Annunciation of non-business navigation and other ferries on the river of side-stream and lakes from the Tearring to Randers 1)

In accordance with paragraph 29, paragraph 1. Paragraph 1, section 72, section 87 (2). 7 and 8 and Article 89 (8). 3, in the law of nature conservation, cf. Law Order no. 933 of 24. September 2009, as amended by law no. 1273 of 21. December 2011 and Law No 580 of 18. June 2012, and upon request from and negotiated with Favrskov, Hedensted, Horsens, Silkeborg, Sanderborg and Province Province :

Objective and demarcation

§ 1. This notice does not regulate-commercial navigation in the Gudenåen by side-stream and on lakes from Tearring to Randers, situated in Favrskov, Horsens, Horsens, Silkeborg, Skanderborg and Viborg municipalities as shown on the map-annexes, for the purpose of : to maintain the national and international importance of the area as a natural environment and to preserve the area's recreational values.

§ 2. Toughing is not permitted in seclusion and piping water areas.

Paragraph 2. Sailing is not allowed in the following water areas.

1) The Gudenea from Tearring to Klostermill, intime. Bredness, Vestbirk and Naldal lakes in the period 1. March to 15. June, both days.

2) Mattrup Z.

3) The old man's old race, Bredwu Lake to Vestbirk Water Power Plant.

4) Dead O, northwest of East Birk.

5) Dead O, from the monastery to Mossø.

6) A 100 m zone around the Emborg Oft in Mossø. The zone is chargeable from country and in the case of a pivotal waxing, the zone shall be taken from the end of the plumbing.

7) The Salten Z from the jump to Rye Bridge and the Salten Langsø. However, sailing without the engine of the Salten Langsø is allowed for the breeders in the insofar as they are.

8) The headset in the northeast corner of Gudensø off the ground for the Fisherman Road.

9) Display YO.

10) The headset in Birksø.

11) A 50-foot zone around Horcutting Spids in Knudlake. The zone is chargeable from country and in the case of a pivotal waxing, the zone shall be taken from the end of the plumbing.

12) Knudå.

13) The innermost part of the Rodeceit.

14) A 50-foot zone around Alø off the Beast. The zone is chargeable from country and in the case of a pivotal waxing, the zone shall be taken from the end of the plumbing.

15) A 50 m zone around Bindø northwest of Møgelø. The zone is chargeable from country and in the case of a pivotal waxing, the zone shall be taken from the end of the plumbing.

16) The bay on the north side of the Stigballe Hoved.

17) The ship-in-the-Paradise shik.

18) A 50 m zone around the island of Kongsholm in Brassø. However, passage in the sails between the island and the north shore shall be permitted. The zone is chargeable from country and in the case of a pivotal waxing, the zone shall be taken from the end of the plumbing.

(19) Funder was.

20) Liny.

21) Gjern Z as well as the Eastern 2/3 of Smyge Lake. However, sailing on Sminge Lake is allowed for the breeders.

(22) Alling Y (Hinge Y).

23) Made it.

24) Borre Z.

25) Catch the Z.

26) Granslev Z.

27) Lilleå.

28) In a 50 m zone around Little Lindholm in Mossø. The zone is chargeable from country and in the case of a pivotal waxing, the zone shall be taken from the end of the plumbing.

29) Grave pelvis.

(30) Ry Fury. Circular pressure.

31) The scapegoat of Ry Møllesø.

32) Stryched at the port of the Silkeborg (Paper Plat factory).

33) The sails, however, are sailing without engine on the San Sø allowed for the purpose of the practice of fair-scale fishing.

Paragraph 3. In a 50 m zone on the island of Birksø, the seam and the fishing shall not be allowed. The zone is chargeable from country and in the case of a pivotal waxing, the zone shall be taken from the end of the plumbing.

Paragraph 4. The following are the definition of :

1) People whose property or land borders up to the water system.

2) Persons who, as tenants, live a property that borders the water system, insofar as the right to navigation is covered by the lease.

§ 3. Victory or engine sailing, including electric motor, are not allowed in the following water areas :

1) The Gudenea from Tearring to Mossø, including the inat. Bredness, Vestbirk, Naldal lakes.

2) Tear Ye from Tear Lake (Skanderborg Sø) to Mossø.

3) The Salten O from Rye Bridge to the Gudenen.

4) Ry Mølle Kanal. However, sailing with a sail shall be permitted.

5) The Kanopascase at Ry Mølle.

6) Ravnlake. However, sailing with sail and elaps shall be permitted.

7) Friends' Sø. However, sailing with a sail shall be permitted.

8) Avnor and Klüvers Kanal.

9) Road Island.

10) Almind Lake.

11) Kali dsvig in Silkeborg Langsø.

12) Desert Island and Lysaw.

13) Thorlake.

14) Alling Lake.

15) Allinggård Sø.

16) Hinge Sø.

17) The Gudenen from the doorway east of Silkeborg, including inat. the west 1/3 of Sminge Lake to a line across the Tange Sø. 1300 m east of the briddock, as shown in the map annex. The prohibition in 1. Act. does not apply to brewers, however.

18) Nørreå from Rindsholm to Fladbro.

(19) Remstrup Z. However, engine navigation, including electric motor, shall be allowed.

Paragraph 2. Twin-driven vessel with a speed of over 5 knots is not allowed on the Gudento between Tange and Randers. This provision shall be valid until it is replaced by other speed limits in accordance with other legislation, including water-flow regulations after the water drain slop.

Paragraph 3. The municipal boards may, by the way, set speed limits for navigation-driven vessels, including speed limits in sub-areas, subject to the approval of the Fish and Wildlife Board. Requirements regarding speed restrictions shall be published in accordance with section 14.

§ 4. Concordes of motor vehicles, including power-driven vessels, may only take place with vessels registered in accordance with section 7 to 10.

Paragraph 2. Victory on the line south of the Klostermill from Tearring to Mossø, cf. Section 3, paragraph 3. 1, no. 1-5, may only be carried out with vessels registered in accordance with section 8.

Paragraph 3. Windsurfing, kitesurfing and water skiing by motorboat may only take place in water areas designated by the municipality board. Principals of such designated territories shall be published in accordance with section 14.

Paragraph 4. Parachuting and sailing by jet ski, water scooters, and similar. is not allowed.

Exclusions

§ 5. The following shall not be applicable to the prohibition in section 2 and section 3.

1) A voyage of scientific purposes. The sail shall be notified to the municipality that may lay down the conditions for the shipping.

2) Public authorities ' ferries with regard to the taking of their administrative tasks.

3) Sailing, including sailing with a motorded vessel, in the presence of a rescue party in the case of serious person or cause of injury or to the disposal of nearby peril.

Paragraph 2. The City Council may, with the approval of the Natural Management Board, allow for less expansion in access to navigation in the areas referred to in sections 2 and section 3.

§ 6. The municipality boards may, notwithstanding the provisions of section 2-4, grant permission to :

1) Sailing and other ferries in special cases, and special arrangements.

2) Conceit with other types of vessels other than those registered under Clause 7 9.

Registration arrangements

§ 7. The local authorities of the municipalities referred to in section 1 shall result in a registration scheme for home-belonging vessels with an engine, including electric vessels and both with the motor of the outboard.

Paragraph 2. The registration number of vessels with the engine including power-driven vessels and both with an outboard engine shall be accompanied by the owner of the vessel.

Paragraph 3. Request for registration after paragraph 7 (4). 1 shall be made to the municipality where the vessel is indigenous. A vessel with an engine shall be based on the following :

1) an owner has domicile or summer cottage within Favrskov, Hedensted, Horsens, Silkeborg, Sanderborg and Viborg municipalities ; or

2) the vessel in a rented spot (privately or publicly owned) is situated in one of the municipalities referred to in Section 1.

Paragraph 4. The local authority's amendments to the registration schemes, including the setting of the maximum number of vessels, where appropriate for the sub-areas, vessel sizes, and a decision on registration for the navigation of other types of vessels other than those referred to in paragraph 1. 1, shall be submitted by the approval of the Natural Board

Paragraph 5. Requirements concerning the registration schemes shall be published in accordance with section 14.

§ 8. The municipal boards in Hedenden and the Horsens municipalities lead to the Tearring of the Klostermill on a separate registration scheme for home-based vessels without a motor.

Paragraph 2. Request for registration after paragraph 8 (3). 1 shall be made by the two municipalities in which the owner of the vessel is spreading or resident, cf. no. 1-3. A vessel without an engine shall be based on the following :

1) the vessel belongs to a brewing owner,

2) the vessel belongs to a person resident in the Horses and Horsens State west of the E45 motorway, as well as in the part of the Vejle municipality which before 2007 was covered by Tørring Uldum municipality and where there has been a record in Hedensted municipality in the past. as the resident vessel owner, and the person has taken advantage of this option, or

3) the vessel belongs to a person resident in the territories of the Horsens east of the E45 which has previously been able to be registered as a resident vessel owner, and the person has taken advantage of this option.

Paragraph 3. Amendments to the registration system in accordance with this paragraph shall also be approved by the Wildlife Agency, cf. Section 7 (2). 4.

§ 9. The local authorities of the municipalities referred to in Section 1 shall ensure that all types of rental craft are registered.

§ 10. Vessels not covered by the registration schemes in section 7 9 shall, at the time of the voyage of the Tearring to Klostermill, lead a chargestone plate. The cashier numbers shall be issued at the place of the Horses and the Management Board of the Horne Management Board.

Facilities

§ 11. The local authorities may permit the establishment of permanent installations and temporary facilities for non-commercial navigation where such installations do not require authorisation from other legislation.

Paragraph 2. The municipality boards may lay down detailed conditions for the authorisation.

Landlord

§ 12. The local authorities of the municipalities referred to in Section 1 shall administer an authorisation system for rental activities complying with the requirements laid down in caps. III, on authorisations in the European Parliament and Council Directive 2006 /123/EC of 12. In December 2006 on services in the Internal Market (Services Directive). Provisions concerning the authorisation scheme shall be published in accordance with section 14.

Paragraph 2. The rental operation of vessels for navigation may only be operated by the authority of the municipalities referred to in § 1, which shall jointly establish the conditions for rental.

Paragraph 3. When the municipality board receives an application for authorisation to operate, a receipt shall be sent to the applicant with information on :

1) the deadline for the notification of a decision and

2) redress.

Administration

§ 13. The municipality boards shall carry out the necessary information on this notice.

§ 14. The municipality boards shall publish regulations pursuant to section 3 (1). 3, section 4 (4). 3, section 5, section. 2, section 7, section 8, paragraph 8. Paragraph 12 (1) and 12 (2). 1, as well as decisions in accordance with section 5 (5). 2, section 6 and section 12 (2). 2.

Paragraph 2. Publication shall be carried out by notification according to the local authorities ' arrangements and may be made solely on the local authority ' s websites.

Paragraph 3. The notice shall include information on :

1) the main content of the formula or decision,

2) the place or place where the decision has been submitted ;

3) The hall of applause.

Paragraph 4. Publication under paragraph 1. 1 may be omitted if the publication of other rules is published.

Paragraph 5. The municipal boards shall publish the decision of the Office in a complaint file after the decision of this authority. Publication can be made solely on the home side of the local authorities or the office of the public.

§ 15. The municipal boards may charge fees to cover the costs of managing the notice.

§ 16. The Municipal Management Board shall set up a user council with representatives from among other things, the landowners, the canouries, authorities and stakeholders interested organisations to advise on issues relating to the management of the notice by the municipal management board.

Supervision

§ 17. The municipal boards shall supervise the compliance of this notice.

Crow

§ 18. The Municipal Management Board shall be able to appeal to the Agency for the Agency and the Environment Board in accordance with the rules laid down in Chapter 12 of the protection of the natural protection law.

Punishment

§ 19. Unless higher penalties have been inflished on any other law, the penalty shall be penalised by the penalty which :

1) , section 2, section 3, section 4, section 8, section 8. 2, section 10, sections 11 and § 12 (2). 2.

2) shall be disregarded by the municipal boards pursuant to section 7 (3). Paragraph 1 and paragraph. 4, and section 8 (4). 1, or

3) will override the terms set out in section 5 (5). 1, no. Paragraph 5, section 5. 2, section 6, section 11, paragraph 1. 2, and section 12 (3). 2.

Paragraph 2. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

The entry into force, etc.

20. The announcement shall enter into force on 1. May 2013.

Paragraph 2. Publication no. 111 of 26. January 2007, on non-business navigation on the river of the river basin and lakes from the Tearring of Randers.

Paragraph 3. Applicable provisions and decisions pursuant to paragraph 1. The notice shall remain in force until such notice shall be fixed until such notice shall be amended or taken into account in accordance with this notice.
