Publication of the approval of training centres, examiners, etc. in the training of train drivers in the railway area ; 1)

In accordance with section 6 (4), 3 and 4, section 21 h, paragraph. ONE, ONE. pkt., and section 26, 1. pkt;, in the law of rail, cf. Law Order no. 1249 of 11. In November 2010, as amended by law no. 613 of 22. June 2012 will be determined according to section 24 h (1). 1 :

Implementation of EU rules

§ 1. The announcement shall be carried out by the Commission Decision of 22. November 2011 on criteria for the recognition of training centres involved in the training of train drivers, the criteria for the recognition of examiners for train drivers and on criteria for the testing of samples in accordance with Directive 2007 /59/EC of the European Parliament and of the Council

Paragraph 2. The Commission ' s decision shall be annexes 1 to the notice.

Scope of application

§ 2. The announcement shall lay down criteria for the approval of training and examination centres for train drivers for train drivers and locomotive drivers, for the approval of examiners for train drivers and train drivers and train drivers ; and in the conduct of tests, in accordance with Directive 2007 /59/EC of the European Parliament and of the Council of 23. October 2007 on the certification of train drivers, piloting locomotives and trains on the railway network in the Community (the driver ' s driver directive).

Paragraph 2. The notice shall not apply to carers applicable to the practicalities of train drivers, in accordance with the provisions of the driving train. however, section 14 (4). 2.

Member States ' competence

§ 3. Commissioned powers of the Member States shall be exercised by the Traffic Management Board.

Application for approval as a training centre

§ 4. The one who wishes to extend the training of train drivers for driving on the Danish rail network shall have an approval for the training centre issued by the Traffic Management Board.

Paragraph 2. The one in paragraph 1. 1 training of the train driver shall include training for the purpose of issuing a driver ' s licence or driver ' s licence or class in parts thereof.

§ 5. Applications for the approval of the training centre shall be submitted to the Traffic Management Board. Apps must apply the Track Management application form that is available on the styling website.

Paragraph 2. If the training centre consists of several legal entities, separate legal entities must be applied separately.

Paragraph 3. Appeability shall comply with the requirements laid down in Article 4 of Annex 1 to professional qualifications in order to obtain an approval as a training centre. In addition, those who teach railway courses at the training centre must be approved by the Traffic Management Board.

Paragraph 4. Applics must specify which training tasks for which the applicant requests approval.

§ 6. The Traffic Management Board may issue an additional approval to a foreign training centre which has obtained approval pursuant to the Commission decision, cf. section 1, if the applicant can document the necessary skills and knowledge associated with Danish railway conditions.

Approval of training centers

§ 7. The Traffic Management Board shall approve an applicant for a training centre as soon as possible, and within two months after the Traffic Management Board has received the necessary documentation in the case.

Paragraph 2. A first-time approval is valid for two years. Subsequent Approval as a training centre will be valid for five years. In exceptional cases, the Management Board may, in specific cases, reduce the period of validity of all educational tasks or part of the educational tasks for which the approval is to be approved.

Paragraph 3. A training centre which has obtained the approval of the Traffic Management Board may apply for approval for additional training tasks. The Traffic Management Board shall issue an amended approval on the basis of the new information. The original expiration date will remain unchanged.

Paragraph 4. If a training centre no longer meets the requirements for one or more of the teaching tasks provided for in the authorisation, the training centre shall immediately cease to offer the teaching concerned and notify the Traffic Management Board ; on this.

Paragraph 5. Before an end to a training centre, the Training Centre can request the Traffic Management Agency to renew its approval. The training centre shall be accompanied by the documentation of the training activities of the preceding years.

Suspension and withdrawal of training centre

§ 8. The Traffic Management Board may suspend or withdraw an approval if the training centre is no longer satisfying the requirements of the notice. The Traffic Management Board shall inform you of the requirements in the notice which the training centre does not meet.

Paragraph 2. In the case of the suspension or withdrawal of a training centre, the Traffic Management Board may provide the training centre for the training centre to meet the requirements of the notice before the approval is suspended or withdrawn.

Training centres owned by railway undertakings or infrastructure managers

§ 9. Railway railway undertakings and railway infrastructure managers, which train only own train drivers, may have approved their training activities for train drivers as part of the company's safety certificate, cf. Article 5 of Annex 1.

Paragraph 2. Railway undertakings and railway infrastructure managers, cf. paragraph 1, shall comply with the requirements for the training and examination requirements, etc., as specified in Article 4 of Annex 1.

Exminations of exports

§ 10. A training centre approved by the Traffic Management Board shall also be considered to be approved as an examinations centre for train drivers.

§ 11. Where a training centre is to provide practical training for new or new equipment railway or rolling stock, the training centre may use teachers who have not yet obtained a certificate to cover it ; new line or rolling stock. This presupposition that the sub-victor meets other requirements including locomotive driver ' s licence, certificate and period for professional experience, cf. § 13.

Supervision

§ 12. The Management Board shall supervise the training centres which have obtained the approval of the Traffic Management Board.

Paragraph 2. The Management Board shall also ensure that railway undertakings and railway infrastructure managers are supervised solely on the basis of their own train drivers, in accordance with the rules of the establishment of the single market. section 9, via your company's security certificate.

Eksaminators

§ 13. An applicant who wishes to be approved as an examiner shall fulfil the following :

1) Applicant shall have at least 4 years of professional experience within the preceding five years before the date of the application of the substance applying for the applicant ' s examination.

2) The applicant must have carried out a railway infrastructure which is relevant in relation to the subject matter and subjects to be finals.

§ 14. In order to maintain the competence as an examiner and thus the approval of the Traffic Management Board, an examiner will teach subject matter and subject matter to rail content and to participate in appropriate training.

Paragraph 2. Drivers used as examiners in connection with the examination of train drivers shall also participate in appropriate training, cf. paragraph 1.

Censors

§ 15. An approved examiner, cf. § 13, may also act as a censor for the examination of driver drivers.

§ 16. When using censors in connection with the examination of train drivers, section 22-24 in notice no. 985 of 11. October 2011 on the certification of train drivers, use.

Registers

§ 17. The Traffic Management Board shall keep a record of approved training sites and examiners. The Traffic Management Board shall assign an individual identification number to the approved training sites and examiners. The Traffic Management Board shall publish an overview of approved training sites and examiners on the Traffic Management website.

Pensation and appeal

§ 18. The Management Board may dispense with the requirements of this notice, where it is, moreover, compatible with EU rules in this field.

§ 19. In the case of decisions taken by the Traffic Control Agency, within four weeks of the decision to be issued, the Transport Minister shall be complained to the Transport Minister.

Entry into force and transitional provisions

20. The announcement will enter into force on the eighth. November 2012.

Paragraph 2. The following rule is hereby repealed : section 19, 2. pkt., in the notice. 985 of 11. October 2011 on the certification of train drivers.

Paragraph 3. Railway undertakings, railway infrastructure managers and institutions which, on the date of entry into force of the notice, train driver for others, perform this task until 1. July, 2013, where these must have been approved as a training centre in accordance with the provisions of this notice.

Commission Decision of 22. November 2011 on criteria for the recognition of training centres involved in the training of train drivers, the criteria for the recognition of examiners for train drivers and on criteria for the testing of samples in accordance with Directive 2007 /59/EC of Parliament and of the Council

THE EUROPEAN COMMISSION HAS-

Having regard to the Treaty establishing the Functioning of the European Union,

Having regard to Directive 2007 /59/EC of the European Parliament and of the Council of 23. October 2007 on the certification of train drivers, leading locomotives and trains on the railway network in the Community 1) , in particular Article 23 (1). Article 25 (b) and Article 25 (3). 5, and

in the following considerations :

(1) If a sufficient and comparable level of training and testing for train drivers and locomotive drivers for their certification in all Member States is necessary to achieve their certification in all Member States, it is necessary to establish common EU criteria, both : in the case of procedures for the recognition of training centres and procedures for the recognition of examinations for train drivers.

(2) Training and testing should be carried out in an appropriate manner and have a reasonable and comparable level of quality in all Member States, so as to allow mutual recognition of the results of the test results.

(3) Training centres should be competent for the implementation of the training of the tender. Training centres must, in particular, have the technical and operational competence and be suitable for conducting courses and they should have adequate staff and equipment.

(4) Special provisions should be laid down for training centres which belong to railway companies or infrastructure managers who apply for safety certificates or security approvals. In order to reduce the administrative burden, a Member State should be given the opportunity to combine the recognition of such training centres with the procedure for the granting of safety certificates and security approvals.

(5) The exporter for locomotive drivers should be trained and professionally competent in the field of fabric, where they must act as examiners. The requirements concerning the competence of an examiner should address aspects such as test methods, skills and pedagogical skills. The competent authority should, for each person or unit applying to be the examiner for locomotive drivers, should check whether their professional competence is sufficient to carry out tests within their respective areas of competence.

(6) The exporter for locomotive drivers should carry out the tests in an independent and impartial manner. With this objective, the persons or entities that wish to be recognised must demonstrate to the competent authority that they comply with the requirements.

(7) The measures provided for in this Regulation are in accordance with the opinion of the Committee provided for in Article 32 of Directive 2007 /59/EC,

DECIDUON THIS DECISION :

CHAPTER 1

GENERAL PROVISIONS

ARTICLE 1

Scope and scope

This Decision lays down criteria for the recognition of training centres for training centres for train drivers and drivers of train drivers, for the recognition of examiners for train drivers and train drivers and for the train drivers and for the organisation of the train drivers and for the arrest ; of samples in accordance with Directive 2007 /59/EC.

It shall apply to :

a) training centres which provide courses for train drivers and train drivers in the areas referred to in Article 23 of Directive 2007 /59/EC;

b) the examiners for train drivers authorised to control the professional qualifications of train drivers and train drivers to be certified in accordance with the requirements of the train drivers. Article 25 of Directive 2007 /59/EC.

ARTICLE 2

Definitions

For the purposes of this Decision :

a) ' applicant ' means a unit or individual who has created a company that is applying to be recognized to provide courses in the context of the training measures referred to in Article 23 (1). In Directive 2007 /59/EC, 5 and 6 of Directive 2007 /59/EC, including a single person applying to be recognized as an examiner, cf. Article 25 (1). 1 and 2 of Directive 2007 /59/EC

b) "teaches" means a person with the appropriate skills and professional qualifications to prepare, organize and organise courses ;

c) ' examiner ' shall mean a person with the appropriate skills and professional qualifications recognised to hold and assess tests in relation to Directive 2007 /59/EC;

d) ' test ` means a course of progress where the professional qualifications of a train driver or locomotive drivers are checked in accordance with Directive 2007 /59/EC by means of one or more written, oral or practical samples ;

(e) ' training centre ` means a unit set up for the purpose of organising samples for train drivers in accordance with Article 25 of Directive 2007 /59/EC;

(f) ' recognition ' shall mean a formal declaration concerning the professional qualifications of a person or entity to conduct an education or an examination issued by an authority designated for this purpose by the Member State ;

g) ' competent authority ` means the competent authority of Article 3 of Directive 2007 /59/EC or any other body designated by the Member State, or by the competent authority, the recognition of training centres and examiners has been transferred.

CHAPTER 2

TRAINING CENTERS

ARTICLE 3

Independence and impartiality

Training centers are organising courses in an impartial manner for all participants.

In particular in the case of a training centre for the training centre for persons employed in the establishment of the training centre, but also for other people, the training must be carried out independently of the interests of the undertaking which owns it ; the training centre, and in an impartial manner to all participants. The training centre applies the same rules to persons employed in the company that owns the training centre, as in other people. Member States shall ensure that measures are taken which ensure compliance with this principle.

ARTICLE 4

Professional Qualifications Requirements

1. an applicant shall demonstrate its technical and operational qualifications and its suitability for organising courses that are in line with the training tasks. The applicant must have adequate staff and equipment and operate in an environment suitable for teaching and designed to prepare for train drivers for the purpose of obtaining licences or certificates in accordance with the Directive ; 2007 /59/EF.

2. Appepers shall in particular :

a) have an effective management structure which ensures that the underrates have sufficient qualifications and experience to provide courses in accordance with the requirements of Directive 2007 /59/EC;

b) have personnel, facilities, equipment and accommodation which are appropriate for the exchange rates and the expected number of audience participants ;

c) ensure that the practical instruction is given by teachers, both of which have a valid driver ' s licence and a valid range of road / rolling stock, which has at least three years of professional experience ; Like train drivers. If a professor is not in possession of a valid certificate for the relevant infrastructure / rolling stock, there must be a locomotive in the presence of a certificate for the person concerned, infrastructure / rolling stock, cf. in Article 4 (4), 2 (e) of Directive 2007 /59/EC;

d) indicate how they intend to secure content, organisation and duration of courses, training plans and competence plans ;

(e) be in the possession of systems for registering training activities, including information concerning participants, teachers and training courses and purposes ;

(f) have a quality assurance system or equivalent procedures for monitoring compliance and fitness of the systems and procedures to ensure that the tendering courses comply with the requirements of Directive 2007 /59/EC;

g) provide for qualification management, continuous training and measures, aimed at maintaining the professional competence of the underclass ;

(h) demonstrate that procedures shall be provided that provide for continuous updating of teaching methods, tools and equipment, including literature, teaching software and documents made available by the infrastructure manager, e.g. rules concerning the rules of operation, signalling or security systems.

3. Member States may impose additional requirements for the training of infrastructure on their own territory.

4. Applicants wishing to be recognised for education in particular communications and terminology for use in railway operating and safety procedures shall submit their application to the competent authority of the Member State in which the infrastructure is ; positioned to which the communication and terminology concerned refer to.

Article 5

Training centres owned by a railway undertaking or infrastructure manager

1. Member States may authorize an applicant who is owned by a railway undertaking or an infrastructure manager serving the sole staff of the owner and who satisfies all the requirements of Article 4 of this Decision, a combination of safety certification and security clearance in accordance with Directive 2004 /49/EC of the European Parliament and of the Council ; 2) .

2. The declaration of recognition may, in such cases, be shown on the relevant safety certificate or the appropriate security clearance.

3. the workflow and administration of the one in paragraph 1. The applicant shall be organized and structured in a way that prevents any conflict of interests.

ARTICLE 6

New or new gear and robbling equipment

The Member States may, in the context of a new and new equipment and newly introduced rolling stock, under which circumstances a recognised training centre may organise practical training exempted from Article 4 (2). (b) 2 (c).

The use of such an exemption is strictly limited to cases where there is not yet a tutor who is in possession of a certificate covering the new or newly-introduced rolling stock.

The sub-victor shall comply with all other requirements referred to in Article 4 (2). in the case of the licence and certificate, 2 (c), cf. Articles 14 and 15 of Directive 2007 /59/EC, and the period required for professional experience.

CHAPTER 3

EKSAMINATORS

Article 7

Independence and impartiality

Applicants shall confirm that they will conduct the tests in an independent and impartial manner, free of any pressure or incentive which might affect the assessment of the test results and the manner in which the sample is held.

With this aim of an eye, the competent authority shall make a declaration forming part of the application form which the applicant must sign.

ARTICLE 8

Professional Qualifications Requirements

1. Applicants must have professional qualifications and experience in the matter of the substance they wish to hold samples for.

The experience required must consist of at least four years of professional experience in the last five years before the date of the application.

The professional experience required may include periods such as the conductor of locomotive drivers in possession of a valid driver ' s licence and an additional certificate, or which is a teacher in the field of training applicable in the context of the submitted ; application.

2. In the case of practical samples on board trains, the applicant must be in possession of both a valid locomotive driver ' s licence and a valid certificate covering the test area or a similar line of rolling stock. Where an examiner is not in possession of a valid certificate for the infrastructure / rolling stock of the person concerned, there must be a locomotive present at the test, which is in possession of a certificate for the person concerned ; infrastructure / rolling stock, cf. in Article 4 (4), Point 2 (e) of Directive 2007 /59/EC.

The applicant shall have at least four years of professional experience from trains which must have been obtained over the last five years before the date of the application. The applicant ' s knowledge shall be up-to-date on the time of the application.

3. In addition, applicants must comply with the following minimum criteria :

a) they must be able to understand and speak the language equivalent to at least Level B2 of the European Framework for Language Competence (EFLC). 3)

b) they must have the skills and pedagogical skills required to conduct tests and have a deep knowledge of the relevant test methods and documents ;

c) they must show how they intend to maintain their professional qualifications in the areas where they are holding samples ;

d) they must have good knowledge of the certification scheme for train drivers.

4. Member States may lay down additional requirements for examiners who are holding tests for the Member State ' s own infrastructure.

CHAPTER 4

DETENTION OF SAMPLES

Article 9

Common criteria for the testing of samples

Samples which are designed to assess the qualifications of train drivers in accordance with Article 25 of Directive 2007 /59/EC shall meet the following criteria :

a) in the case of samples being held by two or more persons, at least the person in charge of the test must be a recognized examiner in accordance with the provisions of this Decision ;

b) in the case of the practical part of the sample affecting the driver ' s qualifications, the examiner must be in possession of a driver ' s licence and an additional certificate allowing the use of the infrastructure and driving with the rolling rolling ; material to which the sample relates, or a certificate for a similar line of rolling stock. Where an examiner is not in possession of a valid certificate for the infrastructure / rolling stock of the person concerned, there must be a locomotive present at the test, which is in possession of a certificate for the person concerned ; infrastructure / rolling stock, cf. in Article 4 (4), 2 (e) of Directive 2007 /59/EC;

c) tests must be carried out in a transparent manner and be of an appropriate length so that it can clearly be documented that all the relevant points of the Annexes to Directive 2007 /59/EC are covered ;

d) in cases where the examiner participating in the test is also the person who has taught the driver or the engine conductor in the test substance, the sample of another examiner which has not been involved in the prior instruction ;

(e) a test must be prepared, taking into account, in particular, the confidentiality of the questions expected during the test.

Article 10

New or new gear and robbling equipment

Member States may, in the case of a new or new equipment, or newly introduced rolling stock, under which circumstances a recognised examiner may hold samples which are exempted from Article 9.

The use of such an exemption is strictly limited to cases where there is still no examiner which is in possession of a certificate covering the new or newly introduced rolling stock.

The exporter shall meet all other requirements referred to in Article 4 (2). in the case of the licence and certificate, 2 (c), cf. Articles 14 and 15 of Directive 2007 /59/EC, and the period required for professional experience.

CHAPTER 5

FINAL PROVISIONS

Article 11

Transition period

If a leader in a railway undertaking or a manager of an infrastructure manager has already selected examiners intended to conduct tests for their own staff in accordance with national provisions and requirements applicable before this the entry into force of the decision, Member States may decide that such selected examiners may continue to conduct tests if the following conditions are met :

a) the operator of the railway undertaking or the infrastructure manager has selected the examiner in question in accordance with the rules of a safety certificate or a security clearance issued in accordance with Directive 2004 /49/EC and before in the field of application laid down by the competent authority, and until the end of this safety certificate or security clearance ;

b) the operator of the railway undertaking or the infrastructure manager shall verify that the selected examiners comply with the requirements laid down in this Decision ; the master of the railway undertaking or the operator must be in the railway undertaking or in the case of the infrastructure manager shall take the appropriate measures to comply with the requirements applicable to examiners.

Article 12

Use

This Decision shall apply from the 15th. May 2012.

In the case of training centres which already provide courses on the date of use of this Decision, the decision shall be used from 1. July, 2013.

ARTICLE 13

Addressees

This Decision is addressed to the Member States.
