Chapter 1

Scope

§ 1. This Order applies to the preparation of elinstallationsrapporter under the Consumer Protection Act on the acquisition of real property Elinstallationsrapporter prepared for the property referred to in § 1 of the Law on consumer protection on the acquisition of real property, etc.

Chapter 2

Scheme Governance

§ 2. The system of elinstallationsrapporter managed by the Safety Technology Authority.

PCS. 2. Safety Authority handles administration of the scheme, including

1) develop and maintain lists of authorized electrician companies in the scheme,

2) charge an administration fee for each elinstallationsrapport with electrician companies

3) receives and records elinstallationsrapporter and tells a serial number for each elinstallationsrapport,

4) inform the electrician companies in the scheme, the scheme and the administration of the scheme

5) through overseeing prepared elinstallationsrapporter and

6) compiles statistics on elinstallationsrapporterne.

PCS. 3. The administration fee is 77 kr. For each elinstallationsrapport.

PCS. 4. The maximum amount for the establishment of a elinstallationsrapport (review of the building's electrical systems and preparing elinstallationsrapport) appear in Annex 1 to this Order. The maximum amount is regulated by the Safety Technology Authority with effect from 1 January each year, the Statistics Denmark's index. The adjustment is based on the annual percentage change in the consumer price index, calculated from the index in September.

Chapter 3

Definition

§ 3. For the purposes of this Order elinstallationsrapport: A report containing the results of the review of the building's electrical systems, and informing the extent to which the building's electrical systems are operational and legal under public law.

Chapter 4

Conditions for preparation of elinstallationsrapporter

§ 4. Only authorized electrician enterprises referred. Act on the authorization of electricians, etc., where the person authorized electrician is licensed as head employed, see. § 4, paragraph. 1 and 2 of the Decree on authorization and operation of electrical installations company may develop elinstallationsrapporter under this ordinance.

PCS. 2. The authorized electrician company must be registered in the system via Security Agency information and registration system in accordance with the relevant guidelines on www.eleftersynsinfo.dk before elinstallationsrapporter can be prepared.

PCS. 3. Authorized electrician companies that join the scheme must be covered by a professional liability insurance. Liability insurance The scope and conditions must be equivalent to what in general is achievable in the insurance market, covering at least 5 years after the transfer to the buyer of a property that the certified electrician company has prepared elinstallationsrapport on, however, the longest for 6 years from the report date .

§ 5. The authorized electrician company must opt ​​out of the scheme, when the company no longer meets one or more conditions to be signed up for this.


§ 6. The right to be enrolled in the scheme for the preparation of elinstallationsrapporter lapse if the authorized electrician company's authorization lapses or is revoked pursuant to § 8 paragraph. 2, or § 9 paragraph. 1 of the Act on the authorization of electricians etc.

Chapter 5

The procedure for preparation of elinstallationsrapporter

§ 7. The authorized electrician business when preparing elinstallationsrapporter

1) follow Security Agency guidelines for review of the building's electrical systems and for the preparation of elinstallationsrapport on the basis of the review,

2) comply with the rules on the remuneration of elinstallationsrapporter and for payment of an administrative fee for each elinstallationsrapport, see. § 2. 3 and 4,

3) the reporting and payment of the administration fee avail Safety Authority's web-based information and registration system,

4) be independent of each case, so that the certified electrician activity should be independent of interests that could affect the preparation of elinstallationsrapporten,

5) refusing to accept booking for elinstallationsrapport from the seller's estate agent,

6) not to condition the preparation of elinstallationsrapporten that are purchased services other than elinstallationsrapporten,

7) refrain from attempting to influence the implementation of oversight in accordance. § 16, including by contacting or otherwise affect the owner of the property that supervision concerns, and

8) endorse the decisions Board for Technical Installations shall, unless the authorized electrician company within 30 days of notification of the decision has informed the Board that it did not wish to be bound by the decision.

Chapter 6

Review of the building's electrical

§ 8. The review of the building's electrical systems are intended to clarify the extent to which the building's electrical systems are operational and legal under public law, see. § 2 a paragraph. 3 of the Act on consumer protection by the acquisition of real estate, etc. The review non-functionality and illegalities about the electrical installation are covered, including factors such as the short or long term, present a risk of injury or fire.

PCS. 2. Consideration of the building's electrical installations must be performed with professional care and using the insight and experience that can be expected by a qualified electrician business. The review is to be visual and must be examined, with the use of appropriate technical means, but without the destructive intervention, unless otherwise agreed.

PCS. 3. Consideration of the building's electrical systems include control of, among other electrical panels, including control measurement of RCDs. The review also includes control of, among other equipment behind the switches, sockets and junction box, lavvoltsinstallationer, control of elinstallationens dimensioning and control of protection against direct and indirect contact with live parts.

PCS. 4. Wiring behind removable and retractable parts of the electrical installations must be carried out on samples.

§ 9 for the examination of the building's electrical systems and preparing elinstallationsrapporten fall

1) trivial matters, including normal wear and tear, which is normal for an electrical installation with that age and are not likely to affect elinstallationens performance significantly,

2) parts of the electrical installation that could not be checked, see. § 13 paragraph. 1

3) electrical installations outside of the building itself,

4) appliances,

5) other utility items, except for recessed and fixed appliances used for heating and

6) assessment of the electrical installation to date.

§ 10. For the purpose of the review of the building's electrical installations, the authorized electrician business ask the owner or his representative for information on elinstallationernes performance.

§ 11. The authorized electrician company can with the limits imposed by § 7, no. 4 and 6, outside huseftersynsordningen assume benefits beyond the review of the building's electrical and elinstallationsrapporten, for example, estimates of the costs of repair.

Chapter 7

Elinstallationsrapporter


§ 12. Elinstallationsrapporten shall include the verification of the building's electrical installations and must be prepared in a form approved by the Safety Technology Authority. The authorized electrician entity prepares elinstallationsrapporten to the person who commissioned the report, and transmit the report electronically to Safety Authority via the Internet-based information and registration system, see. § 7, no. 3, within 14 days after the audit of the building's electrical installations are made.

§ 13. In elinstallationsrapporten must be disclosed if the authorized electrician company in connection with the review of the building's electrical considers that a part of the electrical installation is unavailable, and if so, for what reason that this part of the electrical installation is unavailable.

PCS. 2. If the authorized electrician business that there is uncertainty about information that has been available from the owner or his representative in connection with the review of the building's electrical installations, that fact and the reason for the uncertainty is disclosed in elinstallationsrapporten.

§ 14. Elinstallationsrapporten must be drawn up or renewed less than 1 year before the date on which the buyer of the property receives the report referred to. § 4 a paragraph. 1 of the Consumer Protection Act on the acquisition of real property, etc.

PCS. 2. For the renewal of elinstallationsrapporten determines the authorized electrician business to what extent, a new review of electrical installations are required and thus reduced the remuneration to be paid. The new report produced for the person who ordered the renewal, and the report transmitted electronically to Safety Authority via the Internet-based information and registration system, see. § 7, no. 3, no later than 14 days after the new report is prepared. The new report comes with prospective effect instead of the original.

§ 15. In preparing elinstallationsrapporter relating to condominiums, there must be elinstallationsrapporter under this Order both for the owner of the apartment and the common property electrical installations.

Chapter 8

Supervision

§ 16. Safety Agency carries out constant monitoring of compliance with this Order.

PCS. 2. Supervision includes overseeing the quality of the elinstallationsrapporter, including a review of the building's electrical installations and supervision of approved electrician companies preparing elinstallationsrapporterne.

§ 17. Safety Agency may, provided that a qualified electrician business is not spontaneously opt out of the scheme, see. § 5, decide to opt out of the authorized electrician business.

Chapter 9

Appeals

§ 18. Security Agency's decisions under this Order may not be brought before another administrative authority.

Chapter 10

Entry into force

§ 19. This Order shall enter into force on 1 May 2012.

Remuneration to authorized electrician companies that produce elinstallationsrapporter
The maximum amount provided per. May 1, 2012 and includes costs for expenses, mileage, insurance, etc. The maximum amount includes the review of the building's electrical systems and preparing elinstallationsrapport.
