Completion of the recognised work environment certificate attesting the inspection and requirements of the inspections carried out by the inspection bodies

In accordance with section 65 b (b), 3 and 4, and section 65 on the Work Environment Act, cf. Law Order no. Seventy-seven of seven. September 2010, as amended by law no. 356 of 9. April 2013, and after debate with the Minister for Acquiec and Growth, the following shall be determined :

Chapter 1

Anerwell-known work environment certificate, etc.

§ 1. Undertakings with staff covered by the law on the working environment may be granted a recognised work environment certificate, which relates to either the overall business (the entity with all its production units) or one or more production units.

§ 2. For the purposes of a company, this notice shall mean a legal entity in the form of :

1) a natural person in his capacity as employer,

2) a legal person or a branch of a foreign legal person,

3) a governmental administrative unit,

4) a region,

5) a municipality, and

6) a community community.

§ 3. A production unit shall be understood by means of this notice ;

1) the main activity of a legal entity which has only one main activity, and where all activity is carried out on or from the same geographical address as the address of the legal entity ;

2) each principal activity where a legal entity has several key activities carried out on or from one geographical address ; and

3) each activity where a legal entity has activities carried out on or from a number of geographic addresses.

Paragraph 2. A recognized work environment certificate may not be issued for a construction site.

§ 4. In order for an establishment or unit of production to be granted a recognized working environment certificate, the requirements of Chapter 2 must be fulfilled.

Paragraph 2. Businesses or production units which do not comply with one or more of the requirements for the issuance of a certificate in Chapter 2, cf. paragraph 1 but within 4 weeks of the inspection has started to comply with the requirements, a working environment certificate may be issued.

§ 5. The recognised work environment certificate shall be issued by an accredited inspection body for this purpose.

Paragraph 2. The inspection body shall, for each undertaking, for which inspection has been carried out in accordance with the requirements of this notice, shall issue a recognised work environment certificate signed by the employee who has the power to do so. The certificate must, for the entire establishment or to one or more production units, subject to the inspection, to which the minimum the following is required,

1) the name and address of the establishment,

2) the activities of the undertaking with regard to product, process or service areas,

3) the parts of the undertaking inspected by the indication of the production unit number of the certificate or an annex to this ;

4) where and when the inspection has been completed,

5) the rules forming the basis for the inspection (this notice),

6) it is a work environment inspection ; and

7) identification of the inspection body.

§ 6. The inspection body shall send copies of the certificate and any annexes to the Board of inspection, together with information on the question of whether the work environment certified business is concerned, the inspection body shall send copies of the certificate and any annexes thereto, together with information on the question of whether the work Coronesmiley on the Work site's website.

Paragraph 2. The inspection body shall inform the Board of Work when a certificate is deduced, suspended or disposed of.

§ 7. The inspection body shall check all the production units within a maximum of two certification periods (6 years), subject to the certificate. If the certificate is subsequently extended to include other production units, new production units must be checked at the latest during the subsequent certification period.

Chapter 2

The material work environment

§ 8. In the company or in the production unit, where the areas referred to in Annex 1 are concerned, there may be substantial work environment problems which may result in an injunction in accordance with the law on the working environment.

§ 9. For companies or production units with a work environment organization in two levels, cf. in section 6 b of the working environment, a written work environment policy shall be drawn up, describing the work environment work carried out on the company. The description must include at least :

1) a declaration of principle on the importance of the working environment,

2) an indication of specific objectives relating to the undertaking ' s working environment ; and

3) the establishment of general duties and tasks for the top management, management staff, the staff and the working environment organisation.

Paragraph 2. For other undertakings or production units, the working environment policy may be limited to a written declaration of principle on the importance of the working environment and the designation of targets for the work environment work.

§ 10. A workplace assessment must be carried out in accordance with the rules of the working environment legislation.

Paragraph 2. In its workplace assessment, the company or the production unit must relate to, where appropriate, significant working environment problems, cf. Annex 1.

§ 11. The rules on the safety and health of the labour environmental legislation must be fulfilled.

Paragraph 2. For undertakings or production units with a working environment organisation at two levels, a member of the company ' s senior leadership shall be chairman of the top committee of the work environment organisation. Similarly, a member of the nearest senior leadership must be chairman of the respective sub-committees or groups of the working environment organisation.

§ 12. The rules on training and the training of labour environmental legislation and statutory training must be fulfilled.

Paragraph 2. The company or production unit must have guidelines for training and instruction of the staff in the context of

1) hire,

2) the transfer or change of tasks to the Commission ;

3) the introduction or modification of work equipment ; and

4) the introduction of new technology.

Paragraph 3. For companies or production units with a work environment organization in two levels, cf. the section 6 b of the working environment shall be written in writing.

§ 13. Work accidents must be notified and examined in accordance with the rules of the working environment legislation.

Paragraph 2. Expiration for accidents at work must also be investigated.

Paragraph 3. Businesses or production units must establish guidelines for systematic investigation of accidents at work and accidents.

Paragraph 4. The guidelines must include requirements for :

1) the initiation of necessary measures to avoid repetitions, and

2) the organisation of the working environment or, where such does not exist, the involvement of employees in the investigation of accidents.

Paragraph 5. For companies or production units with a work environment organization in two levels, cf. the section 6 b of the working environment shall be written in writing.

§ 14. Use instructions for the CE marked machinery and pressure equipment and the safety data sheets and the workplace instructions on substances and materials shall be provided at the company or production unit and be available in : compliance with the work environment legislation.

§ 15. In the case of the technical aids of the establishment or production unit, subject to the requirement of statutory inspection, statutory inspections shall be carried out in accordance with the rules of the working environment.

§ 16. The company or production unit must carry out work environment reviews of the company or production unit to continuously control the working environment.

Paragraph 2. Work environment reviews must be carried out at least twice a year. In establishments where the section 6 (a) and (6) of the working environment is established, this participation shall be included in the review.

Paragraph 3. The company or production unit must have written guidelines for work environment reviews, including for who attendees and the frequency of the work environment reviews.

§ 17. In the planning of new or changing existing jobs, working processes and methods, the introduction of new technologies, the acquisition of technical aids, personal protective equipment and substances and materials, it must be ensured that the working environment shall be brought into line with the general and special requirements of the working environment legislation.

Paragraph 2. The company or production unit must involve the work environment organization or, where such does not exist, the employees in the planning process.

Paragraph 3. Businesses or production units with a work environment organization at two levels, cf. Section 6 b of the work environment shall have written guidelines concerning the involvement of the work environment organisation.

§ 18. The company or production unit must have guidelines for information on the working environment of the undertaking or the production unit which is significant for foreign companies operating in the company or production unit ; territory if :

1) such work shall be carried out at least once a month ; or

2) the company ' s working environment is a hazard to the effect that the employees of foreign companies are exposed to the working environment effects listed in Annex 1, Part 1, 8.

Paragraph 2. For companies or production units with a work environment organization in two levels, cf. the section 6 b of the working environment shall be written in writing.

The spatial labour market

§ 19. The company or production unit shall, during the participation of the employees or their representatives, have decided how it will specifically work to maintain its staff and recruit new employees who are under threat of exhaust emissions from the exhaust ; labour market.

Paragraph 2. The decision must be written.

Paragraph 3. For companies or production units with a work environment organization in two levels, cf. in section 6 b of the working environment, the decision shall contain objectives, action plan and guidelines for the follow-up of the action plan.

Healthcare

20. The company or its production unit shall, during the participation of the employees or their representatives, have decided how it will actually work for health promotion in the workplace.

Paragraph 2. The decision must be written.

Paragraph 3. For companies or production units with a work environment organization in two levels, cf. in section 6 b of the working environment, the decision shall contain objectives, action plan and guidelines for the follow-up of the action plan.

Documentation

§ 21. The undertaking shall demonstrate the performance of the company or production unit in order to meet the requirements of this chapter.

§ 22. The company or production unit must, in the case of psychosocial workloads, see it in accordance with : in Annex 1, Part 1, Section 6, for use or in the establishment ' s workplace assessment, cf. § 10, document the fact that an independent mapping has been carried out, which is at least the case for these psychosocial loads.

-23. The total documentation of the establishment or production unit after section 21 shall be required as a minimum in the form of a collection of the documentation prepared for the achievement of the recognised work environment certificate, cf. Annex 2.

Paragraph 2. The undertaking or production unit shall also provide in writing proof of the performance of the work carried out by the company or the production unit in the area of work environment policy, health promotion and the inclusive labour market.

Paragraph 3. The company or the production unit shall indicate the number of declared work accidents, the type of accident and information on the undertaking ' s prevention of accidents at work, including measures against repetition of accidents.

Paragraph 4. The company or production unit must document by an endorsement by a representative of the employees or at the minutes of meeting minutes that the employees or their representatives have been involved in the initiatives which are in the name of the documentation ; by paragraph 1.

Paragraph 5. The documentation must be publicly available in a combined form.

Paragraph 6. If the documentation contains information of a confidential nature, this information must be anonymized before the documentation is made available to the public.

§ 24. The documentation in accordance with section 21 to 23 shall be renewed at each new issue of a recognised work environment certificate.

Chapter 3

Inspection of the inspection body

§ 25. The inspection body of the inspection body of the establishment or production unit shall be carried out with the participation of a representative of the management of the company or production unit and a representative of the company or production unit of the company or production unit.

Paragraph 2. In the case of inspections carried out by the inspection body, other accredited certificates in the area of the working environment which, having been negotiated with the business and growth minister, are approved by the Minister for Employment, as an indicator of the fact that a or more of the conditions for the granting of recognised work environment certificate after this notice has been met.

SECTION 26. In addition to the verification of compliance with the requirements for the issuing of a recognised health certificate in Chapter 2, the inspection body shall also include compliance with compliance requirements within the time limit set out in section 4 (4). 2.

Control requirements for the physical working environment of undertakings

§ 27. The inspection body shall check,

1) that, in the case of the areas referred to in Annex 1 there are no significant working environment problems which may result in an injunction in accordance with the law of the working environment, cf. § 8, and

2) all work processes and working environment conditions for all employees of the company or the production unit. In the case of homogeneous work processes and a uniform working environment where the work environment problems in the areas referred to in Annex 1 are in the same way, the control may be limited to a representative sample. In the case of temporary and rotating workplaces, a representative sample cannot be selected.

Paragraph 2. The Director of the Health Safety Board shall emit guides in which it is specified when it is a representative sample and when it is a matter of uniform working processes and a uniform working environment where the environmental problems are concerned ; prevented in the same way.

Paragraph 3. In the case of psychosocial loads, the inspection body shall check that there is a separate mapping, which is at the very least the case of the psychological workloads listed in Annex 1, Part 1, point. 6.

Control requirements for the self-service of undertakings

§ 28. The inspection body shall for establishments or production units with a working environment organisation at two levels, cf. section 6 b of the work environment, control ;

1) there is a written work environment policy, cf. § 9,

2) the policy contains a declaration of principle from the management of the importance of the working environment,

3) the policy indicates specific objectives related to the company ' s working environment ; and

4) that the policy shall establish duties and tasks relating to the work environment effort for the top management, management staff, the staff and the working environment organisation.

Paragraph 2. In the case of other undertakings or production units, it is only necessary to check whether the environmental policy is at least a statement of principle by the management of the importance of the work environment work and the objectives of the work environment work.

§ 29. The inspection body shall check,

1) the deskit assessment contains all the required elements in accordance with the section 15a of the working environment, for all parts of the establishment to which a recognised health certificate is sought ; and

2) the company or production unit has remained for the major problems, cf. § 8.

-$30. The inspection body shall for establishments or production units with a working environment organisation at two levels, cf. section 6 b of the work environment, control ;

1) the working environment organisation is established in accordance with the rules of the working environment legislation,

2) on temporary and changing places of work, cooperation with work environment organisations from other undertakings is collaborating when several undertakings carry out work in the same workplace, cf. the rules of the work environment ;

3) that members of the working environment organisation have undergone or enrolled in the working environment training ;

4) there is a written evidence that the annual work environment organisation of the work environment has taken place,

5) an authority development plan is available for the members of the working environment organisation relating to the supplementary working environment training and that the Member States are offered the additional working environment training ; and

6) a member of the senior management chair is the chairman of the company's top committee in the working environment organisation and that the chairman of the subcommittees or groups are members of the nearest senior management, cf. Section 11 (1). 2.

Paragraph 2. In the case of other undertakings and production units, the representative of the company ' s management and representative of the staff of the inspection shall be verbally confirming that working environment matters are resolved in cooperation between employer and employees.

§ 31. The inspection body shall check that staff working with processes requiring special statutory training have undergone, or have been enrolled, these studies have been enrolled in these studies, cf. § 12.

§ 32. The inspection body shall check that there are written guidelines for the instruction and training of the staff, cf. § 12, paragraph 1. 2.

§ 33. The inspection body shall check that accidents at work have been notified and examined in accordance with the rules of the working environment legislation, cf. Section 13 (1). 1 and that the flow to work accidents has been examined, cf. Section 13 (1). 2.

Paragraph 2. Onwards the inspection body shall check,

1) in writing.-(b) There are written guidelines for systematic studies on accidents at work and accidents at work, cf. Section 13 (1). 3,

2) that the guidelines contain requirements for the implementation of the necessary measures to avoid recurrence, cf. Section 13 (1). 4, no. 1, and

3) that the guidelines contain requirements concerning the organisation of the working environment or where such a does not exist, the enrament of the employees in the investigation of any accidents, cf. Section 13 (1). 4, no. 2.

§ 34. The inspection body shall check that the company or production unit is available on the business or production unit ;

1) instructions for the CE marked machinery and pressure equipment, and

2) safety data sheets and workplace instructions for substances and materials which may be hazardous to or, incidentally, of low security or health, cf. § 14.

Paragraph 2. For the use of the CE marking equipment and pressure equipment, sampling must be carried out on the basis that at least 50% of the required instructions for use are available, but the highest five shall be available and available.

Paragraph 3. In the case of the workplace instructions for substances and materials which may be hazardous to or, incidentally, low safety or health, sampling must be carried out of at least 50% of the required workplace instructions, but at most 20, available and available.

$35. The inspection body shall check that the undertaking ' s or production unit ' s technical aids to be subject to statutory inspections have been carried out statutory inspections of a experts, cf. § 15.

Paragraph 2. Statduous inspections shall be carried out by a qualified expert for the following technical assistance,

1) horsepower,

2) the lifting equipment,

3) means of transport,

4) game,

5) presses,

6) pressure equipment control class A and B,

7) centrifuges, and

8) elevators.

§ 36. The inspection body shall check,

1) that the company or production unit has written guidelines for working environment reviews, including frequency and participants ; and

2) the guidelines stipulate that work environment review must be carried out at least twice a year, with the participation of the work environment organisation.

§ 37. The inspection body shall check that the company or production unit has written guidelines for the inclusion of work environment considerations in the planning of new or changing existing jobs, work processes and -methods, the introduction of new technology, the acquisition of technical remedies, personal protective equipment and substances and materials, cf. § 17.

§ 38. The inspection body shall check that the company has written guidelines for information on working environment conditions against foreign builders and companies carrying out business operations in the company ' s area, cf. § 18.

Control requirements for the companies ' work in the space-market labour market

§ 39. The inspection body shall check,

1) the undertaking or production unit has drawn up a written decision, cf. Section 19 (1). 2,

2) that the decision relates specifically to the maintenance of own staff and recruitment of new employees who are under threat from the exclusion of the labour market, and

3) that the decision has been taken, taking part in the participation of employees or their representatives.

Paragraph 2. For companies or production units with a work environment organization in two levels, cf. The section 6 b of the working environment must be checked to ensure that the written resolution contains the objectives, action plan and guidelines for the action plan, cf. Section 19 (1). 3.

Inspecting requirements for business activities with health promotion

§ 40. The inspection body shall check that the company or production unit has drawn up a written decision, cf. Section 20 (2). 2,

1) that the decision relates specifically to health promotion in the workplace, and

2) that the decision has been taken, taking part in the participation of employees or their representatives.

Paragraph 2. For companies or production units with a work environment organization in two levels, cf. The section 6 b of the working environment must be checked to ensure that the written resolution contains the objectives, action plan and guidelines for the action plan, cf. Section 20 (2). 3.

Paragraph 3. It must be checked that the company or production unit can document the results of the initiatives referred to in section 23 (4). 2.

Control requirements for the documentation of undertakings

§ 41. The inspection body shall check that the total documentation is available as required in section 21.

Paragraph 2. It must be verified that the documentation is available in an overall form, cf. Section 23, paragraph 1. 5.

Paragraph 3. It must be checked that the company or production unit can document the results of the initiatives which are due to the documentation provided for in paragraph 1. Paragraph 1 and paragraph. 2.

Paragraph 4. It must be checked that the staff have been involved in the work, e.g. by the documentation being endorsed by a representative of the staff or by the presentation of meetings in relevant fora, cf. Section 23, paragraph 1. 2.

Paragraph 5. It must be checked if the documentation for section 21-23 is new or renewed.

Chapter 4

Crow and other things.

§ 42. Complagues of decisions concerning the issue of recognised work environment certificate, which is made by an accredited inspection body, shall be treated by the accredited inspection body according to procedures laid down in international standards. The storage of the stock shall be sent to the inspection body.

Paragraph 2. Complaguing cannot be brought to an administrative authority.

§ 43. The announcement shall enter into force on 1. November, 2013.

Paragraph 2. Publication no. 924 of 21. In October 2001 on the work environment certificate, the inspection and requirements of the inspection bodies of the inspection bodies shall continue to apply to the work environment certificates issued with their home meal before 1. November, 2013.

Paragraph 3. Publication no. 924 of 21. October 2001 on the work environment certificate attesting and requirements for the inspection by the inspection bodies of undertakings shall lapses on 1. November, 2013.
