(The replacement engines and the flexibility scheme)

§ 1

Notice no. 367 of 15. April 2011, on the limitation of air pollution from mobile non-road machinery, the following changes are made :

1. Foot notation the title of the notice shall be replaced by the following :

L 59, page 1, Commission Directive 2001 /63/EC of 17. August 2001 adapting to the technical progress of Directive 97 /68/EC, EC Official Journal 2001, nr. Directive 227, page 41, Directive 2002/88/EC of the European Parliament and of the Council of 9. December 2002 amending Directive 97 /68/EC on the approximation of the laws of the Member States relating to measures to be taken against the emission of contaminated gases and particulates from internal combustion engines to be installed in non-road mobile machinery, the Official Journal of the European Communities ; 2003, no. L35, page 28, Directive 2004 /26/EC of the European Parliament and of the Council of 21. April 2004 amending Directive 97 /68/EC on the approximation of the laws of the Member States relating to measures to be taken against the emission of contaminated gases and particulates from internal combustion engines to be installed in non-road mobile machinery, the Official Journal of the European Communities ; 2004, no. L 225, page 3, parts of Council Directive 2006 /105/EC of 20. In November 2006, adapting Directives 73 /2 3 9 / EEC, 74 /557/EEC and 2002 /83/EC concerning the environment, due to the accession of Bulgaria and Romania to the EU Official Journal of the European Union. In 363, page 368, Commission Directive 2010 /26/EU of 31. March 2010 amending the European Parliament and Council Directive 97 /68/EC on the approximation of the laws of the Member States relating to measures to be taken against the emission of gaseous pollutants and particulates from internal combustion engines to be installed in mobile non-road machinery, EU Official Journal 2010, nr. L86, page 29, as well as the European Parliament and Council Directive 2011 /88/EU of 16. November 2011 amending Directive 97 /68/EC in respect of the rules governing engines placed on the market under the flexibility scheme, 2011 EU-2011. L-305, page 1. "

2. Everything in its publication changes 'as amended by Directive 2010 /26/EU' to : 'as last amended by Directive 2011 /88/EU'.

3. I § 9 pasted as paragraph 2-4 :

" Stop. 2. The Environmental Management Board may allow the placing on the market of replacement engines for use in locomotives and motor carts if the replacement engine complies with the limit values of Stage III A, where the engine to be replaced either does not meet the steps III A limit values ; or meet the step III A limit values, but not step III B limit values.

Paragraph 3. The Environmental Management Board may authorise the placing on the market of replacement engines that do not comply with step III A limit values, for use in motor vehicles without running control and which are unable to make independent movement if the replacement engine meets a standard that is not lower than the standard that is met by engines mounted in existing engine wagons of the same type.

Paragraph 4. Permissions pursuant to paragraph 1. 2 and 3 shall be granted only if the Environmental Management Board considers that the use of a replacement engine which satisfies the requirements of the last used emission levels in the engine carriage or locomotive concerned will be associated with significant technical technical requirements ; trouble. "

4. § 12 ITREAS :

" § 12. Motors for use other than those of motor vehicles and vessels may be placed on the market in accordance with the flexible arrangements described in Annex XIII of Directive 97 /88/EC, as amended by Directive 2011 /88/EU. `

5. I Section 13 (1). 4 the following paragraph shall be inserted after ' Section 9 ` : 1, "

6. I § 13 pasted as paragraph 5 :

" Stop. 5. Engines referred to in section 9 (4). 2 or 3 must have a label with the attached "UDSKIFTNINGSMOTOR" attached to the engine. In addition, the mark must contain a reference to the authorisation given by the Environment Board. `

7. section 16 (4). 1, no. 3, ITREAS :

" 3) install or have an installed replacement engine which does not meet the requirements of section 9 or Section 13 (3) ; 4 or 4. 5, or "

§ 2

The announcement will enter into force on the 20th. December 2012.
