Publication of the freeing of certain animal and plant species and the care of the harmful game, 1)

In accordance with section 30 (2), Paragraph 1, section 70, paragraph 1. One and two, section 71, paragraph 1. Article 89 (2) and Article 89 (2). 3, in the law of nature conservation, cf. Law Order no. 933 of 24. September 2009, and section 6 (4). 1, 4 and 7, section 6 (a), 3, section 12, section 49, paragraph. One and three, section 52, paragraph. 2 and Section 54 (4). 3, in the law of hunting and feral management, cf. Law Order no. 930 of 24. September 2009, shall be determined :

Chapter 1

Scope of application

§ 1. The commuting shall include :

1) The species of birds, which are in the wild state, have their natural stay in the territory of the Member States of the European Union, where the Treaty on European Union is applicable.

2) The mammals, reptiles, fish, amphibians and vertebrates (invertebrates) as specified in Appendix 1.

3) The plants listed in Appendix 2.

4) The animals listed in Appendix 3.

Paragraph 2. The commuting shall also include mammals and birds that are exposed or escaped human custody and which have established willory, reproducizing stocks in nature, unless traditionally regarded as domestic animals.

Paragraph 3. The provisions on animals shall comprise these in all their life stages as well as for parts and products of these.

Paragraph 4. The provisions on plants comprise plants in all life stages and parts and products thereof.

Paragraph 5. The provisions relating to wild animals include mammals and birds, including migratory birds, which are naturally occurring in the Danish nature.

§ 2. The commuting does not include :

1) animals that are farmed farmed, cf. law no. 814 of 14. July 2012 on team of animals, or

2) animals bred in captivity and derived from animals which are legally acquired.

§ 3. The prohibition of the covered animal and plant species shall consist of the prohibitions laid down in Chapters 2 to 4.

Paragraph 2. The protection of wild game, which is not protected, is laid down in Chapter 6.

Chapter 2

Frequing of birds, netting trees and so on covered by the Birds Protection Directive

§ 4. For birds covered in section 1 (1). 1, the prohibition of intentional killing or capturing them, whatever the method used and to be in possession of live birds, is prohibited.

Paragraph 2. The prohibition in paragraph 1. Paragraph 1 shall not apply to species species which are authorised to hunt or catch in accordance with the law of hunting and feral management, cf. § 5. For birds, covered by Section 1 (1). 1, cf. paragraph 3, a ban on trade, transport for trade, storage for sale, offering for sale, sale, preservation or exhibition.

Paragraph 2. The prohibition in paragraph 1. Paragraph 1 shall also include recognisable parts of or products derived from these birds.

Paragraph 3. The prohibition in paragraph 1. Paragraph 1 shall not apply to birds in Appendix 4, provided that the birds have been legally killed or captured or otherwise legally acquired.

§ 6. The nesting of non-colonial birds shall not be set in the period 1. February-31. July.

Paragraph 2. The nesting of rovfugles and owlers shall not be set in the period 1. February-31. August, cf. however, paragraph 1 3.

Paragraph 3. The necks, black and red glens necks must not be cut down.

Paragraph 4. Hule trees and trees with spitting holes shall not be set in the period 1. November-31. August.

Paragraph 5. Digesvalereder must not be destroyed in the period 1. April-31. August.

§ 7. There is a ban on the importation of live birds of the species which at all times fall within the scope of Article 1 of Directive 2009 /147/EC of the European Parliament and of the Council of 30. In November 2009 on the protection of wild birds (the bird protection directive), from non-EU countries, unless the importer can document that they are reared in captivity. The same applies to the subspecies of these species, regardless of whether the underspecies are not naturally occurring in the Member States of the European Union.

Paragraph 2. The trade and distribution of live birds of the species referred to in paragraph 1. 1, only if the birds are reared in captivity. The owner of the Nature Management Board shall, at any time, be able to document the fact that the birds are reared in captivity.

Exemptions

§ 8. The Wildlife Board may allow the phasing-in of phasers.

§ 9. If a satisfactory alternative is not available, the Management Board may make exceptions in section 4 (4). Paragraph 5 (1) and section 5 (5). 1 to

1) respond to the danger of human or human health ;

2) the risk of contamination of humans or animals,

3) in response to the risk of air safety,

4) protect flora and fauna,

5) prevent extensive damage to building, crops, livestock, forests, fish farming or fishing and water areas ;

6) permit, on strictly controlled conditions, that inmate, possess or use certain species of birds in smaller quantities,

7) promoting research and training,

8) restore a stock, repostponds or farmed species of birds ; or

9) permit the collection or storage of specimens of species of birds in a limited and specified number and under strictly controlled conditions.

Paragraph 2. In decisions on derogations from paragraph 1. 1 shall lead to the natural authority,

1) the species covered by the derogations,

2) the allowable catch or murder means, or methods or methods ;

3) the conditions of risk and the circumstances of time and place during which such decisions may be granted,

4) the authority which has the authority to declare that the conditions laid down have been fulfilled and to decide on the means, methods or methods which may be brought into use within which borders and by which persons, and

5) the controls to be carried out.

Paragraph 3. In exceptional cases, the Administrative Board may allow derogations from the provisions of section 6 and section 7. Permission can be granted on terms and conditions.

Chapter 3

The promotion of animals and plants covered by the habitats Directive, Annex IV

§ 10. In the case of wild animals which are naturally occurring in the Danish nature and are subject to Annex IV, see. Annex 1 of Council Directive 92 /43/EEC of 21. In May 1992 on the conservation of natural habitats and wild fauna and flora (Habats Directive), prohibitions are prohibited

§ 11. In the case of animals and plants, which are covered at all times, the habitats Annex IV or the list II of strictly protected species of animals and plants in the Convention of 19 shall be laid down in the field of the habitats Directive. Exemptions

§ 13. For the safety of habitats, including raste and breeding sites, for animal and plant species listed in Annex 1-3 being listed in Annex IV of the Habitat Directive, the Natural Management Board may conclude contracts for the protection of habitats and grant grants, cf. hunting-and wild-management law to :

1) to improve and guarantee the habitats of species, including the recovery of animal and plant species ;

2) information on the site of life protection, etc.,

3) implementation of management plans for rare or endangered species,

4) research, training and monitoring ; and

5) other species-conservation objectives, including arrangements for the restructuring of existing legal operating modes.

Chapter 4

The promotion of animals and plants which are not covered by the bird protection Directive or the habitats Annex IV

§ 14. For wild animals referred to in Annex 1 but are not marked by underscore, there is a prohibition of deliberate killing or incapsuction, whatever method may be used.

Paragraph 2. For wild plants in the Danish nature referred to in Annex 2 but are not marked by underscore, there is a ban on the damage being damaged or removed from their adult location.

Paragraph 3. In the case of leeches and snails referred to in Annex 3, a non-collection is prohibited for business purposes outside areas where they are artificially incaptuated.

Paragraph 4. Notwithstanding paragraph 1 1 it shall be allowed for public authorities and public institutions to catch insects referred to in Annex 1 for scientifically purposes or in investigation purposes.

§ 15. For animals covered by section 14 (4). 1-3, the prohibition of trade, transfer, storage, preservation, transport and exhibition.

§ 16. It is permissible to collect the spawn of little aquatic salamander, scrubtose, butsnude seeds and green seeds for non-commercial purposes.

Exemptions

§ 19. In exceptional cases, the Administrative Board may authorize derogations from the provisions of section 14 (4). 1-3, and section 15 (3). 1 and 2. The permit may be granted on terms of conditions.

Paragraph 2. Collection etc. shall not be required for collection, etc. covered by section 16 to 18.

Chapter 5

Provisions common to protected animals and plants in accordance with Chapters 2 to 4

20. It is incumbated to the owner or the holder of the animals and plants protected in accordance with Chapters 2 to 4, to prove that they are not taken from nature contrary to the provisions of this notice or originate from those of such a date.

§ 21. In accordance with the provisions of section 9 (4), 1, and Article 12, in exceptional cases, the Wildlife Board may permit the eradication of species of the animals and plants that are not naturally occurring in the Danish nature, which are considered to constitute a threat to natural species.

Exclusions

§ 22. The tents in section 5 (5). Chapter 6

Chapter 7

Prenting of injured wild or emergency grac;

Chapter 8

Complaction, punishment, entry into force, etc.

§ 32. The Fish and Wildlife Board shall ensure compliance with this notice, including compliance with the terms and conditions laid down in derogations and authorisations.

§ 33. The decisions of the nature of nature cannot be complained to other administrative authorities.

§ 34. Unless more stringent penalties have been imposed on other legislation, penalties shall be punished by fine ;

Paragraph 2. This notice does not make any changes to the provisions of publication No 1. 84 of 23. 1 January 2002 on the protection of wild fauna and flora by checking trade thereto (Washingtonventionen/CITES).

§ 37. The announcement shall enter into force on 1. April 2013.
