Annanceance concerning reviewer

In accordance with paragraph 5 (2), 2, section 10 (4). 3, section 12, section 13 (3). 3 and section 15 (3). 4 in the case of approval and sight of vehicles, cf. Law Order no. 959 of 24. September 2012, set :

Chapter 1

Permission to undertakings carrying out vehicles

Scope of the authorisation

§ 1. Supervision of vehicles may only be carried out by establishments authorised to carry out vehicles (retrainers) or have the Traffic Management Board (s) permit the surveillance of vehicles to be taken into view.

Paragraph 2. For the purpose of a review, a technical check shall be taken as to whether or not they have been identified by means of a vehicle being determined.

Paragraph 3. " Corporations " means the companies, companies, parties, funds and other self-involved institutions, partnerships, partnerships, partnerships, partnerships, cooperative societies, cooperative societies, and other companies and associations ; Limited responsibility.

Paragraph 5. The following vehicles may not be authorised to perform the following vehicles : cars for more than nine persons, including the driver, or with a maximum permissible weight of more than 3500 kg, and trailers for vehicles where the trailers have a permit ; total weight of more than 3500 kg, and block carts.

Paragraph 6. A permit to carry out a reforesight shall be granted an authorization number and issued with validity so far.

Conditions for granting authorization

§ 2. Permission to carry out vehicles should be issued to undertakings which comply with them in paragraph 1. One-twelve, said conditions.

1) The company must have a technically responsible person who is the owner of the company or has been employed in the establishment and trained (s), or has passed other relevant technical training at equivalent or higher level, approved by Traffic Management, and has passed one of the Traffic Management approved course, cf. Section 14, paragraph 14. 1 and have the necessary management powers to guide the approval-of-the undertaking ' s permit work, cf. § 14. The technically responsible person shall be in possession of a valid driving licence for the vehicle or vehicle species that are specified in the authorization. The technically responsible person shall not be indifferent to the guardianship of the guardianship, whether or not this applies to the guardianship, cf. Section 5 and concress of collecels, cf. § 7.

2) The company must have a firm business location in Denmark.

3) The company must not be under bankruptcies or winding-up proceedings.

4) The company must have full availability of it in section 18 (s). 1, cf. Annex 2, which relates to the category or categories of vehicles which the undertaking is required to circumview.

5) The company must be enrolled in one of the Traffic Management Protocol (s) approved repair control system, cf. Section 19, and provide information on the name of the control-body.

6) The company must have a valid liability insurance that includes oversight work, and which releases vehicle owners / users for losses that could result from a flawed or incorrect oversight.

7) The company is required to report information on IT equipment that can communicate with the Communications Communications Device.

8) The company ' s employed persons undertaking must be trained (Vs) mechanics and possession of valid driving licences for the vehicle or vehicle species to which they shall be circumciised.

9) The company must be in agreement with the supervision and supervision referred to in Chapter 3.

10) The company, including the company owner (personally driven company), and its accountable manager must not be convicted in the last three years in the case of infringements of the rules governing the approval and view of vehicles, or rules issued in pursuant thereto, nor shall it be condemned for matters covered by the criminal code, including the Article 78 (5) of the penal code. 2.

11) The company, including the company owner (personally driven company), must not have acted in such behaviour that there is reason to assume that the company will not be driven safely.

12) Neither the company, including its owner, nor if it is a legal person, members of the management board or the board of directors, the technically responsible person or the legal person, must have a debt of debt to the public at 50 000 ; DKK or over there. "

Permit Applications

§ 3. The application for a review of vehicles to the Traffic Management Board shall be submitted for the submission of the authorization. Paragraph 2. The application must contain information about which category of vehicles the company wants to take care of, cf. Section 1 (1). 4, as well as information on all points of view.

§ 4. The Traffic Management Board may extend it in section 3 (3). The time limit referred to in paragraph 1 shall be that the complexity of the case justifies. The Management Board shall notify the applicant for the extension and the duration thereof before the expiry of the time limit referred to in paragraph 1. 1. The extension message must be valid.

Paragraph 2. The Traffic Management Board shall, as soon as possible, acknowledge receipt of an application for a permit to carry out vehicles for the purpose of carrying out vehicles. The receipt shall include the following information :

1) The published date for the examination of the application in question and the possibility that the period may be extended once, cf. Section 3, paragraph 3. Paragraph 4 (1) and section 4 (4), 2.

2) Enlightenment for the administrative redress for the decision in question.

§ 5. For the assessment of the impact of your permission, the Traffic Management Board may, after obtaining consent, obtain information about the company owned by the company (personal-driven company) and the technical person responsible for the authorization ; public authorities, including the economic and possible criminal conditions.

Permission to be authorized

§ 6. Permission to carry out vehicles should be refused if the company, the company owner of the company (personal-driven company) and / or the technically responsible person is convicted of a criminal offence which is undergoing a serious abuse of : access to the exercise of supervision, cf. Paragraph 2. Permission to carry out vehicles should be refused if the company / company owner (personally driven company) has demonstrated such behaviour that there is reason to assume that the company will not be driven safely, cf. Section 5 (5). 3, in the case of approval and sight of vehicles.

Paragraph 3. Permission to carry out vehicles should be refused if the undertaking and / or the undertaking ' s technical officer does not, in respect of the application, communicate the consent of the Traffic Management Board in section 5.

Paragraph 4. Permission to carry out vehicles should be refused if it is to be assumed that the company will not be able to exercise the prurisation of the company safely.

Chapter 2

Terms of Permission

§ 7. A company which has been authorised by the Traffic Management to carry out a review of the vehicles shall comply with the provisions referred to in paragraph 1. 3, as well as section 8-18, section 23-25 and § 28 (3). The terms and conditions set out in section 2 shall remain in accordance with the conditions set out in section 2. 1-12, stated conditions.

Paragraph 2. The Danish Agency shall be able to obtain information from public authorities as well as request information to the establishment for assessment of the information referred to in paragraph 1. The requirements referred to above are met.

Paragraph 3. Where the conditions governing the authorisation or conditions laid down by the Traffic Management Board shall be amended after an undertaking has been authorised to carry out a review of the vehicles, the Traffic Management Board shall provide the undertaking with a reasonable period of time ; document the fact that the company meets the changed requirements.

§ 8. Changes to the company ' s company structure and other business relationships, employment conditions for the accountable manager person, or changes to other conditions in which the declaration is a prerequisite for the authorisation for the authorisation, cf. Section 3 shall immediately be submitted to the Traffic Management Board for approval, with a view to the continued validity of the permit.

§ 9. Technical Responsible Person

§ 12. § 13. The supervisory operator ' s technical responsible person shall :

4) ensure that the work is carried out in accordance with the applicable rules ; and

Author for Technical Responsible Person Training

§ 14. The technically responsible person shall be trained (vehicle) mechanics or have passed other relevant technical training at equivalent or higher levels. In addition, the accountable person must have undergone a course of a minimum of three days, which shall be completed with a test in the items listed in Appendix 1. Paragraph 2. The course must be carried out at an establishment approved by the Traffic Management Board to implement courses for the responsible persons responsible for technical responsibility.

§ 15. The course referred to in section 14 shall be organized in accordance with paragraph 1. 2-9 requirements described :

Fees

§ 17. For each of the inspections, the Danish Traffic Management Board shall pay a fee of 19 kr.

Paragraph 2. If the charges are not paid in a timely manner, interest shall be paid in accordance with interest-rate rules for the interest rate of monetary claims in the territory of the asset, cf. Section 15 (3). 1, in the case of approval and sight of vehicles.

Paragraph 3. If the charges are not made on time, a reminder of the memory shall be printed. In the case of printing of the memory, a fee shall be charged in the same way as the interest rate supplement in paragraph 1. 2.

Paragraph 4. Equipment requirements

§ 18. Recon firms must, at all locations, be available to the equipment and meet the requirements laid down in Appendix 2.

Paragraph 2. Chapter 3

Control and supervision

Approval of repair control schemes

§ 19. The Traffic Management Board may authorize undertakings to carry out repair checks, cf. Section 2 (2). 1, no. 5. 20. § 21. The Traffic Management Board shall periodically publish a list of approved repair control arrangements.

Supervision of retrainers

§ 22. The Traffic Management Board shall oversee the inspection undertakings. The supervision consists of an administrative supervision (assessment of complaints and reviews, the control of company information, etc.) and practical supervision (company).

-23. The operator shall, upon request, communicate to the Traffic Management any information relating to the undertaking which is relevant to the authorisation issued by the Traffic Management Board.

§ 24. Paragraph 2. Chapter 4

Abduction and revocation of an authorization to perform

Abduction of Permission

§ 28. Permission to carry out a review is subject to a review, cf. Section 7 of the approval and sight of vehicles, if :

2) the holder of the authorization shall be subject to bankruptcy proceedings or winding-up proceedings ; or

3) the technical responsible person's association with the undertaking ceaates,

Withdrawal of authorisation

-$30. The Traffic Management Board may revoke an authorization to conduct a review, cf. Section 8 of the approval and view of vehicles, if :

2) it is established that the person or the technically responsible person at the time of the application has owed a debt to the public at 50 000. or more, cf. § 2, nr. Twelve, and in spite of this, a declaration has been signed, cf. Section 3, paragraph 3. 3, or

3) the owner of the establishment or the establishment of a legal person, members of the management board or the management, the technically responsible person, or the legal person, to be indebable to the public at $100,000. or over there.

Paragraph 2. A permit may be recalled for a given period or for the time being.

Paragraph 3. The Traffic Management Board shall lay down detailed rules on when a company will re-examine an undertaking ' s permit to carry out a review.

Paragraph 4. A decision on withdrawal from paragraph 1. The operator shall be required by the operator of the company, and may be submitted to the courts. Applications for the submission of proceedings to the courts shall be made to the Traffic Management Board no later than four weeks after the decision has been notified to the company. Paragraph 5. The request for a withdrawal of a withdrawal shall not effect unless the right of recognition determines that the undertaking concerned shall have access to the operation of the proceedings at the time of the proceedings. Chapter 5

Persistent authorization

§ 32. In the case of an application, a operator may be granted temporary permission to proceed as a reviewer if :

1) The technically responsible person ' s accountable manager has died, or otherwise by prolonged (more than 4 weeks) illness or similar, has been unable to carry out the functions of the issuing of the permit, provided they are disputed ; by the person concerned.

2) The operator ' s technical responsible person shall be deprived of its position, cf. paragraph 2.

Paragraph 2. Where a person ' s accountable person is deprived of its position, a derogation may be granted for up to two months until the company has employed a new technically responsible person. In exceptional cases, after application, the derogation may be extended for up to four months in any case where the reviewer designates a deputy.

Chapter 6

Penalty and entry into force, etc.

§ 33. The withdrawal of section 1 (2). Paragraph 7, paragraph 7. 1, section 8-13, nr. 2 and 4, section 14 (4). One and two, section 17, paragraph 17. 1, section 18, section 19, paragraph 1. 2-4, section 23, section 25, section 28, paragraph 28. 2 and 3 may be punished by fine.

§ 34. The decision taken by the traffic management decision shall not be made for the transport minister or any other administrative authority.
