in a state if the production of seed by decision of the Council of the European Union is approved as equal to the production of seed in a Member State, and lots of varieties (ingrown lines and hybrids) which are only to be used as components in hybrid varieties must be accompanied by the original label of the party or a copy thereof.

3. The provisions of Section 31 shall apply.

Break control

§ 6. An area with cereals wished to be certified must be considered in the growth season to control the breeding standards of Annex 3 complied with.

Substances. 2. Review for breeding control must be submitted to the Danish Nature Agency and can only be submitted by a registered company.

3. The review must only include one breeder, one species, one black and one category and must only include several areas if these are within a radius of 3 km.

4. An area with winter grain must be reported to breeding control by 1 February and an area with the age of 1st. Reviews received after 1 July are rejected.

§ 7. The threshold must be made by the fields of the NaturErhvervstyrelsen.

Substances. 2. Regardless of paragraph 1, the breeding control of seat grain can be carried out by persons authorised by the Danish Agency in accordance with the provisions of Annex 4, Part I.

3. The inspection shall inform the written notice of the result of the breeding control. In the case of cassation, the cause is provided.

Partial control

§ 8. The Danish Medicines Agency shall apply upon request from a registered company samples of a party derived from approved areas, and as agtes notified to certification, to examine whether the Party complies with the quality standards of Annex 5.

Substances. 2. Notwithstanding paragraph 1, the samples may be deducted by a sampler authorised by the Danish Agency pursuant to the provisions of Annex 4, Part II when the sampling takes place in a company or department authorised by the provisions of Annex 4, Part III.

3. The company must ensure that official analyses are carried out in accordance with Section 39. The company must send the analysis result within 3 months after the date of sampling. All costs for sampling and analysis are held by the company.

Section 9. The sampling must be carried out after applicable international rules and in accordance with “Instructuring in the sampling of seed”.

Substances. 2. The sampling must take place in a suitable local, and the party must be easily accessible and clearly separated from other parties. The sampler must have a suitable local at its disposal for registrations, breakdown, marking, sealing and storing samples. The room must be placed in connection with the premises where the other part of the sampling work takes place, and there must be a lockable creature that only the sampler has access to.

3. When sampling with an automatic sampler, the installation must be approved by the NaturErhvervstyrelsen. The automatic sampler must take samples correctly. The company must perform an annual control of the automatic sampler and could demonstrate evidence of control.

Section 10. A party, including mixtures, in accordance with og 20 and 22, must be notified to certification in sealed devices marked with an official label note after the provisions of Annex 6.

Substances. 2. The party must be sufficiently uniform, and the weight of the Party must not exceed the following amounts with more than 5%:

1) wheat, rye, spelt and durum wheat: 30 tons.

2) Alm. canarial grass: 10 tons.

3) 3) Majs,

a) base seed of breeding lines: 40 tonnes.

b) base seed of other than ingrown lines and certified seat grains: 25 tonnes.

3. The labelling and sealing must be made by the sampler or under its supervision and so that the seal is destroyed by opening and cannot be used again. § 8(2) applies similar.

4. Regardless of paragraph 1, a company can report a party to certification in relation to the party being delivered in loose weight directly to the final consumer in the country after Section 25(2).

5. If you try to remove the party in connection with the posting of the party in a silo or other warehouse container, or contain the silo or container a residual party after completing delivery, the sampler shall seal the silo or the container after completing the sampling, or the container.

6. Should the seal be broken, and shall the party be resembled, it shall be done under the supervision of the sampler.

§ 11. Documentation for purchases, printing and consumption of official markers must be registered. It also applies to bags with printed label bill.

Substances. 2. When purchasing official sealing devices, including plomber and sealing strips, everyone is assigned to the sampler. Documentation for purchase and consumption of sealing devices must be registered for each type.

§ 12. The company shall be in front of a sample drawn out by the party after Section 8, the inspection animals for the purpose of determining whether the party complies with the standards of Annex 5 for the variety and content of other black.

Substances. 2. Regardless of paragraph 1, control cultivation of samples of samples of samples of samples of samples of 2nd generation of other species than rye, corn and canarial grass and certified grains of rye, corn and canarie grass. 3. (1) 1 shall not apply to a party that is not bred here in the country, if the reviewers no later than 15 August in the harvest year, the Danish Council shall send a inspection certificate issued by the official inspection authority in the breeding country.

4. Control cultivation can be carried out by the Danish Nature Agency or by the Authority in another Member State in the European Union or Member State of the European Economic Cooperation. The result of control cultivation carried out in another Member State shall be submitted to the Danish Nature Agency within 15 August this year. All costs associated with control are held by the company.

5. Control cultivation must be carried out in accordance with applicable international rules.

Cetification

§ 13. A party from an approved area here in the country can be reported to the NaturErhvervstyrelsen for certification.

Substances. 2. The review must be submitted in writing to the Danish Agency and can only be submitted by a registered company. The review must specify in which category the Party is requested certified, cf. section 16, the breeding parties or certified parties included in the notified party and with which quantities.

3. (1) 1 and 2 and § 31 shall be equivalent to a party

1) is bred in a Member State of the European Union and originates directly from

a) preliminary ground, basic grain or certified seat grain 1th generation certified in a Member State of the European Union or in a state not a member of the European Union, but if the production of seat grains is approved as equal to the production of seat grains in a Member State, or

b) a cross of basic grain certified in a Member State and basic seed certified in an equal state (hybride varieties),

2) is marked by the provisions of Annex 6, Part II, Section A, and

3) 3) is accompanied by an official follow document containing the information in Annex 6, Part II, Section B

4. (1) 1 and 2 and § 31 shall apply similar to a party not a member of the European Union if it is not a member of the European Union.

1) The base seat is bred or certified in the country or in that State and the production of seat grains is approved as equal to the production of seat grains in a Member State;

2) The breeding State has officially established that the Party complies with the breeding standards of the OECD rules, in accordance with Section 19,

3) 3) The party is marked as not finally certified seat grains according to the OECD rules, cf. section 19, and

4) The party is accompanied by an official follow document in accordance with Annex 6, Part V.

§ 14. The Danish Medicines Agency certificates a party alm. byg, alm. oats, naked seas, lilies, lm. wheat, lm. rye, triticale, spelt or durum wheat, which complies with the higher Danish quality standards in Annex 5, and a party lm. canarie grass or corn, which complies with the EC quality standards in Annex 5, and abroad.

Substances. 2. The control certificates a party alm. byg, alm. oats, nut seas, leots, lm. wheat, lm. rye or triticale that complies with the EC quality standards, for sale abroad, and the party must not be sold here in the country. If the party is marked as a seat grain for sale in the country, the marking of the party must be changed.

3. Regardless of paragraph 1 and 2, the Danish Agency may certify a party as a pre-standard or basic rule, although it does not comply with the standards of Annex 5, Part II, for germination, in accordance with Section 30.

§ 15. For all parties of certified rye and 1th generation hybrids of alm. byg, lm. oats, lm. wheat, triticale, spelt and durum wheat as well as 2th generation of alm. byg, lm. oats, lm. wheat, triticale, spelt and durum wheat on a total size that does not exceed 120 tonnes (consistent), the analysis for quality of 5 standards in Annex 5.

1) the company has ensured that the parent party complies with EU quality standards in Annex 5, and

2) the mother party is divided into parties to certification that

a) not exceeding 30 tonnes

b) Tested after og 8-10, and

(c) the provisions of Annex 6 Part 1(a)

Substances. 2. If the analysis result shows that the standards of Annex 5 are not complied with, the samples from the other parties shall be analysed.

3. The samples taken must be kept by the company for at least 1 years for control.

4. In addition to the implementation of the production of seat grains after this provision, this must be communicated to the Natural Authority.

5. § 26 shall apply to parties covered by this provision.

§ 16 The Danish Medicines Agency certificates a party

1) pre-standard, if it

a) on the responsibility of the pet owner or its representative is the result of confectionery material, thus understanding grains of a processed black used for the maintenance of the black or for breeding of pre-based seed

b) is intended for breeding of pre-standard, basic grain or certified grains and

(c) meets the conditions for certification as basic seed,

2) basic seed, if it

a) on the responsibility of the variety owner or its representative is the result of pre-standard or confidential material that meets the conditions of certification as a base, and

b) is intended for breeding of certified seat grains,

3) 3) certified seat grains of rye, corn and straw. canarial grass if it is

a) is the breed of basic or on the producer owner or its representative's responsibility on pre- basis, which meets the conditions for certification as a base and

b) must be used for other breeding than breeding of seat grains,

4) certified seat grains of hybrids of lm. oats, naked seas, leots, lm. barley, lm. wheat, spelt and even dusty varieties of triticale, if it is

a) is the breed of certified seat grains 1st generation, on the basis or on the producer owner or its representative’s responsibility on pre- basis, which meets the conditions for certification as basic seed and

b) must be used for other breeding than breeding of seat grains,

5) certified seat grains 1th generation of alm. city, alm. oats, naked seas, lilies, wheat, triticale, spelt and durum wheat, if it is

a) is bred on basic or on the producer owner or its representative's responsibility on pre- basis, which meets the conditions for certification as a base, and

b) must be used for breeding of certified seat grain 2th generation or other breeding than the breeding of seat grains,

6) certified seat grain 2th generation of alm. city, lm. oats, naked seas, leots, lm. wheat, triticale, spelt and durum wheat, if it was

a) is the breed of certified seat grains 1st generation, on the basis or on the producer owner or its representative’s responsibility on pre- basis, which meets the conditions for certification as basic seed and

b) must be used for other breeding than the breeding of seat grains.

§ 17. A party shall not be certified in accordance with alle 8-16, all markers shall be removed from the party and handed over to the sampler. The cover with the pre-printed note must be emptied or the label must be done unreadable during the inspection of the sampler.

Validity

§ 18. A certified party must only be sold within the season (1 July-30 June), where the party has been tested first time to examine whether the norm for germination in Annex 5 is complied with.

Substances. 2. A party winter build, winter wheat, winter triticale or winter pig, which is first sealed during the period 1 May-30 June, must be sold until 1 December the same year.

3. After the expiry of the validity period, the validity may be extended in accordance with paragraph 4 and 5, if a examination of a new sample of the party shows that the norm in Annex 5, Part II, for the germination remains complied with. §§ 8 and 17 are equivalent.

4. The validity referred to in paragraph 1 shall be extended for a new season if the sample is in accordance with paragraph 3. The validity cannot be extended further.

5. Regardless of paragraph 4, the validity period for a party winter builder, winter wheat, or winter pigs can be extended until 1.december, if sample, in accordance with paragraph 3, is taken in the period 1 May-30. The validity cannot be extended further.

6. After the expiry of the validity period referred to in paragraph 1, the remaining parties, including mixtures, in accordance with blandes 20-22, are mixed according to the guidelines of Annex 7, and the mixed party can be notified to certification after the rules of 8 8-17. The validity period for the party may not be extended, and any remaining party may not be sold as grain.

7. The extension of the validity period referred to in paragraph 3 and 4, and the certification of residual parties referred to in paragraph 5, may only be made upon request from a registered company.

8. Displays a renewed study of a party pre-standard or basic rule that the party no longer complies with the norm for sprouting in Annex 5, Part II, no. 2, shall apply Section 14(3).

(1) grains sold in accordance with paragraph 2-7 must be marked with the information in Annex 6, Part I, Section B.

OECD certification

§ 19. Regardless of the §§ 8-14 and 16-17, the Danish Nature Agency may, after application, certify a party according to the rules for the certification of seat grains, which are sold internationally established by the Organisation for Economic Cooperation and Development (OECD), whose Party must be carried out to a state not a member of the European Union.

Mixing

§ 20. Partis of different varieties of the same species must be mixed and sold here in the country as a variety of variety, if scientific or technical experiences have been determined that the mixture is especially suitable for limiting the spread of certain harms. In the composition of a mixture, the cultivation characteristics of the blacks are also taken. The Danish Medicines Agency shall send every year the notice of the variety that meets these conditions.

Substances. 2. However, black mixtures, however, do not mix of hybrid rye and conventional rye, shall contain three or four varieties which must be the same proportion of the mixture. Black mixes of hybrid rye and conventional rye must contain at least 90 percent of a hybrid variety.

3. Regardless of paragraph 1 and 2, the Danish Nature Agency may, according to a specific assessment, allowing a party seat grain to be approved for sale in a different relationship than mentioned in paragraph 1 and 2, if scientific or technical experience, that another compositions are particularly suitable for limiting the spread of certain harm.

4. No information about parties to enter into a mixture that makes it assumed that they do not meet the quality standards of Annex 5.

5. Black mixtures must be made under the supervision of the sampler.

§ 21. The company must be given that samples are taken after §§ 8 and 9, cf. section 10 of the parties to enter a variety mix and of the variety mixture.

Substances. 2. The company must ensure that a samples of batches are examined whether the parties comply with the quality standards for certified seat grain 2nd generation in Annex 5.

3. The company must, at the request of the NaturErhvervstyrelsen, in front of the samples of the parties involved in the mixture of control animals, in order to determine whether the parties adhere to the quality standards of Annex 5 for the variety and content of other blacks.

4. Control cultivation can be carried out by the Ministry of Justice or by the Authority in another Member State in the European Union or Member State of the European Economic Cooperation. The result of control cultivation carried out in another Member State shall be submitted to the Danish Nature Agency within 15 August this year. All costs associated with control are held by the company.

5. Control cultivation must be carried out in accordance with applicable international rules.

§ 22. Certified parties of alm. settlement and of Italian or alm. grass must be mixed, but must only be sold here in the country.

Substances. 2. The mixtures must be made under the supervision of the sampler. § 10 is equivalent.

Bejdsing

§ 23 In chemical treatment (bejdsing) of seat grains, information on the preparation and preparation must be indicated on the official label note referred to in Annex 6 or on a supplier label label.

Substances. 2. Bejdses a party after it is certified, a new sample of the Party should be taken by any investigation of whether the Party still complies with the standards of Annex 5, Part II, for germination. §§ 8-10, § 14(3) and § 26 shall be equivalent.

Sale

§ 24. A party must first be sold when certified.

Substances. 2. The party must be sold before the result of the control cultivation is available in accordance with Section 12(4). The party shall not be required by the control cultivation, any residues shall not be sold as seat grains.

§ 25. Sperm grains must be sold in marked and sealed packings marked in accordance with the requirements of Annex 6. § 10 is equivalent.

Substances. 2. Regardless of paragraph 1, a company approved by the Danish Nature Agency must sell certified seat grains 1 and 2nd generation in loose weight to the final consumer in the country. The information on the official notice referred to in Annex 6, Part I, Section A shall be notified to the consumer in a particular document. The party shall be provided directly to the final consumer and shall not be returned to the sales company.

§ 26. Regardless of Section 24(1), a party notified to certification shall be sold as seat grains for consumption here in the country before the outcome of the survey after Section 8(1) is available if the company is available, if the company is available,

1) has ensured that the party complies with at least EU quality standards in Annex 5, and

2) the compensation scheme for seed grains is obliged to pay compensation to the final buyer if the result of the investigation shows that the party did not adhere to the Danish quality standards in Annex 5.

Substances. 2. Regardless of Section 24(1), the Danish Nature Agency may allow a party to be notified to certification, sold as a seat grain before the results of the study for germination is provided, provided that,

1) sale only happens to the first part of the trading chain,

2) a preliminary analysis certificate and

3) 3) company

a) has notified the name of the Danish Agency and the buyer and the name and

b) in Annex 6, Part I, Section C.

§ 27 Regardless of Section 24(1), a party shall be intended for use as seat grains sold uncertified

1) in small amounts for trials, scientific purposes and preparation and

2) in appropriate quantities for other examination or trial purposes than referred to in No 1 provided that the grain is of a black that was reviewed for admission to the Danish variety list, cf. section 4(2), no. 1

Substances. 2. Permission after paragraph 1 for the sale of grains of a genetically modified black is only notified if an official environmental risk assessment is taken all appropriate measures to avoid harmful impacts on human health and the environment.

3. Grain sold after paragraph 1 shall be marked with the information in Annex 6, Part III.

§ 28 § 24(1), the Danish Nature Agency may allow a party grain to be sold uncertified to use in the country

1) in small amounts for trials, scientific purposes and preparation and

2) in appropriate quantities for other examination or trial purposes than referred to in No 1 provided that the grain is of a black that was reviewed for admission to the Danish variety list, cf. section 4(2), no. 1

Substances. 2. Permission after paragraph 1 for the sale of grains of a genetically modified black is only notified if an official environmental risk assessment is taken all appropriate measures to avoid harmful impacts on human health and the environment.

3. Grain sold after paragraph 1 shall be marked with the information in Annex 6, Part III.

§ 29 Regardless of Section 24(1), small quantities of varieties under testing for recording on the variety list can be approved for sale only if they are used solely for testing and testing new varieties and meet the other conditions of Annex 8.

Substances. 2. Parties referred to in paragraph 1 shall be marked as set out in Annex 6, Part I, Section F.

§ 30. In the sale of a party pre- basis or basic seed that does not comply with the standards of Annex 5 for germination, cf. section 14(3), the company shall provide the found sprout capacity by a supplement marking, in accordance with Annex 6, Part I, Section C, and shall notify the Natural Authority that the labelling is made.

Substances. 2. In the sale of a party of a genetically modified black, the information must be clearly stated by sales catalogues etc.

Introduction

§ 31 A party that is produced abroad must be brought into the country and sold as a seat grain, if

1) The black is recorded on the Danish variety list or on the common variety of the European Community, and

2) Party is certified

a) in a Member State of the European Union or

b) in a state whose production of seat grains by decision of the Council of the European Union is approved as equal to the production of seat grains in a Member State,

3) 3) the party if it is produced in an equal state,

a) is marked by the OECD rules, cf. section 19, and is accompanied by an official OECD certificate,

b) is accompanied by an original ISTA analysis certificate or, for seat grains from the United States and Canada, an official AOSA analysis certificate or a copy of the analysis certificate, and

(c) on each packing is provided with an official statement that the party meets the EU rules and standards, and

d) if the party is chemically treated, it must be stated on the official label note or by other marking. In addition, it must be applied outside or inside the packings, and

e) if the party is genetically modified, it must be provided on all labels and documents relating to the party.

4) the party is accompanied by an official statement that

a) it is harvested on an area that in breeding control is found free of the occurrence of air carriers, and that a sample of at least one kg of the party has been examined and found free of air carriers, or

b) a sample of three kg of the party has been examined officially in the ship country or by another seed analysis laboratory, cf. section 39, and is found free from the aeroplanes.

5) when the party is introduced to further breeding, § 12(1) and 3 are equivalent.

Substances. 2. A party with a total weight of over 100 kg originating in a Member State of the European Union, which is brought into the country for sale as a seat grain, must be notified to the Danish Medicines Agency accompanied by evidence that the provision of paragraph 1 is complied with.

3. A party with a total weight of over two kilos originating in an equal state that is brought into the country for sale must be notified to the Danish Nature Agency and must be accompanied by evidence that the provision of paragraph 1 is complied with and an official follow document containing the information in Annex 6, Part V.

Production and trading of conservation varieties

§ 32. Production and trade of varieties that are recorded in the variety list as » conservation variety« must only take place in the origin region.

Substances. 2. The provisions of §§ 1-2 and § 23(1) and 2 shall apply corresponding to conservation varieties.

3. If the production of a conservation variety as a result of a specific cultivation problem can not take place here in the country, NaturErhvervstyrelsen can approve supplementary regions for the production of grains. However, type of preservation produced in such supplementary regions can be used only in the origin region.

§ 33. Companies producing conservation varieties must, before the beginning of each production season, report information about the size and location of the production area, as well as the amount of grain expected to be brought in trade, to the NaturErhvervstyrelsen. The report shall be submitted no later than 1 January for spring crops and no later than 1 July for winter crops.

Substances. 2. The Danish Medicines Agency shall report the amount of seeds of the conservation variety, the company must bring in trade in the following season. The total amount brought in trading shall not exceed it in Annex 9, I.

§ 34. A party of a conservation variety must be sold as ‘maintain variety’ without the prior official control.

Substances. 2. The party shall comply with the EU quality standards referred to in Annex 5, Part I-IV and Part VI, to the certification of ‘certified seat grains 1st generation’ for rye, and by ‘certified seat grain 2th generation’ for other species than rye, as well as the norms relating to flyholders, gold oats and gold hoists. The party shall be sufficiently uniform and the weight of the Party shall not exceed the weight limit of Section 10 by more than 5%.

3. The party must be sufficient variety.

§ 35. Cleaning varieties may only be brought in the trade in closed packings or containers and be sealed so that the seal is destroyed by opening and cannot be used again. The packing must be marked after the provisions of Annex 9, II.

§ 36. The company must be in front of a test of the party to examine whether the party complies with the quality standards referred to in Annex 5. The test can be taken and examined by the company. The company can request the NaturErhvervstyrelsen to take the sample. The cost of sampling and analysis is held by the company.

Substances. 2. The test must be taken after the provisions of the Danish Agency’s preparation in the sampling of seeds and must be examined in accordance with applicable international methods and the Danish Agency’s instructions.

3. The company must at the request of NaturErhvervstyrelsen send a copy of the certificate of analysis. The test must be kept for at least two years for any control.

4. The companies shall no later than 14 days after the closure of a party of a preservation-sort report it to the Danish Nature Agency with information about art, black, quantity, reference number and the date of closing the party. The date of closure of the party shall not be later than the date of the latest examination of the party for germination.

§ 37. The Danish Medicines Agency checks whether the party complies with the quality standards of Annex 5, and whether the party is sufficient variety and variety.

Substances. 2. In accordance with Section 36(4) of Section 36(4), all costs of control shall be subject to control.

§ 38. The companies must no later than 30 June report the amount of grains of each type of preservation brought in trade in the finished production season.

Official analyses

§ 39. Studies of samples covered by the notice may be made:

1) of a seed analysis laboratory authorised by the direktorateate pursuant to the provisions of Annex 4, Part IV, or

2) as an official examination in another Member State of the European Union, or

3) 3) as an examination carried out under official control of another Member State in the European Union.

Administrative provisions

§ 40. The Danish Medicines Agency may, after written application, allow the sale of a party that does not meet the conditions of certification if it is necessary to overcome transient difficulties with the supply of seat grains.

§ 41. The Danish Medicines Agency checks that the rules in the notice are observed.

Substances. 2. The Danish Medicines Agency’s control and analysis results are published.

§ 42. Any complaint about the breeding control in accordance with §§ 6 and 7 should be submitted as soon as possible to ensure that the basis for a new marker is unchanged.

§ 43. Section 1(2)(b) of Section 1(2)(2) of Section 14(2) of Part 2, 1 and paragraph 3, Section 5, Section 8(2), §§ 9-12, Section 14(2)(2), §§ 17-18, 20- 20-36, and § 38 of the fine.

§ 44. An authorization notified pursuant to Annex 4, Part I, II, III and IV pursuant to Section 7(2) and Section 8(2) and(3) may be deducted if it is found that

1) one or more of the conditions set out in Annex 4, Part I, II, III and IV are not met, or

2) In spite of this, the company has failed to pay off liability checks fees.

§ 45. The decision shall enter into force on 20 March 2013.

Substances. 2. Decision No 1496 of 15 December 2010 on seat grains is repealed.

C. The stock

The stock must be sufficient variety and the variety, as referred to in Part II, section A. seed grains of an inkeeping line must be sufficient variety and variety interest with regard to the characteristics of the line. For seat grains of hybrid varieties, this also applies to the properties of the components.

Plant damage, including especially Ustilagineae (no fire), which reduces the use of the seat grain, may only occur at least as possible.
3) 3)
The area must be in such a cultivation state, and the stock must be at such a level of development that it is possible to take adequate control of the occurrence of air carriers, the health state, the variety unit, and any mix of other plant species.

We may not be able to identify weeds or rent seeds significantly.

A. All species
1)
The first consideration must be carried out immediately after the flight’s slip.
2)
There must not be chemical combating air carriers, cf., no. 6 and Section C

When finding air carriers, the area must either be discarded or adjusted to other conditions.
In setting for other reasons, the found air-cooking plants must be cut off and/or cut.
However,:
a)
The area is discarded if the flying sea is located in larger quantities spread over the area,
b)
finds of air carriers in colonies1) cut,
(c)
finds of airplanes, both colonies and standalone, cut in fields with rye, triticale, lm. seas, naked seas and leek.
4)
In the event of the number of air-cooking plants, the inspection must be calculated from the inspection, whether the inspection has occurred before or after the inspection.
5)
The area must be found free from air carriers. There must be at least one week between two reasons for the occurrence of air carriers.
6)
It is allowed to fight grass carved with means that have effect against air carriers. To combat the spring, the area must be estimated for the occurrence of flying seas twice at least one week.
1) A colony usually consists of more than 10 plants in a place, corresponding to seed thrown from one single plant.
B. Rules of cut-off by finding air carriers
1)
Crop must be made with crater, garden mill or similar. The mark must be cut into ground height and be at least half a meter wide.
2)
Multiple cuts can be made on an area, and cut from the middle of the area. A cut should consist of right lines. A cut can have several kneel. A cut should be made at least 20 metres from the outer flying sea. A cut should be done so that it is possible to harvest the approved area in reasonable manner.
3) 3)
In the final case, the cut must be made, and there shall not be air carriers in the area approved.
4)
The crop on a cut area must be harvested after the crop on the other part of the area is harvested and must be kept separate from the part of the breed that is searched.
5)
Instead of a cutting edge, the breeder with the company's approval agreement with the control unit can be made a stoch marking and harvest control. When the uninnfected area is harvested, the harvest of the infected area must not be started before the harvest control has occurred.
C. General town, wheat, spelt and durum wheat
If there was chemical combating airplanes on a small, consecutive part of an area, the reviewers within a week from the first inspection seek the Natural Authority on the approval of the area of the following conditions:
a)
New attention must be made at the earliest one week after the first sentence.
b)
In the part of the area, the first or other conditions must be found.
(c)
The steering wheel shall, at harvest control, find that the area where chemical combat and at least 10 m wide belt are offensive up to the area, is left uneasted after the rest of the area is harvested and the breed has been removed.

Annex 4

Authorisation of markers, sampling agents, companies and departments using authorized samplers and seed analysis laboratories

In. Authorisation as a field control
1)
The application for authorisation is to be submitted to the Danish Nature Agency on a special timetable that is re-established by the Danish Agency.
2)
The applicant must have undergone a farming training that ensures that the applicant can perform field control in sound manner.
3) 3)
Authority shall be notified when the applicant has completed the Danish Agency's course for new markers and passed exams.
4)
The Mark Control is assigned an authorization number to be attached with the signature of the controller on the inspection forms.
5)
The Authority shall be issued as a general authorisation to carry out a mark notice of areas notified by registered seat grain companies. Operators employed in a seat grain company must only be established by this company, unless the Danish Nature Agency has granted permission to others.
6)
Maintaining the authorisation requires that
a)
The field control unit conducts mark inspections and conducts reports in accordance with the instructions of the NaturErhvervstyrelsen,
b)
The marker regularly conducts detentions,
(c)
The marker will take part in one of the annual meetings of the direktorate for authorized markers at least every five years,
d)
satisfactory compliance between allegations carried out by the field control tool and the clarification of the same areas made by the direktorate, and
e)
The Danish Agency shall be informed of all matters affecting the implementation of the facts.
II. Authority as a trial
1)
Authorisation may be notified to a person who is
a)
independent, or
b)
employed by a natural or legal person who does not deal with the production of, processing or trading of seat grains, or
(c)
employed by a registered seat grain company.
2)
The application for authorisation shall be submitted to the Danish Nature Agency on a form which is requested by the Danish Agency. If the applicant is employed by a registered company, the application must be submitted by this. Authorisation shall be notified when the applicant has passed the practical examination of the Danish Agency in sampling. In order to maintain the authorization, the trial must then complete the first course of the Danish Agency in the sampling and pass a theoretical exam herein.
3) 3)
A sampler employed by a registered seat grain company must only take samples of lots of seat grains produced by the company, unless the Danish Nature Agency has permitted otherwise.
4)
The sampling must be made according to applicable international methods and in accordance with ‘Instructuring in the sampling of seed’.
5)
Maintaining the authorisation requires that
a)
The sampler regularly takes samples,
b)
satisfactory compliance between the analysis results for samples drawn out by the sampler and inspection samples of the same parties by the Danish Agency,
(c)
The exam at least every other year participates in the course of the Danish Medicines Agency or in the company’s internal training course, in accordance with Part III,
d)
the authorised sampler at the Danish Agency’s audit visits is to have completed the sampling tasks satisfactory and has followed any deviations and other instructions from the Danish Agency, and
e)
The Danish Medicines Agency shall be informed of all matters that are important to the implementation of the sampling.
III. Authorisation of business or department to use authorized samplers
1)
Before sampling, by authorized sampler, can be initiated, the companies or departments of which an authorized sampling is approved by the Danish Nature Agency.
2)
In order to ensure one of the NaturErhvervstyrelsen approved quality management system, which describes how the authorized sampling is carried out in the company.
3) 3)
For companies holding internal training courses on sampling subjects for own trials, participation in the courses of the NaturErhvervstyrelsen will not be mandatory, provided that the company may document that internal courses are held and that the individual sampler participates in those following the same rules as under Part II, no 5, point (c.
4)
The company or department shall have to have followed up any deviations and other instructions from the Danish Agency.
5)
The company or department shall keep the NaturErhvervstyrelsen informed of all matters that have significance to the implementation of the sampling.
IV. Authority as seed analysis laboratories
1)
Authorisation may be notified to a laboratory that meets the following requirements:
a)
The laboratory must be independent or belong to a registered seat grain company.
b)
The laboratory must have a leading laboratory, which is directly responsible for the technical work of the laboratory, and has the necessary qualifications for the professional to lead a seed analysis laboratory.
(c)
Laboratory laboratory users must have passed exams, in the analyses and the species that the authorisation includes, in accordance with point e.
d)
The laboratory must advise on premises and equipment that the Danish Agency can approve as satisfactory to the performance of the analyses that the authorisation includes.
e)
The laboratory must have one of the NaturErhvervstyrelsen approved quality management system, which describes how the authorized analysis is carried out in the company. In addition, the procedure for sampling checks tests and procedure for preparation and detention of courses and exams must be described in the quality management system.
(f)
The laboratory's national analysis certificate with the Danish Nature Agency logo must be approved by the Danish Agency.
2)
The application for authorisation shall be submitted to the Danish Nature Agency on a form which is requested by the Danish Agency. Authorisation shall be notified with effect from the date in which the Danish Agency may find that the requirements laid down in No 1 are met.
3) 3)
A laboratory that belongs to a registered seat grain company must only analyze parties of seat grains produced by the company unless otherwise agreed between the company and the Danish Agency.
4)
Autorised analysis of seat grains shall be carried out according to applicable international methods and in accordance with the instructions of the Danish Agency. The results of the analyses required shall be submitted immediately after the completion of the analysis to the Danish Agency for use by certification and control of the parties concerned.
5)
The laboratory must take out 5% of their analyzed parties for control analysis. The controls shall be carried out as an official examination in another Member State of the European Union. The laboratory holds all costs associated with it.
6)
Maintaining the authorisation requires that
a)
The laboratory for stillness complies with the requirements of No 1 and No 3-5,
b)
laboratory laboratory operators regularly make the analyses that the authorization includes,
(c)
satisfactory compliance between the analysis results for samples analyzed by the laboratory and inspection samples of the same parties,
d)
The laboratory’s analysis certificate by the Danish Agency’s control is available to be completed satisfactory,
e)
The laboratory of the Danish Agency’s audit visits is to have carried out the analysis tasks satisfactory and has followed any deviations and other instructions from the Danish Agency,
(f)
The laboratory has participated in annual ring analysis with a satisfactory result,
g)
the laboratory does not use subcontractors of analyses, unless the Danish Agency has granted permission to others,
h)
The laboratory helps clarify the cause of discrepancies between results and follows up deviations and other directions from the Danish Agency, and
in)
The Danish Medicines Agency shall be informed of all matters that are important to the analyses authorised by the laboratory.

Labelling

1)
As an official label note, an adhesive label should be used or a printed label note of not easily descending material to be fixed so that it can only be removed by breaking the seal. A clearly individual running number must be printed on each label. The label must be approved by the Danish Nature Agency.
2)
The cover with the label note must be used if the label is approved by the Danish Nature Agency. The bags must be provided with a pre-printed bag number (evt. order number). During production, a clearly individual running number must be printed on each bag.

Annex 7

Conditions for certification of residual parties

The remaining parties of seat grains, including mixtures, may, after the end of the validity period, be mixed according to the following guidelines:
1)
The parties of destruction, and of the rams, and of the rams, and the seas, naked seas, and purples must be mixed after 1 December after the end of the validity period.
2)
The parties of winter build and winter wheat must be mixed after 1 May.
3) 3)
The parties of alm. rye and winter honey must be mixed after 1 July.
4)
Only parties of the same black or black mix must be mixed.
5)
Parties of different categories shall be certified in the lowest category. The parties of pre- basis must only be mixed with parties of lower category with the written permission of the NaturErhvervstyrelsen.
6)
Stacked parties may only be mixed with parties that are stained with the same means and in the same dosage. The mixed party must not be put on new.
7)
Upon review of a mixed party for certification, the party is of old harvest.

Annex 8

Sale of varieties that are during testing for shooting on blacklists

The Danish Medicines Agency and other EU Member States' certification authorities can allow trade with varieties that are not yet admitted to official variety list. The seed grain must only be used for testing and testing new varieties. The owner or the owner’s official representative must submit application to the certification authority in the country where the black is testing to be admitted to the variety list. The seat must meet the standard certification rules.
In. Application for the Danish Nature Agency
1)
The Danish Medicines Agency can allow trade with varieties that are testing for admission to the official Danish variety list. The application for each black must be submitted by the owner or the official representative of the variety owner. The application must contain information about the following:
a)
Apply.
b)
Holder.
(c)
Black code (review number) for review for testing for admission to the Danish variety list.
d)
Art.
e)
Black name or confectionery.
(f)
If the black is genetically modified, it must be documented that the black is approved by the European Parliament and of the Council Directive 2001/18/EC on the environmental of genetically modified organisms and by Regulation 1829/2003/EC on genetically modified foods and feed.
g)
Description of the planned tests and testing.
h)
Member States where trials and testing are carried out and planned quantities.
2)
Permission is granted solely for testing and testing carried out on agricultural companies, for the purpose of obtaining information about the cultivation or the use of the black.
3) 3)
The application must be submitted to the NaturErhvervstyrelsen no later than one month before trading must take place.
4)
The Danish Medicines Agency may allow trade of each black up to a given quantity as specified in Part III of this Annex.
5)
The permission is valid for a season and can be extended for a season at a time if the variety owner or its official representative is looking for it.
6)
The permit for the individual black ends when the black is recorded on the Danish variety list, the common EF blacklist, if the black is rejected, or the reviewers draw the application for recording on the variety list back.
7)
The Black owner or its official representative shall inform the Danish Nature Agency if a black is rejected or withdrawn from the variety testing.
8)
The seat must meet the standard requirements for certification of last generation, except for the requirement of recording on the variety list.
II. Other requirements
A.
Reporting
1)
The Black owner or its official representative shall report the results of the testing and testing of the Natural Authority.
The following shall be provided:
a)
The quantities sold by each black and
b)
which countries are sold to.
2)
The information must be submitted to the Danish Nature Agency no later than 1 December after each season.
