Publication of harmful organisms 1)

In accordance with sections 1 to 2, sections 4 to 7, 8 (8) (3). 1, sections 9-10 and § 13 (3). Paragraph 1-3 and paragraph 1. 5-7 on plant harmful organisms, cf. Law Order no. 198 of 12. In March 2009 :

§ 1. The purpose of the Bekendom is to protect against attacks and the spread of certain harmful organisms.

Paragraph 2. The following definitions shall apply to this notice :

1) Plants : Lewing plants and parts of plants, including seeds.

2) Live parts of plants, including inter alia :

a) fruit in the botanical sense, not the depth of the botanist,

b) vegetables, however not deep-frozen,

c) rods and rods, onions and grounding pins,

d) cut flowers,

(e) branches and cut trees with a leaf, or

(f) Plant tissue sculpture.

3) Seeds : Seeds in Botanical significance intended for planting.

4) Plants for planting :

a) Plants that have been planted and must remain planted or should be replanted, or

b) plants that have not been planted, but which must be planted.

5) ' Planting ` means any plant or plant parts in a growing medium for the purpose of ensuring their growth or propagation.

6) Tree :

a) Wood that has been wholly or partially preserved the natural, round surface, with or without bark or in the form of tile, shavings, sawdust, wood waste or scrap of wood, or

b) wood, in the form of garnering tree, distance, stamps, pallets or packaging materials used in the transport of objects of any kind if it constitutes a phytosanitary risk.

§ 2. The plant harmful organisms referred to in Annex 1 may not be distributed or otherwise transferred to others.

Paragraph 2. Selling plants has not been permitted in Annex 2, which is infetable by harmful organisms listed in the Annex.

Paragraph 3. Paragraph 2 shall apply mutatis muctis to the sale, distribution, supply, delivery or other form of transfer.

§ 3. Plants, plant products and the tree infetable by plant harmful organisms listed in Annexes 1 and 2 may not be moved without the written consent of the Natural Business Management Board.

Paragraph 2. The one that finds or has contradict or attacks on Diabrotica virgifera le Conte (cornrodsbille), Epitrix cucumeris (Harris), Epitrix similaris (Gentes), Epitrix subcrinita (Lec.) or Epitrix tuberis (Gentner) shall immediately report to the Natural Acquire Management Board, specifying the fundspot.

§ 4. The Office of the Natural Vocational Management Board that the harmful organisms covered by Section 2 have been spread or that there is a danger, the Directorate may provide for measures to combat these harmful organisms, including isolation or destruction of plants, plant products and packaging resulting from infective risk.

Paragraph 2. If the Management Board finds that there is imminent danger of propagation of other harmful organisms other than those listed in Annex 1 and 2 or harmful organisms listed in Annex 2 to other plants other than those referred to in Annex 2, the Management Board may provide for measures as referred to in paragraph 1. 1.

§ 5. The destruction of plants and so on shall be carried out in accordance with the rules laid down in the notice of waste.

§ 6. The Office of the Natural Acquids may lay down a deadline for the implementation of tendered measures.

Paragraph 2. The Management Board shall allow the measures to be carried out for the account of the owner or user in question to be carried out on the required time limit.

§ 7. The National Services Authority shall check that the notice is complied with.

Paragraph 2. Companies must, as far as possible, provide information on the origin and forwarding evidence of where these plants have been purchased.

§ 8. In accordance with section 5 of the Act on Plant organisms, the Management Board may, in accordance with section 5, be free of charge of plants, etc. for the examination of whether the material is infetable by harmful organisms.

Paragraph 2. Plants and others covered by an investigation pursuant to paragraph 1. 1 where there is a reasoned request for the material to be attacked by harmful organisms, shall not be removed without the written consent of the Management Board.

§ 9. in accordance with the notification of imports and movement of harmful organisms, the Danish Agency may authorize the derogation from the provisions of section 2, where the derogation does not result in the risk of spreading ; of harmful organisms.

§ 10. Unless higher penalties have been inflished on any other law, the penalty shall be penalised by the penalty which :

1) is in violation section 2, section 5, section 7, paragraph 7. 2, section 8 (4). 2,

2) omits to comply with the measures taken pursuant to Article 4 or in accordance with section 9.

Paragraph 2. Companies can be imposed on companies, etc. (legal persons) punishable by the rules of the penal code 5. Chapter.

§ 11. The announcement shall enter into force on 1. January 2013.
